In Africa, concern has been expressedabout the way the new biofuel <strong>in</strong>vestments may result<strong>in</strong> the loss of rights over l<strong>and</strong> on the part of localcommunities (Scott, 2009). With <strong>in</strong>terest <strong>in</strong> allocat<strong>in</strong>gl<strong>and</strong> for biofuel expansion the security of l<strong>and</strong> tenure<strong>and</strong> access or use rights on the part of local residentcommunities across rural could be compromised(Kamanga, 2008; Sulle & Nelson, 2009b). Table 7summarizes concerns <strong>and</strong> impacts of biofuels<strong>in</strong>vestments on l<strong>and</strong> tenure <strong>in</strong> <strong>Tanzania</strong>.Although at any rate as far as <strong>in</strong>vestment on l<strong>and</strong> isconcerned, foreign <strong>in</strong>vestors are required to have ashare with <strong>Tanzania</strong>ns. However, the amount of share<strong>Tanzania</strong>ns have been given is very, very small, forexample, <strong>in</strong> the case of Sun Biofuel Plc's it is only 1%for two <strong>Tanzania</strong>ns. In <strong>Tanzania</strong> l<strong>and</strong> act provides for the conversion ofcustomary tenure to leasehold for under 99-year leases.• Is caus<strong>in</strong>g tensions as <strong>in</strong>vestors’ <strong>and</strong> requirements come <strong>in</strong>toconflict with those of communities.• Lack of transparency <strong>in</strong> the way the <strong>in</strong>vestment is tak<strong>in</strong>g placeparticularly regard<strong>in</strong>g the allocation of l<strong>and</strong> is lead<strong>in</strong>g to conflict.• Insufficient proper consultation <strong>and</strong> poor underst<strong>and</strong><strong>in</strong>g oftraditional l<strong>and</strong> authority on biofuel <strong>in</strong>vestment proposed on l<strong>and</strong>is likely to compound even more <strong>in</strong> future the conflicts betweenbiofuel commercial producers <strong>and</strong> local community.• Local people <strong>in</strong>cur substantial opportunity costs <strong>in</strong> grant<strong>in</strong>g largeareas of l<strong>and</strong> to <strong>in</strong>vestors, which are not be<strong>in</strong>g factored <strong>in</strong>toexist<strong>in</strong>g assessments of l<strong>and</strong> values.• Payment of compensation limited to loss of crops <strong>and</strong> treesexclud<strong>in</strong>g loss of l<strong>and</strong> itself underm<strong>in</strong>e the position <strong>and</strong> welfare oflocal people.• Rights to use l<strong>and</strong> for graz<strong>in</strong>g, firewood collection, or wild fruitgather<strong>in</strong>g stipulated <strong>in</strong> traditional l<strong>and</strong> tenure systems is shutteredas the result of biofuel <strong>in</strong>vestment on the l<strong>and</strong>.• Common l<strong>and</strong>s are officially unrecognized <strong>and</strong> therefore <strong>in</strong>eligiblefor compensation by biofuel <strong>in</strong>vestors thus compromis<strong>in</strong>g local<strong>in</strong>terests <strong>and</strong> rights.• Loss of local villagers forest-based economic activities, <strong>in</strong>clud<strong>in</strong>gcommercial charcoal production <strong>and</strong> harvest<strong>in</strong>g forest products.• Loss of US $35-50 generally unaccounted-for per capita <strong>in</strong>come,which have been estimated by World Bank from <strong>in</strong>formal <strong>and</strong> non<strong>in</strong>dustrialuses of forests <strong>in</strong> <strong>Tanzania</strong>.• Loss of forests which, provide 75% of all build<strong>in</strong>g materials, 95%of household energy supplies <strong>and</strong> 100% of traditional medic<strong>in</strong>es.• The community loss of l<strong>and</strong> without receiv<strong>in</strong>g compensation,Lal, 2006; Envirocare,2007; Kamanga, 2008;Sulle & Nelson, 2009b ;Sulle, 2009b.ABN, 2007; Kamanga,2008;Oxfam International,2008;Sulle 2009a, b.ABN, 2007; Action Aid,2010; Cotula et al., 2009;Knaup, 2008; Rughani,2009; Sulle & Nelson,2009a; Sulle 2009a, bAction Aid, 2010;Scott,2009;Sulle & Nelson,2009a;Sulle2009a,b.Kamanga, 2008;WorldBank, 2007; Sulle &Nelson, 2009b; Sulle 2009a, b.2698
