mayor’s messageFirst, I would liketo congratulate ourgraduating seniors fromhigh schools, colleges anduniversities and extendon behalf of the Cityour very best to you asyou embark upon highereducation or your careers. We hope that youwill enjoy this once-in-a-lifetime momentwith your families and friends and withoutany tragedy. It seems that we often hear whenthe jubilation of graduation results in overindulgence of alcoholic beverages which canresult in loss of life. Please use common sense,enjoy this great time of your life and may it bethe beginning of a wonderful future for eachof you.Looking Back at Memorial DayMemorial Day was an outstanding time ofremembrance by this community. The numberof people who lined the parade route and thenattended the solemn ceremony at <strong>Brecksville</strong>Highland Cemetery was remarkable. I thankeach and every one of you for attending andthose who participated in this year’s parade.It truly was one of our largest gatherings aswe remembered the 60th anniversary of theArmistice that ended the Korean War, thecoming of the 150th anniversary of the Battleof Gettysburg in July, and the service of thegreat men and women of this communitywho went off to war and made the ultimatesacrifice. We remembered those who servedthis country and by the grace of God returnedand became integral parts of our community,and also those who came back from war withwounds to their bodies or minds and todayare still impaired with limited quality of life.We remembered those still missing in action,the POWs and, of course, we pray for thebrave men and women who are in harm’sway each and every day defending our idealsboth here and abroad. We were pleased tohave Congressman David Joyce participatein the parade and extend Memorial Daygreetings at the ceremony. Also attending wereall members of City Council and membersof the <strong>Brecksville</strong>-Broadview Heights CitySchool Board. We were also honored by thepresence of a graduate of the United StatesMilitary Academy at West Point, who 48hours before our ceremony graduated and wascommissioned a Second Lieutenant. DavidG. Hamski, a graduate of BBHHS in 2009,was our Memorial Day speaker. We offered toSecond Lieutenant Hamski and all who haveserved this country, our full faith and trust intheir courage, dedication and love of country.Also present and honored were MidshipmanJackson P. Morgan, Naval Academy Classof 2016 and Cadets A. J. Cook and BradleyErnst, Class of 2016 at West Point.We were again honored by World War IIveterans – First Lieutenant <strong>Home</strong>r Farr andCaptain Ben Jeremiah, U. S. Army Air Corps,who led the Pledge of Allegiance. We thankthe <strong>Brecksville</strong>-Broadview Heights HighSchool Marching Band, <strong>Brecksville</strong> AmericanLegion Excelsior Post 196 and the Women’sAuxiliary, our Boy Scouts and Girl Scouts,the <strong>Brecksville</strong> Women’s Club and all thosewho participated in the parade and ceremony.Finally, we recognize the names of thoseburied at our cemetery who perished in thewars our nation has fought since the AmericanRevolution. We made special note of DennisRust, a <strong>Brecksville</strong> young man who died inKorea, and we remembered that one yearago, Gold Star Mother Paula Kancler spokewhen we unveiled the monument for SergeantDennis E. Kancler, our Marine who died inAfghanistan in 2011. Lest we never forget.Our cemeteries and City grounds all lookedwonderful on Memorial Day because of theefforts of our Horticulture Department andour City’s Beautification Committee whotogether with our summer employees, design,plant and maintain our flowers and shrubsthroughout the community. Thank you foryour efforts and for beautifying our City.Summer Is Finally Here!Summer was teasing us in May butnow it is time to sign up for the summerprograms at the Community Center and theHuman Services Center. I encourage yourparticipation throughout the summer and intothe fall. Please remember, both at work andplay, to be safe and don’t forget that accidentsat home can be avoided with proper care andattention. I also caution you when traveling,to always be aware of your surroundings anddo not make yourself an easy victim for theftand other crimes that often occur as a result ofcriminals taking advantage of those traveling.Please use caution during whatever you aredoing throughout the summer.The Color OrangeOur road program is well underway; manyphases of our concrete repairs are completedand soon we will begin repaving our asphaltroads. I continue to commend and thank ourservice workers who do the bulk of our roadprogram. We are one of a few cities who paveour streets with asphalt by utilizing our ownmanpower and equipment. We contract outthe milling of the current surface but replacethe milled area with asphalt with our owncrews. We also do smaller concrete repairs,mainly sidewalks, aprons, areas around catchbasins, as well as crack-filling and othergeneral maintenance to our roads, saving ourtaxpayers hundreds of thousands of dollarsin manpower and equipment rental eachyear. We are in the process also of replacingall traffic signs to comply with the newfederal reflective regulations as well as heightregulations. (Yes, that is why the stop signsare tall.) Each year our roads are reviewed andgraded and those receiving the lowest gradeare the ones first repaired. In locations wherewe are repairing concrete roads we often dojust sections of the roadway at a time to limitthe inconvenience to the residents and at thesame time “spread the dollars” so that we canattend to as many streets as possible in areasthat are in less than optimum condition.Please have patience with our workers andunderstand that there may be delays, butwhen the work is complete you will have yearsof use that will be uninterrupted. I commendService Department Director Ron Weidigand his staff as well as thank the Streets &Sidewalks Committee of City Council fortheir support throughout the road programseason.There’s a Knock at the DoorRecently, residents have expressed concernregarding door-to-door solicitations. council cornerNow that the warm summer weather is finallyupon us, we can all look forward to our annual<strong>Home</strong> <strong>Days</strong> celebration. This year, <strong>Home</strong> <strong>Days</strong>will run from Friday June 28th through SundayJune 30th. Please review this edition of theBulletin for all of the programming and eventdetails to enjoy with your family and neighbors.As we celebrate the July 4th holiday, please keep in mind our militaryservice men and women who volunteer to serve and keep us safe andpreserve our freedom. Most especially, keep in your thoughts andprayers those who have given the ultimate sacrifice while serving ourgreat country.As mentioned in the previous Bulletin, our annual roadmaintenance program is underway once again this year. Shortlyafter <strong>Home</strong> <strong>Days</strong>, Route 82 will be closed in both directions fromHighland to Old Royalton Road near the Broadview Heights borderfor two weeks in order to replace a storm sewer running underneaththe roadway which has failed and caused a large slippage along thenorthern side of the roadway. Please be mindful of the workers andtheir equipment and we appreciate your patience while dealing withthe required detours.Finally, the annual Kiwanis Horse Show will once again returnto the Metroparks on Sunday August 4th from 9am-10pm and the<strong>Brecksville</strong> Historical Association will host its annual Corn Roast onSunday, August 18 from 1-5pm.Have a safe and enjoyable summer!Greg Skaljac,City Council Presidentbuildings & groundsLouis N. Carouse, Jr.Buildings and Grounds will have a busy summeras many projects will be underway and severalnew ones will be proposed and implemented. Thebids for the Blossom Service Garage have beenreceived and a contract awarded to Seitz Buildersfor $1,357,000.00. The old existing Boiler Houseon the site just west of the Synthetic Turf Field will be razed; site workis now underway. The completion of the project is scheduled for thisNovember. Related services for the construction of the Service Buildingapproved by the Committee were to CTL Engineering for materialtesting services for $4,900.00 and to D.G. Bohning and Associates forengineering and surveying as needed not to exceed $10,000.00.The Center for the Arts Building will have exterior ductwork doneby Bell Insulation Service Co. for $5,020.00. As previously reported,the Highland Drive Cemetery has very few graves remaining. TheCity Engineer has plotted 60 additional graves that will be offered forsale in July or August of this year. Future planning may result in a newcemetery to be placed at the Blossom Hill Complex.Later this summer we expect to consider a recommendation on theReports from committee chairpersonsvarious projects planned for <strong>2013</strong> including roof repairs and replacementsfor the Community Center. BroskIThe <strong>2013</strong> Road Program is underway. ConcreteRepairs will be performed on: Orianna, LogCabin, Deer Run, Old Orchard at Hickory Ridge,Gatewood, Boxelder, Seth Payne entrance, Riverviewnorth hill, Chautauqua, Hinckley and Hinckleycul-de-sac, Potomac, Crabtree at Timber Trail,Meadow Lane, Lake Park, Windswept at SR-82, OldRoyalton, and the municipal parking lot. Other components of the <strong>2013</strong>Road Program contract include partial depth joint repairs, crackfilling,pulvamixing, asphalt placement, painting striping, and Reclamiteapplication.The City of <strong>Brecksville</strong> is entering an agreement with the CuyahogaCounty Department of Public Works for the completion of pavingprojects on Miller Road from Katherine Blvd. to Barr Road and8343 Riverview Road to SR-82. Snowville Road improvements willbe performed in the year 2014 due to other projects that need to becompleted along the roadway prior to paving. The City has agreed to useits staff and equipment to pave the roads, and the County will reimbursethe City of <strong>Brecksville</strong> for the costs of materials. The total costs for allthree projects are estimated at over $1.7 million.State Route 82 will be closed from Highland Drive west to OldRoyalton Road for a two-week period this summer during theconstruction of a culvert replacement project. The exact time frameof the road closure will be announced as soon as information becomesavailable.Please be safe in your travels throughout the City by obeying speedlimits and signs, especially in or around construction zones.4


utilities Michael HarwoodWe would like to provide status of the upcomingmainline capital utilities projects that are scheduledfor completion during the <strong>2013</strong> construction season;;1. Mercer Lane Sanitary & Storm SewerReplacement Project; the necessary temporary andpermanent easements have been obtained. ThePurchasing Director will be advertising for publicbids following City Council approval.2. Route 82 Culvert Repair/Replacement Project; the ODOT reviewhas been completed, the project was issued for public bid, andcontract awarded. Final ODOT service agreements are beingfinalized, with a potential construction start of July 1, <strong>2013</strong>. Pleasenote as part of this project, S.R. 82 will be closed for a maximumof 2 weeks. The detour route and notification will be postedprior to the closure.3. The following four (4) projects have the design and constructiondocuments in production (approximately 85% complete), withthe necessary temporary and/or permanent easement identificationcomplete. Once the easements have been received and executed thedesign and construction documents will be completed for public bidissuance.a) Amber Lane Stream Relocation and Roadway Project,b) 6755 Rivercrest Drive & Storm Sewer Repair Project,c) 9755 Whitewood Road Storm Sewer Repair Project,d) 7603/7635 Amber Lane Storm Culvert Replacement Project.4. City Council isrequired to submit any proposal, as recommendedby the Charter Review Commission, to the electorsfor a vote. I encourage all residents to review theinformation available on the City’s webpage regarding the proposedchanges and to contact members of City Council or Mayor Hruby withany questions. We appreciate the Committees’ hard work and lookforward to receiving the recommendations.The City’s codifier, American Legal Publishing Corp., preparesan annual supplement to the <strong>Brecksville</strong> Code of Ordinances thatcontains all ordinances of a general and permanent nature that havebeen enacted by City Council since the re-codification of subsequentsupplements to the code. American Legal Publishing also recommendsrevisions and/or supplementation to certain sections of the <strong>Brecksville</strong>Code which are based upon or make reference to certain sections ofthe <strong>Ohio</strong> Revised Code. Recently City Council passed an ordinance toenact and adopt a supplement to the <strong>Brecksville</strong> Code.When a proposed change is being considered, it is the responsibilityof the Legislation Committee to make recommendations to CityCouncil regarding amendments and/or supplements to the City of<strong>Brecksville</strong> Code of Ordinances.Should you ever wish to review the <strong>Brecksville</strong> Code of Ordinances, acomputerized version is available to you for reference at the <strong>Brecksville</strong>Branch of the Cuyahoga County Library. The annual premiums are $97,876for Property, Boiler, Inland Marine Insurance,$28,853 for Umbrella Insurance, $20,853 forPublic Officials Liability Insurance, and $11,776 for the City’s LawEnforcement Liability Insurance.At the March 19th meeting, City Council authorized the issuance ofa grant in the amount of $5,618.85 to the <strong>Brecksville</strong> Center for theArts for the purchase of a laptop computer, audio-visual equipment,specialized equipment for the ceramics studio, and a pottery wheel.After determining additional capacity to allow it, City Council hasauthorized expansion of the pilot program allowing a limited numberof non-resident, city income tax paying employees, access to theCommunity Center. The proceeds from the annual fees paid by thesemembers have provided the City the opportunity to purchase andupgrade equipment at the Community Center without impacting theCity’s regular budget.Payment of the monthly professional bills was made for legal,architectural, and engineering services in the amount of $31,287.29 inMarch, $34,109.05 in April, and $32,742.27 in May.As was outlined in the Mayor’s report in the last Bulletin issue,City Council and the Administration continue to seek feedbackregarding the Mayor’s income tax credit recommendation to generateadditional revenue that would allow for the possibility of fundingvarious important projects and improvements to the Fire Department,Community Center, Old Town Hall, Police Department, and theBlossom Hill Complex. <strong>Brecksville</strong> City Ordinance on Door to Door SolicitationsThere are two types of door-to-door solicitations, commercial andnon-commercial. An example of commercial solicitation is doorto-doorsales. Examples of non-commercial solicitation are religiousgroups, political canvassers, and even trick-or-treaters.Door-to-door solicitation and sales have long been a part of ournation’s commerce. Valuable causes have been promoted by noncommercialsolicitation. Think of petitions, candidates, churches,and the free exchange of ideas which form the foundation of ourdemocracy.However, you may not want strangers approaching your home. Areview of federal law and City of <strong>Brecksville</strong> Ordinances concerningdoor-to-door solicitation can help you understand your rights.In 2002, the United States Supreme Court weighed in on the issueof non-commercial solicitations. In Watchtower Bible & Tract Societyof New York, Inc. v. Village of Stratton, the Court decided that aregulation must be narrowly tailored to a municipality’s interest inprotecting its residents from crime and fraud, but it cannot reach toofar in scope to prohibit noncommercial canvassers promoting a varietyof causes.In Watchtower, the petitioner was a religious organization thatcoordinated the preaching activities of Jehovah’s Witnesses. It sueda small town in southern <strong>Ohio</strong>, seeking an injunction against theenforcement of several sections of an ordinance regulating uninvitedpeddling and solicitation on private property in the town.The ordinance prohibited canvassers and others from going in andupon private residential property for the purpose of promoting anycause without first obtaining a permit from the mayor’s office.After striking down the town’s regulation on noncommercialsolicitors, the Court noted that the annoyance caused by an uninvitedknock at the door is the same whether or not the visitor is armed witha permit. The Court further noted that it was unlikely that the absenceof a permit would preclude criminals from knocking on doors andengaging in conversations not covered by the ordinance.One section of the town’s ordinance that the petitioner did notchallenge established a procedure by which a resident may prohibitsolicitation even by holders of permits. Where residents posted a “NoSolicitation” sign on their property, no uninvited canvassers mayenter the property unless they are specifically authorized to do so.<strong>Brecksville</strong>’s Codified Ordinances protect residents who do not desirecontact from solicitors:§ 705.01 DEFINITIONS. For the purpose of this chapter, thefollowing definitions shall apply unless the context clearly indicatesor requires a different meaning. CANVASSING, CANVASSER,SOLICITATION or SOLICITOR. Includes any person who callsat residences or places of business without the invitation or previousconsent of the owner(s) or occupant(s) of such premises for thepurpose of any one or more of the following activities: (1) Seekingto obtain orders for the purchase of goods, wares, merchandise,foodstuffs or services of any kind, character or description whatever,for either present or future delivery; or (2) Seeking to obtainprospective customers for application or purchase of insurance ofany type, kind or character; or (3) Seeking to obtain subscription tobooks, magazines, periodicals, newspapers and every other type orkind of publication; or ( 4) Seeking to obtain contributions or to sellany goods, articles or services of any kind for the support or benefitof any charitable, religious or nonprofit association, organization,corporation or project; or (5) Seeking to obtain from an occupantof any residence an indication of such occupant’s belief in regard toany social, political or religious matter, or ( 6) Seeking to influencethe personal belief of the occupant of any residence in regard to anysocial, political or religious matter; or (7) Taking of a poll or censusby any person, firm or corporation other than a governmental bodyor agency thereof.§ 705.02 NOTICE PROHIBITING CANVASSING ORSOLICITATION. Notice by the owner(s) or occupant(s) of anyresidence or place of business of the determination to refuse toreceive any uninvited canvassers or solicitors shall be given bydisplaying a weatherproof card, decal or sign not less than threeinches by four inches in size nor more than one square foot in totalsurface area upon or near the main entrance door to the residenceor place of business indicating such determination by the owner oroccupant, containing the words “No Solicitors Invited” with lettersat least one inch in height. Any such sign which complies with therequirements of this section shall be exempt from any additionalor different requirements contained in the provisions of Chapter1187 of the Planning and Zoning Code. (Ord. 3284, passed 7-6-93) Residents wishing to prevent contact from solicitors, eithercommercial or non-commercial, can post the small sign and expectprivacy. Solicitors who ignore the sign and try to get the attention ofthe home’s occupant will violate the Ordinance below:§ 705.03 CANVASSING OR SOLICITATION INVIOLATION OF NOTICE. It is unlawful and shall constitute atrespass for any person to go upon any premises and ring the doorbell upon or near any door, or rap or knock upon any door, or createany sound in any other manner calculated to attract the attention ofany occupant of such residence or place of business for the purposeof securing an audience with the occupant(s) thereof and engage incanvassing as defined in§ 705.01, in defiance of the notice exhibitedat the residence or place of business in accordance with the provisionsof § 705.02.
