APPENDIX 1Legislative Context and ChangesThe NSW Department of Education and Training derives manyof its powers, functions and responsibilities from the EducationAct 1990 which provides for the establishment and operation ofgovernment schools and from the Technical and Further EducationCommission Act, 1990 which establishes the Technical and FurtherEducation Commission.In addition the NSW Department of Education and Trainingadministered the following Acts in 2001:Australian Catholic University Act 1990Australian William E Simon University Act 1988Board of Adult and Community Education Act 1988Board of Vocational Education and Training Act 1994Charles Sturt University Act 1989Education (Ancillary Staff) Act 1987Higher Education Act 1988Higher Education (Amalgamation) Act 1989Industrial and Commercial Training Act 1989Macquarie University Act 1989Moree and District War Memorial Educational Centre Act 1962Parents and Citizens Associations Incorporation Act 1976Sancta Sophia College Incorporation Act 1929School Forest Areas Act 1936Teacher Housing Authority Act 1975Teachers’ College Act 1912Teaching Services Act 1980Technical Education Trust Funds Act 1967University of New England Act 1993University of New South Wales Act 1989University of Newcastle Act 1989University of Sydney Act 1989University of Western Sydney Act 1988University of Wollongong Act 1989West Scholarship Act 1930Women’s College Act 1902During 2001 Parliament passed three Acts that fall within theadministration of the Department of Education and Trainingbut which did not commence operation within that year.The Apprenticeship and Traineeship Act 2001 commenced on 1January 2002 and repeals the Industrial and Commercial TrainingAct 1989. The Universities Legislation Amendment (Financial andOther Powers) Act 2001 commenced on 1 March 2002. The HigherEducation Act 2001 will replace the Higher Education Act 1998but has not commenced at the time of reporting.There were some other legislative changes in 2001. The Technicaland Further Education Commission Act 1990 was amended toallow the Commission to exercise its functions outside NewSouth Wales and the proposed date of repeal of the School ForestAreas Act 1936 was postponed until 30 June 2003.In addition the Education Regulation 2001 was made to replacethe equivalent Education Regulation 1996 and the EducationTeaching Service Regulation 2001 replaced the Teaching Services(Education Teaching Service) Regulation 1994 with some changesbeing made to its teacher discipline provisions.There were no significant judicial decisions affecting theDepartment or the users of the services provided by theDepartment.APPENDIX 2Controlled EntitiesNames of ControlledEntitiesNSW Adult MigrantEnglish ServiceNSW TAFECommissionTAFE GLOBALPty LtdDetails of Objectives, Operations and ActivitiesThe NSW Adult Migrant English Service (AMES) helps newly-arrived migrantsto study English, enabling them to participate in the community, educationand work. AMES is recognised throughout the world as a high-quality providerof language and literacy education. Courses are offered at AMES centres,workplaces and community venues and through distance education and hometutoring.The NSW TAFE Commission (TAFE NSW) is the largest provider of vocationaleducation and training in Australia. TAFE NSW offers a wide range of nationallyrecognised courses at more than 120 campuses across the State. Eleven TAFEinstitutes and a world class distance education facility, the Open Training andEducation Network, deliver programs and vocational education and trainingservices to meet the needs of industry and the community.TAFE GLOBAL Pty Ltd is a wholly owned entity of the NSW TAFE Commission.TAFE GLOBAL Pty Ltd was incorporated in 2000 and commenced operationsin 2001.
