The <strong>Arab</strong> <strong>Steel</strong> Summit<br />

2011, which was held<br />

<strong>in</strong> Doha <strong>in</strong> April, tackled<br />

an array of key issues,<br />

<strong>in</strong>clud<strong>in</strong>g competitiveness,<br />

growth strategies and <strong>in</strong>vestment<br />

opportunities <strong>in</strong> the sec<strong>to</strong>r.<br />

The three-day conference,<br />

under the patronage of HE<br />

the M<strong>in</strong>ister of Energy and Industry<br />

Dr Mohamed Saleh al-<br />

Sada, was jo<strong>in</strong>tly organized by<br />

the <strong>Arab</strong> Iron and <strong>Steel</strong> Union<br />

(AISU) and Qatar <strong>Steel</strong>. Two key<br />

<strong>to</strong>pics discussed were the “<strong>Arab</strong><br />

steel <strong>in</strong>dustry: competitive position<br />

and growth strategies” and<br />

“Opportunities and trends of<br />

<strong>in</strong>vestment <strong>in</strong> the <strong>Arab</strong> region”.<br />

On the sidel<strong>in</strong>es of the summit,<br />

AISU held the International<br />

<strong>Steel</strong> Exhibition 2011 which<br />

showcased various products<br />

and solutions that help enhance<br />

the <strong>in</strong>dustry’s productivity.<br />

The summit provided a platform<br />

for <strong>in</strong>teraction among producers,<br />

companies and <strong>in</strong>stitutions<br />

specialized <strong>in</strong> the steel <strong>in</strong>dustry.<br />

<strong>Arab</strong> steel <strong>in</strong>dustry, whose production<br />

is expected <strong>to</strong> <strong>to</strong>uch<br />

20 million <strong>to</strong>nnes this year and<br />

24 million <strong>to</strong>nnes by 2014, will<br />

require massive <strong>in</strong>vestments<br />

for enhanc<strong>in</strong>g its share <strong>in</strong> the<br />

<strong>world</strong> steel production, accord<strong>in</strong>g<br />

<strong>to</strong> AISU.<br />

Demand for steel <strong>in</strong> the <strong>Arab</strong><br />

<strong>world</strong> is expected <strong>to</strong> <strong>to</strong>uch 60<br />

million <strong>to</strong>nnes by 2014 and 70<br />

million <strong>to</strong>nnes <strong>in</strong> 2015, mak<strong>in</strong>g<br />

imports necessary.<br />

Qatar <strong>Steel</strong>, which is a member<br />

of AISU, called for <strong>in</strong>tensive efforts<br />

<strong>to</strong> atta<strong>in</strong> self-sufficiency <strong>in</strong><br />

steel <strong>in</strong> the region.<br />

The <strong>Arab</strong> <strong>world</strong> is expected <strong>to</strong><br />

contribute 2.7% of the <strong>world</strong><br />

steel production by 2014 from<br />

the present level of 1.7%, accord<strong>in</strong>g<br />

<strong>to</strong> AISU secretary general<br />

Mohammed Eid Al Ashqar.<br />

“An overview of the reality of development<br />

<strong>in</strong> our region reveals<br />

that the <strong>Arab</strong> region is witness<strong>in</strong>g<br />

a constant growth <strong>in</strong> its projects<br />

and that there is a need for<br />

optimal utilization and employment<br />

of the potentials and the<br />

national wealth <strong>in</strong> the development<br />

of <strong>Arab</strong> steel <strong>in</strong>dustry,”<br />

Qatar <strong>Steel</strong> general manager Ali<br />

b<strong>in</strong> Hassan Al Muraiki <strong>to</strong>ld the<br />

summit.<br />

The success of <strong>Arab</strong> steel <strong>in</strong>dustry<br />

will be achieved through<br />

the existence of mega projects<br />

with <strong>Arab</strong> <strong>in</strong>vestments, which<br />

should focus on advanced technology<br />

that can compete not<br />

only <strong>in</strong> the <strong>Arab</strong> markets but<br />

also <strong>in</strong> the global arena as well<br />

as through “reach<strong>in</strong>g a stage<br />

of self-sufficiency <strong>in</strong> the region,<br />

elim<strong>in</strong>at<strong>in</strong>g the import gap and<br />

the transition <strong>to</strong> the export<br />

stage”, Al Muraiki said.<br />

Highlight<strong>in</strong>g that Qatar had<br />

been go<strong>in</strong>g through unprecedented<br />

growth, he said “the<br />

new <strong>in</strong>vestments which are<br />

expected <strong>to</strong> be spent over the<br />

next 10 years are estimated <strong>to</strong><br />

be $170 billion”.<br />

Stress<strong>in</strong>g that the strategy of<br />

Qatar is based <strong>in</strong> accordance<br />

with the National Vision 2030,<br />

Al Muraiki said “all figures<br />

clearly reflect that the Qatari<br />

economy has achieved constant<br />

growth and surpluses <strong>in</strong><br />

the budget and foreign trade<br />

and has built up reserves <strong>to</strong> be<br />

<strong>in</strong>vested <strong>in</strong> diverse <strong>in</strong>dustrial<br />

projects that support our efforts<br />

<strong>to</strong> diversify <strong>in</strong>come sources<br />

and reduce dependence on<br />

oil and gas”.<br />

Qatar <strong>Steel</strong> Company, <strong>in</strong> preparation<br />

of this, signed <strong>in</strong> March<br />

a contract for a 1.1 million<br />

<strong>to</strong>nnes/year steelmak<strong>in</strong>g plant.<br />

Qatar is position<strong>in</strong>g itself as a<br />

regional and global center for<br />

<strong>in</strong>vestments.<br />

The 77 million <strong>to</strong>nnes of annual<br />

gas production, award<strong>in</strong>g of the<br />

organiz<strong>in</strong>g rights for the FIFA<br />

World Cup 2022, new legislations<br />

for improv<strong>in</strong>g the <strong>in</strong>vestment<br />

climate and earmark<strong>in</strong>g<br />

$140 million <strong>in</strong> the next 10<br />

years for upgrad<strong>in</strong>g and putt<strong>in</strong>g<br />

<strong>in</strong> place a strong <strong>in</strong>frastructure<br />

base will have a positive impact<br />

on Qatar’s economy with regard<br />

The <strong>Arab</strong> <strong>world</strong> is expected <strong>to</strong> contribute 2.7% of the <strong>world</strong> steel production by 2014 from the present level of 1.7%<br />

<strong>to</strong> attract<strong>in</strong>g regional and <strong>in</strong>ternational<br />

<strong>in</strong>vestments.<br />

Alongside this is the desire <strong>to</strong><br />

diversify the economy with noncarbon<br />

products; and steel is<br />

one of them.<br />

Qatar is emerg<strong>in</strong>g as a lead<strong>in</strong>g<br />

producer of re<strong>in</strong>forc<strong>in</strong>g steel<br />

bars, more commonly known as<br />

rebar, <strong>in</strong> the region.<br />

Al Ashqar po<strong>in</strong>ted out that the<br />

<strong>Arab</strong> region imported about<br />

90% of its iron ore needs, although<br />

they were available <strong>in</strong><br />

<strong>Arab</strong> countries, say<strong>in</strong>g that this<br />

prevented the control of steel<br />

A session <strong>in</strong> progress at the steel summit<br />

prices and of products associated<br />

with this <strong>in</strong>dustry.<br />

Key steel producers <strong>in</strong> the <strong>Arab</strong><br />

<strong>world</strong> are Saudi <strong>Arab</strong>ia, Egypt,<br />

Algeria, the UAE, Qatar and<br />

Libya. Iron ore is ma<strong>in</strong>ly found<br />

<strong>in</strong> Mauritania.<br />

Most of the iron ore used <strong>in</strong> the<br />

Mena region is imported from<br />

Brazil, India, Ch<strong>in</strong>a and Sweden.<br />

Al Ashqar said dur<strong>in</strong>g the open<strong>in</strong>g<br />

ceremony that the <strong>Arab</strong><br />

<strong>world</strong>’s steel <strong>in</strong>dustry occupied<br />

third place globally beh<strong>in</strong>d Ch<strong>in</strong>a<br />

and India <strong>in</strong> terms of growth.<br />

He added that the <strong>in</strong>dustry was<br />

<strong>set</strong> <strong>to</strong> witness a <strong>set</strong> annual<br />

growth of 7% <strong>in</strong> the com<strong>in</strong>g<br />

years.<br />

Accord<strong>in</strong>g <strong>to</strong> the World <strong>Steel</strong><br />

Association, steel use may <strong>in</strong>crease<br />

by 13.1% ma<strong>in</strong>ly due <strong>to</strong><br />

<strong>in</strong>dustrial <strong>demand</strong>. The highest<br />

growth rates are expected <strong>in</strong><br />

the CIS (Commonwealth of Independent<br />

States) economies<br />

(11.1%) followed by the Americas<br />

(9%), Europe (5.7%), Asia<br />

(4.1%) with India lead<strong>in</strong>g the<br />

<strong>demand</strong> with a growth rate of<br />

13.5% and South East Asia with<br />

7.4%. In Ch<strong>in</strong>a, the largest consumer<br />

and producer, growth is<br />

expected <strong>to</strong> slow down by 3.5%<br />

as opposed <strong>to</strong> a previous growth<br />

period which was <strong>in</strong> double digits.<br />

Due <strong>to</strong> this overall <strong>in</strong>crease<br />

<strong>in</strong> the <strong>demand</strong> for steel and the<br />

cont<strong>in</strong>ued bullish prices for raw<br />

materials, consumers will cont<strong>in</strong>ue<br />

<strong>to</strong> see an <strong>in</strong>crease <strong>in</strong> steel<br />

and related product prices.

for steel <strong>in</strong>dustry<br />

The <strong>Arab</strong> Iron and <strong>Steel</strong> Union,<br />

founded <strong>in</strong> 1971, has now 85<br />

members. It is a non-profitable<br />

organisation that arranges<br />

meet<strong>in</strong>gs and conferences <strong>to</strong><br />

help connect buyers and sellers.<br />

It also gives <strong>in</strong>dustry players an<br />

opportunity <strong>to</strong> exchange <strong>in</strong>formation.<br />

Accord<strong>in</strong>g <strong>to</strong> Eng<strong>in</strong>eer Ziad<br />

Kutayni, the Regional Direc<strong>to</strong>r<br />

of the AISU based <strong>in</strong> Damascus,<br />

the organization also provides<br />

advice <strong>to</strong> the steel <strong>in</strong>dustry and<br />

its members, <strong>in</strong>form<strong>in</strong>g them<br />

of new technologies and future<br />

prospects. In an <strong>in</strong>terview with<br />

<strong>QC</strong>S, Kutayni said the current<br />

The Ras Laffan Industrial City<br />

Community Outreach Program<br />

(RLIC COP) launched its road<br />

safety campaign target<strong>in</strong>g students<br />

of schools <strong>in</strong> the north of<br />

Qatar.<br />

The annual campaign, organized<br />

by RLIC COP “Safe Schools” program,<br />

aims <strong>to</strong> raise road safety<br />

awareness among children <strong>to</strong><br />

prepare them <strong>to</strong> be better drivers.<br />

The RLIC COP has been developed<br />

<strong>to</strong> create a respectful,<br />

trust-based partnership between<br />

companies <strong>in</strong> Ras Laffan and surround<strong>in</strong>g<br />

communities as well as<br />

provid<strong>in</strong>g a forum for companies<br />

and residents <strong>to</strong> share ideas and<br />

concerns, <strong>in</strong> order <strong>to</strong> develop sus-<br />

of the company’s development<br />

strategy is engag<strong>in</strong>g <strong>in</strong> knowledge<br />

share their diverse experience<br />

production capacity of the <strong>Arab</strong><br />

region was 17 million <strong>to</strong>nnes,<br />

with the figure expected <strong>to</strong><br />

<strong>to</strong>uch 25 million <strong>to</strong>nnes with<strong>in</strong><br />

four years. The ma<strong>in</strong> producers<br />

of steel <strong>in</strong> the region are Egypt,<br />

Saudi <strong>Arab</strong>ia, the United <strong>Arab</strong><br />

Emirates, Qatar and Libya. The<br />

<strong>Arab</strong> region imports 90% of its<br />

iron ore, ma<strong>in</strong>ly from Mauritania<br />

but also Brazil, Australia<br />

and Sweden. Asked whether it<br />

was becom<strong>in</strong>g more expensive<br />

<strong>to</strong> produce steel <strong>in</strong> the Mena region<br />

under the current politically<br />

unstable conditions, Kutayni<br />

responded that the fac<strong>to</strong>rs that<br />

really contributed <strong>to</strong> the price<br />

escalation were consumables<br />

like graphic electrodes, power,<br />

ferrous alloys and refrac<strong>to</strong>ries<br />

rather than the price and avail-<br />

ta<strong>in</strong>able programs <strong>to</strong> benefit the<br />

community <strong>in</strong> l<strong>in</strong>e with Qatar National<br />

Vision 2030.<br />

All the major RLIC companies are<br />

members of the outreach program,<br />

<strong>in</strong>clud<strong>in</strong>g Qatar Petroleum,<br />

Al Khaleej Gas, Dolph<strong>in</strong> Energy,<br />

Oryx GTL, Qatargas, RasGas and<br />

Qatar Shell.<br />

The Safe Schools <strong>in</strong>itiative aims<br />

<strong>to</strong> raise awareness of health,<br />

safety and environmental matters<br />

among the youth of northern<br />

Qatar. This is the third year RLIC<br />

COP has organized its annual<br />

road safety campaign under the<br />

Safe Schools Program.<br />

More than 23 schools from the<br />

north participated <strong>in</strong> the event.<br />

The campaign was held <strong>in</strong> two<br />

locations: Al Kaban Youth Centre<br />

and <strong>in</strong> Al Khor Primary Independent<br />

Model School.<br />

This year’s focus was on bus safety<br />

with additional programs such<br />

as an <strong>in</strong>formation stand by the<br />

<strong>in</strong> the project management <strong>in</strong>dustry.<br />

One of QPM’s renowned susta<strong>in</strong>ability<br />

specialists attended<br />

the Qatar Green Build<strong>in</strong>g Conference<br />

& Exhibition 2011 <strong>to</strong><br />

draw attention <strong>to</strong> the importance<br />

of provid<strong>in</strong>g measurable<br />

and achievable susta<strong>in</strong>ability<br />

solutions. This was the Middle<br />

East’s largest event perta<strong>in</strong><strong>in</strong>g<br />

<strong>to</strong> susta<strong>in</strong>able development <strong>in</strong><br />

the construction <strong>in</strong>dustry and<br />

hosted over 500 local and <strong>in</strong>ternational<br />

construction and environmental<br />

experts.<br />

Implement<strong>in</strong>g <strong>in</strong>novative solutions<br />

with<strong>in</strong> the <strong>in</strong>dustry motivates<br />

QPM <strong>to</strong> understand and<br />

He added that the global market<br />

market outlook, Kutayni said<br />

there was room for growth as the<br />

current <strong>demand</strong> for steel <strong>in</strong> the<br />

<strong>Arab</strong> region is 35 million <strong>to</strong>nnes<br />

while the production rema<strong>in</strong>ed<br />

17 million <strong>to</strong>nnes.<br />

He said the current political<br />

situation, especially the developments<br />

<strong>in</strong> Libya, had not really affected<br />

steel production. Libya is<br />

a lead<strong>in</strong>g producer of steel <strong>in</strong> the<br />

region but the largest producers<br />

are Egypt and Saudi <strong>Arab</strong>ia<br />

which <strong>to</strong>gether manufacture almost<br />

60% of the region’s steel,<br />

5 million <strong>to</strong>nnes each.<br />

Social Police, activities on traffic<br />

signs, visibility <strong>in</strong> the dark and vehicle<br />

s<strong>to</strong>pp<strong>in</strong>g distances. Safety<br />

experts used a seatbelt conv<strong>in</strong>cer<br />

<strong>to</strong> show the importance of wear<strong>in</strong>g<br />

a seatbelt and its value <strong>in</strong><br />

case of an accident.<br />

In order <strong>to</strong> further engage with<br />

the students and enforce the<br />

road safety message, experts<br />

<strong>in</strong>teracted with the students <strong>in</strong><br />

a road safety art competition.<br />

Numerous contributions were<br />

received. Students did a great<br />

job <strong>in</strong> captur<strong>in</strong>g some of the key<br />

messages <strong>in</strong> road safety such as<br />

the significance of us<strong>in</strong>g seatbelt<br />

and that speed<strong>in</strong>g is one of the<br />

ma<strong>in</strong> causes for serious traffic<br />

accidents. Prizes were awarded<br />

<strong>to</strong> the three best contributions <strong>in</strong><br />

each school.<br />

Parents were <strong>in</strong>vited <strong>to</strong> jo<strong>in</strong> the<br />

campaign dur<strong>in</strong>g scheduled family<br />

even<strong>in</strong>gs and a ladies’ even<strong>in</strong>g.<br />

Barwa, Pearl GTL sign lease agreement for Al<br />

Khor project<br />

Barwa Al Khor, an arm of Barwa<br />

Real Estate Company, has<br />

signed a leas<strong>in</strong>g agreement<br />

with Pearl GTL for a new residential<br />

hous<strong>in</strong>g compound it is<br />

build<strong>in</strong>g.<br />

The hous<strong>in</strong>g compound will provide<br />

300 apartments and 50<br />

villas for Pearl GTL staff when<br />

it is handed over on January 1,<br />

2014. It will be part of Barwa’s<br />

QR30 billion ($8.2 billion) Urjuan<br />

waterfront development <strong>in</strong><br />

Al-Khor.<br />

The Pearl plant, located 20 kilometers<br />

north of Al-Khor <strong>in</strong><br />

the <strong>in</strong>dustrial city Ras Laffan,<br />

will be the <strong>world</strong>’s largest plant<br />

produc<strong>in</strong>g liquid fuels from gas<br />

when it becomes operational<br />

this year. The plant is be<strong>in</strong>g constructed<br />

by Royal Dutch Shell.<br />

Pearl GTL requires residential<br />

hous<strong>in</strong>g for its skilled opera<strong>to</strong>rs,<br />

technicians and shift supervisors<br />

who are responsible for<br />

the day-<strong>to</strong>-day operations at the<br />

plant at Ras Laffan. Urjuan’s<br />

waterfront development is seen<br />

as an ideal location <strong>to</strong> accommodate<br />

oil and gas professionals,<br />

because of its proximity <strong>to</strong><br />

Ras Laffan Industrial City.<br />

“This agreement comes <strong>in</strong> l<strong>in</strong>e<br />

with Barwa strategy <strong>to</strong> raise the<br />

bar <strong>in</strong> the real estate <strong>in</strong>dustry<br />

<strong>in</strong> Qatar and <strong>to</strong> promote and<br />

encourage the construction of<br />

new urban communities outside<br />

Doha,” Barwa said.<br />

“In Barwa, we are striv<strong>in</strong>g hard<br />

<strong>to</strong> manifest our long-term strategy<br />

through a number of new<br />

developments which we early<br />

announced, such as Salwa Bay<br />

and Barwa Mo<strong>to</strong>r City, and a<br />

number of projects yet <strong>to</strong> be announced.”<br />

Barwa Al Khor said it was delighted<br />

<strong>to</strong> have f<strong>in</strong>alized this<br />

agreement with Pearl GTL on<br />

the basis of a very high specification<br />

competitive tender <strong>to</strong><br />

house its management and<br />

staff based locally at Ras Laffan.<br />

with a gym, squash courts and<br />

Barwa Al Khor will prepare each<br />

hous<strong>in</strong>g unit for occupancy by<br />

coord<strong>in</strong>at<strong>in</strong>g the development’s<br />

site activities with the Pearl GTL<br />

residents’ suppliers and furnish<strong>in</strong>g<br />

contrac<strong>to</strong>rs <strong>in</strong> time for<br />

the handover <strong>in</strong> 2014.<br />

have signed a QR6 billion<br />

jo<strong>in</strong>t venture agreement <strong>to</strong> construct<br />

a state-of-the-art enterta<strong>in</strong>ment<br />

and retail complex <strong>in</strong><br />

Doha slated <strong>to</strong> become a driv<strong>in</strong>g<br />

force beh<strong>in</strong>d Qatar’s diverse<br />

economic development.<br />

The country’s largest multipurpose<br />

complex, located on the<br />

northern highway l<strong>in</strong>k<strong>in</strong>g Doha<br />

International Airport with the<br />

proposed Bahra<strong>in</strong> Causeway,<br />

Enforcement of Foreign Arbitration Awards <strong>in</strong><br />

the State of Qatar<br />

Arbitration is one of the most<br />

common mechanisms of dispute<br />

resolution <strong>in</strong> the region<br />

particularly <strong>in</strong> the case of complex<br />

construction disputes. Arguably,<br />

the most important part<br />

of the entire arbitration process<br />

is the enforcement of the arbitration<br />

award aga<strong>in</strong>st the “los<strong>in</strong>g”<br />

parties’ as<strong>set</strong>s.<br />

As with many other jurisdictions,<br />

any arbitration award is<br />

required <strong>to</strong> be “ratified” (formally<br />

approved) by the local courts<br />

<strong>in</strong> Qatar as part of the enforcement<br />

process. The pr<strong>in</strong>ciples<br />

applied by the “execution”<br />

courts depend on whether the<br />

award is “foreign” or “domestic”.<br />

A foreign arbitration award<br />

is an award which is rendered<br />

outside of Qatar, that is, where<br />

the seat of the arbitration is<br />

outside of Qatar, for example,<br />

London or Geneva. Conversely,<br />

a domestic award will be an<br />

award rendered <strong>in</strong> Qatar, that<br />

is, where the seat of the arbitration<br />

is Qatar.<br />

This article briefly looks at the<br />

pr<strong>in</strong>ciples, and the source of<br />

those pr<strong>in</strong>ciples, adopted by<br />

the Qatar courts when ratify<strong>in</strong>g<br />

a foreign arbitration award.<br />

The Qatar Arbitration Law is<br />

found <strong>in</strong> Law No. (13) of 1990,<br />

the Commercial and Civil Procedure<br />

Code (“the Code”). An unofficial<br />

English translation of Article<br />

379 of the Code provides:<br />

“Judgments and orders issued<br />

<strong>in</strong> a foreign country may be ordered<br />

<strong>to</strong> be executed <strong>in</strong> Qatar<br />

on the conditions <strong>in</strong> that country<br />

for execution of Qatari judg-<br />

ments and orders there<strong>in</strong>”<br />

Whilst the English translation<br />

of this provision refers <strong>to</strong> “judgments<br />

and orders” it is commonly<br />

accepted that this word<strong>in</strong>g<br />

<strong>in</strong>cludes arbitration awards<br />

rendered <strong>in</strong> a foreign country. In<br />

accordance with this provision,<br />

therefore, the Qatar courts<br />

recognise the pr<strong>in</strong>ciple of “reciprocity”.<br />

As well as the statu<strong>to</strong>ry recognition<br />

of the pr<strong>in</strong>ciple of reciprocity,<br />

there are various reciprocal<br />

agreements between countries<br />

<strong>in</strong> respect of the enforcement<br />

of arbitration awards. When<br />

look<strong>in</strong>g at the ratification of arbitration<br />

awards <strong>in</strong> Qatar, the<br />

United Nations Convention on<br />

the Recognition and Enforcement<br />

of Foreign Arbitral Awards<br />

(the “New York Convention”),<br />

the 1983 Convention on Judicial<br />

Co-operation between<br />

States of the <strong>Arab</strong> League (the<br />

“Riyadh Convention”) and the<br />

1995 Pro<strong>to</strong>col on the Enforcement<br />

of Judgments Letters<br />

Roga<strong>to</strong>ry and Judicial Notices<br />

issued by the Courts of the<br />

Member States of the <strong>Arab</strong> Gulf<br />

Co-operation Council (the “GCC<br />

Pro<strong>to</strong>col”), are key.<br />

The New York Convention<br />

The New York Convention is one<br />

of the key <strong>in</strong>struments <strong>in</strong> the<br />

enforcement of foreign arbitration<br />

awards around the <strong>world</strong>.<br />

The New York Convention was<br />

adopted by a United Nations<br />

diplomatic conference <strong>in</strong> 1958<br />

and came <strong>in</strong><strong>to</strong> force <strong>in</strong> 1959.<br />

Currently, over 50 years later,<br />

there are 145 signa<strong>to</strong>ry states.<br />

Essentially, the New York Con-<br />

vention requires courts of signa<strong>to</strong>ry<br />

or “Contract<strong>in</strong>g States”<br />

<strong>to</strong> recognise the enforcement of<br />

foreign arbitral awards <strong>in</strong> those<br />

Contract<strong>in</strong>g States.<br />

Article 3 of the New York Convention<br />

provides that each<br />

Contract<strong>in</strong>g State will recognise<br />

arbitral awards and enforce<br />

them <strong>in</strong> accordance with<br />

the Contract<strong>in</strong>g State’s rules<br />

of procedure. The New York<br />

Convention applies not only <strong>to</strong><br />

the recognition and enforcement<br />

by Contract<strong>in</strong>g States of<br />

arbitral awards made <strong>in</strong> other<br />

Contract<strong>in</strong>g States but also <strong>to</strong><br />

the enforcement by Contract<strong>in</strong>g<br />

States of arbitral awards made<br />

<strong>in</strong> non-contract<strong>in</strong>g states, provided<br />

that such arbitral awards<br />

satisfy the basic conditions <strong>set</strong><br />

down <strong>in</strong> the New York Convention.<br />

Contract<strong>in</strong>g States are able <strong>to</strong><br />

adopt certa<strong>in</strong> reservations <strong>in</strong>clud<strong>in</strong>g;<br />

i) that the Contract<strong>in</strong>g State will<br />

apply the New York Convention<br />

only <strong>to</strong> the recognition and enforcement<br />

of arbitration awards<br />

made <strong>in</strong> the terri<strong>to</strong>ry of another<br />

Contract<strong>in</strong>g State (the “Reciprocity<br />

Reservation”); and<br />

ii) that the Contract<strong>in</strong>g State will<br />

apply the New York Convention<br />

only <strong>to</strong> differences aris<strong>in</strong>g out<br />

of legal relationships (whether<br />

contractual or otherwise) that<br />

are considered commercial under<br />

the national law of the Contract<strong>in</strong>g<br />

State (the “Commercial<br />

Reservation”).<br />

Qatar, when ratify<strong>in</strong>g the New<br />

York Convention <strong>in</strong> December<br />

2002, (the same com<strong>in</strong>g <strong>in</strong><strong>to</strong><br />

force <strong>in</strong> March 2003) did so<br />

without either reservation and<br />

thus, <strong>in</strong> effect, is able <strong>to</strong> recognise<br />

and enforce awards of any<br />

state subject <strong>to</strong> the follow<strong>in</strong>g<br />

provisions.<br />

A Contract<strong>in</strong>g State may, pursuant<br />

<strong>to</strong> Article 5 of the New<br />

York Convention, decl<strong>in</strong>e <strong>to</strong><br />

recognise and enforce an arbitral<br />

award:<br />

(a) Where the party aga<strong>in</strong>st<br />

whom the arbitral award is<br />

<strong>in</strong>voked can prove that:<br />

(i) The parties <strong>to</strong> the arbitration<br />

agreement were under some<br />

<strong>in</strong>capacity accord<strong>in</strong>g <strong>to</strong> the<br />

law applicable <strong>to</strong> them;<br />

(ii) The arbitration agreement<br />

was not valid under its govern<strong>in</strong>g<br />

law;<br />

(iii) It was not given proper notice<br />

of the appo<strong>in</strong>tment of the<br />

arbitra<strong>to</strong>r or of the arbitration<br />

or was otherwise unable <strong>to</strong><br />

present his case;<br />

(iv) The arbitral award dealt<br />

with a dispute not contemplated<br />

by or not fall<strong>in</strong>g with<strong>in</strong><br />

the terms of the submission<br />

<strong>to</strong> the arbitration;<br />

(v) The composition of the arbitral<br />

authority was not <strong>in</strong> accordance<br />

with the arbitration<br />

agreement; or<br />

(vi) The arbitral award is not yet<br />

f<strong>in</strong>al or has been <strong>set</strong> aside or<br />

suspended by the courts <strong>in</strong><br />

the jurisdiction of the seat of<br />

the arbitration; or<br />

(b) Where the competent authority<br />

of the Contract<strong>in</strong>g<br />

State where enforcement of<br />

the arbitral award is sought,<br />

f<strong>in</strong>ds that:<br />

(i) The subject matter of the dispute<br />

is not capable of <strong>set</strong>tlement<br />

by arbitration under the<br />

law of the Contract<strong>in</strong>g State<br />

where enforcement of the arbitral<br />

award is sought; or<br />

(ii) The recognition or enforcement<br />

of the arbitral award<br />

would be contrary <strong>to</strong> the public<br />

policy of the Contract<strong>in</strong>g<br />

State where enforcement of<br />

the arbitral award is sought.<br />

Enforcement of Arbitration<br />

Awards under the Riyadh Convention<br />

and the GCC Pro<strong>to</strong>col<br />

Along with other member states<br />

of the <strong>Arab</strong> League, Qatar is a<br />

signa<strong>to</strong>ry <strong>to</strong> the 1983 Conven-<br />

tion on Judicial Co-operation<br />

between States of the <strong>Arab</strong><br />

League (the “Riyadh Convention”)<br />

and <strong>to</strong> the 1995 Pro<strong>to</strong>col<br />

on the Enforcement of Judgments<br />

Letters Roga<strong>to</strong>ry and<br />

Judicial Notices issued by the<br />

Courts of the Member States<br />

of the <strong>Arab</strong> Gulf Co-operation<br />

Council (the “GCC Pro<strong>to</strong>col”)<br />

along with Bahra<strong>in</strong>, Kuwait,<br />

Oman, Saudi and the UAE. Both<br />

agreements generally provide<br />

that each signa<strong>to</strong>ry (or “Recipient<br />

State”) will recognise<br />

judgments of a court of any<br />

other signa<strong>to</strong>ry (the “Orig<strong>in</strong>at<strong>in</strong>g<br />

State”) subject <strong>to</strong> certa<strong>in</strong><br />

exceptions.<br />

Similarly <strong>to</strong> the New York Convention,<br />

Article 37 of the Riyadh<br />

Convention (which deals specifically<br />

with arbitral awards),<br />

provides that awards from Orig<strong>in</strong>at<strong>in</strong>g<br />

States should be recognised<br />

and enforced <strong>in</strong> Recipient<br />

States, though the “competent<br />

judicial authority” may reject<br />

the enforcement of the award<br />

<strong>in</strong> the follow<strong>in</strong>g cases:<br />

i) if the law of the Recipient<br />

State does not authorize the<br />

<strong>set</strong>tlement of the subject matter<br />

of the dispute by arbitration;<br />

ii) if the award was made on<br />

the basis of a void arbitration<br />

agreement or the award is not<br />

f<strong>in</strong>al;<br />

iii) if the arbitral tribunal was<br />

not competent under the terms<br />

of the arbitration agreement or<br />

under the laws of the seat of arbitration;<br />

iv) if the parties <strong>to</strong> the arbitration<br />

were not properly notified<br />

<strong>in</strong> respect of the arbitration proceed<strong>in</strong>gs;<br />

or<br />

v) if the arbitral award is contrary<br />

<strong>to</strong> the provisions of Shari’a<br />

law, public order or good morals<br />

of the Recipient State where<br />

enforcement is be<strong>in</strong>g sought.<br />

are similar <strong>to</strong> those as <strong>set</strong><br />

out <strong>in</strong> the New York Convention.<br />

Another successful year for Barwa<br />

posted an 84% jump <strong>in</strong> full-year<br />

profit for 2010 on <strong>in</strong>come from<br />

rents and services and profit on<br />

the sale of properties, a company<br />

statement said.<br />

“Increased revenues from rents<br />

and services and profit on the<br />

sale of properties and projects<br />

and sale of Barwa’s stake <strong>in</strong> a<br />

subsidiary, along with other exceptional<br />

returns result<strong>in</strong>g from<br />

Barwa be<strong>in</strong>g exempted from<br />

some commitments, led <strong>to</strong> this<br />

<strong>in</strong>crease <strong>in</strong> net profits dur<strong>in</strong>g<br />

2010,” the statement said.<br />

Barwa’s Board of Direc<strong>to</strong>rs recently<br />

held the company’s Ord<strong>in</strong>ary<br />

and Extraord<strong>in</strong>ary General<br />

Assembly Meet<strong>in</strong>g at Doha’s<br />

Ritz Carl<strong>to</strong>n, with more than<br />

75% attendance of shareholders.<br />

The meet<strong>in</strong>g discussed and approved<br />

all items on its agenda,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>in</strong>crease of the board<br />

members from five <strong>to</strong> seven<br />

members and amendment <strong>to</strong><br />

some of the Articles of Association.<br />

The meet<strong>in</strong>g also discussed<br />

and approved the company’s<br />

performance throughout the<br />

year, its f<strong>in</strong>ancial position and<br />

Sharia Supervisory Board Report.<br />

Ghanim b<strong>in</strong> Saad Al Saad,<br />

Chairman and Manag<strong>in</strong>g Direc<strong>to</strong>r,<br />

presented the Board of<br />

Direc<strong>to</strong>rs report on the activity<br />

of the company and its f<strong>in</strong>ancial<br />

position for the f<strong>in</strong>ancial year<br />

ended 31/12/2010, its results<br />

for the year 2010 and plans for<br />

the year 2011.<br />

Al Saad said at the meet<strong>in</strong>g<br />

that <strong>in</strong> 2010 the global and regional<br />

<strong>in</strong>stability had cont<strong>in</strong>ued<br />

<strong>in</strong> f<strong>in</strong>ancial markets. The <strong>world</strong><br />

had not fully recovered from the<br />

crisis that had its impact on all<br />

economies.<br />

Nevertheless, for Barwa the<br />

year 2010 was another successful<br />

year, with many bus<strong>in</strong>esses<br />

flourish<strong>in</strong>g and significant<br />

achievements at both<br />

f<strong>in</strong>ancial and adm<strong>in</strong>istrative<br />

sides, he said.<br />

“In addition, the company is<br />

progress<strong>in</strong>g <strong>in</strong> achiev<strong>in</strong>g its<br />

strategic goals through striv<strong>in</strong>g<br />

hard <strong>to</strong> cont<strong>in</strong>ue ma<strong>in</strong>ta<strong>in</strong> its<br />

success and growth on local,<br />

regional and <strong>in</strong>ternational arenas.”<br />

List<strong>in</strong>g the achievements of<br />

Barwa and its subsidiaries dur<strong>in</strong>g<br />

2010, Al Saad said that the<br />

net profit for 2010 had <strong>surge</strong>d<br />

by 84% over the same period<br />

<strong>in</strong> 2009 due <strong>to</strong> the <strong>in</strong>crease <strong>in</strong><br />

<strong>to</strong>tal earn<strong>in</strong>gs which amounted<br />

<strong>to</strong> QR8 billion <strong>in</strong> 2010. The <strong>to</strong>tal<br />

earn<strong>in</strong>gs <strong>in</strong> 2010 saw a 266%<br />

rise compared <strong>to</strong> 2009 when<br />

they were QR3 billion.<br />

along with other returns led <strong>to</strong><br />

the <strong>in</strong>crease <strong>in</strong> net profits dur<strong>in</strong>g<br />

2010. In 2010, earn<strong>in</strong>gs per<br />

share (EPS) reached QR4.06,<br />

compared <strong>to</strong> QR2.92 per share<br />

dur<strong>in</strong>g 2009, a 39% <strong>in</strong>crease.<br />

One of the miles<strong>to</strong>nes dur<strong>in</strong>g<br />

2010 was the merger with Al<br />

Aqaria, which enabled Barwa <strong>to</strong><br />

become the Qatar’s largest listed<br />

real estate company with a<br />

market capitalization of QR11.1<br />

billion. Complement<strong>in</strong>g the real<br />

estate portfolio of Barwa <strong>in</strong><br />

Qatar, Al Aqaria is a significant<br />

addition <strong>to</strong> Barwa’s as<strong>set</strong> base,<br />

help<strong>in</strong>g <strong>to</strong> position the group for<br />

future growth.<br />

Other miles<strong>to</strong>nes achieved dur<strong>in</strong>g<br />

2010 were the successful<br />

completions of some major developments.<br />

complete and fully occupied.<br />

transform the Industrial Area<br />

center, is <strong>set</strong> <strong>to</strong> be completed <strong>in</strong><br />

2012. The leas<strong>in</strong>g and market<strong>in</strong>g<br />

Barwa F<strong>in</strong>ancial District, which<br />

has recently been sold <strong>to</strong> Qatar<br />

Petroleum, has won the “Best<br />

International Office Development”<br />

and the “Overall Best Office<br />

Development” for the Middle<br />

East Region prizes at the<br />

regional and <strong>in</strong>ternational property<br />

awards held <strong>in</strong> association<br />

with Bloomberg. Achiev<strong>in</strong>g such<br />

a global award is unique for a<br />

commercial development <strong>in</strong> the<br />

region and it demonstrates Qatar’s<br />

ability <strong>to</strong> compete <strong>in</strong> the<br />

highly competitive <strong>in</strong>ternational<br />

property arena, Al Sadd said.<br />

He po<strong>in</strong>ted out that Barwa had<br />

adopted a comprehensive corporate<br />

governance policy dur<strong>in</strong>g<br />

2010 <strong>to</strong> promote strong<br />

accountability and implement<strong>in</strong>ternationally<br />

recognized account<strong>in</strong>g<br />

standards <strong>in</strong> mak<strong>in</strong>g<br />

reserves and allocations, while<br />

ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the best results,<br />

profitability and earn<strong>in</strong>gs per<br />

share.<br />

To enhance the efficiency and<br />

effectiveness of our processes<br />

and improve our report<strong>in</strong>g <strong>to</strong><br />

support sound decision mak<strong>in</strong>g,<br />

Barwa implemented an<br />

Enterprise Resource Plann<strong>in</strong>g<br />

System (ERP system).<br />

Al Saad disclosed that the plan<br />

for the year 2011 was <strong>to</strong> cont<strong>in</strong>ue<br />

this excellence and success<br />

and the true challenge would <strong>to</strong><br />

ma<strong>in</strong>ta<strong>in</strong> such a record. This,<br />

he said, could only be achieved<br />

by striv<strong>in</strong>g <strong>to</strong> do more.<br />

Barwa’s future plans <strong>in</strong>clude a<br />

new flagship <strong>to</strong>urism resort <strong>in</strong><br />

Qatar called Salwa Bay Resort.<br />

Located on the south western<br />

coast of Qatar, it will be developed<br />

over the next six years. It<br />

will feature a mix of residential<br />

and hospitality properties <strong>to</strong><br />

deliver new experiences for Qatar’s<br />

<strong>to</strong>urists.<br />

In addition, Mo<strong>to</strong>r City project,<br />

which costs QR2 billion and<br />

covers an area of 1.8sq meters,<br />

is another major future development.<br />

As Qatar prepares <strong>to</strong> host the<br />

2022 FIFA World Cup, Barwa’s<br />

strategy will focus on capitaliz<strong>in</strong>g<br />

on development plans<br />

<strong>to</strong> support the <strong>in</strong>frastructural<br />

needs of the country so that<br />

Barwa’s projects contribute <strong>to</strong><br />

ensure that the Word Cup is a<br />

resound<strong>in</strong>g success. Therefore,<br />

Barwa strategy’s ma<strong>in</strong><br />

focus shall be on local market<br />

<strong>to</strong> ensure successful delivery of<br />

<strong>in</strong>frastructure projects that contribute<br />

<strong>to</strong> the success of Qatar<br />

economy.<br />

Barwa’s priority dur<strong>in</strong>g 2011 is<br />

a focus on enhanc<strong>in</strong>g bus<strong>in</strong>ess<br />

efficiency and overall growth of<br />

the company. This is <strong>in</strong> order <strong>to</strong><br />

improve net operat<strong>in</strong>g revenue<br />

and cash flow through effective<br />

The external audi<strong>to</strong>r’s report on<br />

the f<strong>in</strong>ancials for the year ended<br />

31/12/2010 was presented<br />

by Ahmad Husse<strong>in</strong>, KPMG &<br />

Partners.<br />

The representative of Sharia<br />

Supervisory Board (SSB) read<br />

the SSB report on the company’s<br />

activities for the f<strong>in</strong>ancial<br />

year ended 31/12/2010. He<br />

talked on the SSB’s role <strong>in</strong> the<br />

company as the authority <strong>to</strong> review<br />

all its activities, confirm<strong>in</strong>g<br />

that the contracts and activities<br />

entered <strong>in</strong><strong>to</strong> dur<strong>in</strong>g the f<strong>in</strong>ancial<br />

year ended 2010, as well as<br />

the calculations of profits and<br />

losses on <strong>in</strong>vestment accounts,<br />

were done <strong>in</strong> a manner that did<br />

The Lusail light rail transit system<br />

is central <strong>to</strong> the transportation<br />

<strong>in</strong>frastructure of Lusail City,<br />

one of the largest real estate<br />

development projects be<strong>in</strong>g<br />

undertaken <strong>in</strong> the Middle East<br />

and North Africa region. It will<br />

feature 30km of track, 7km of<br />

which are underground, 24 stations<br />

(seven of which are underground),<br />

service depots and<br />

President and CEO of AECOM,<br />

The Lusail Light Rail Transit<br />

System is part of the Qatar Railway<br />

project which is a $30 billion<br />

<strong>in</strong>tegrated railway network<br />

that will cover all major areas<br />

<strong>in</strong> the country and consist of<br />

three transport modes: long<br />

distance, metro and freight.<br />

The Qatar Railways Company<br />

is wholly owned by Qatari Diar<br />

Khalid Cement <strong>to</strong> take part <strong>in</strong> Project Qatar 2011<br />

Khalid Cement is a vital part of<br />

Qatar’s commendable growth<br />

projects at Elsewedy<br />

Cables, has said that Elsewedy<br />

provides a turnkey solution <strong>to</strong><br />

major companies like Kahramaa,<br />

Qatar Petroleum, Ras-<br />

Gas, ABB and Areva. Elsewedy<br />

specializes <strong>in</strong> electrical cabl<strong>in</strong>g<br />

such as extra-high voltage<br />

(EHV), medium voltage (MV)<br />

and low voltage (LV).<br />

The Elsewedy fac<strong>to</strong>ry <strong>in</strong> Qatar<br />

can manufacture and supply<br />

up <strong>to</strong> an MV grade of cable.<br />

All EHV cables are made <strong>in</strong><br />

the Elsewedy Cables fac<strong>to</strong>ry <strong>in</strong><br />

Egypt.<br />

In an <strong>in</strong>terview, Eng Thamim<br />

said that Elsewedy provided a<br />

whole range of solutions from<br />

design, feasibility study, electrical<br />

<strong>in</strong>frastructure and the<br />

project management of the<br />

cable <strong>in</strong>stallation. He described<br />

Elsewedy Cables as a member<br />

of the electrical <strong>in</strong>frastructure<br />

<strong>in</strong>dustry, specializ<strong>in</strong>g <strong>in</strong> cabl<strong>in</strong>g,<br />

particularly underground and<br />

EHV (extra-high voltage) cables<br />

used <strong>to</strong> connect electricity substations.<br />

On be<strong>in</strong>g asked about the value<br />

of the cabl<strong>in</strong>g market, Eng<br />

Thamim said that <strong>in</strong> 2008 Kahramaa,<br />

which is the ma<strong>in</strong> authority<br />

<strong>in</strong> cable lay<strong>in</strong>g <strong>in</strong> Qatar,<br />

issued tenders <strong>to</strong> the value of<br />

$2,800 million dur<strong>in</strong>g Phase 8<br />

of a bid process that is ongo<strong>in</strong>g.<br />

Vendors, like Elsewedy, are now<br />

await<strong>in</strong>g results for Phase 10.<br />

Elsewedy is the first cable fac<strong>to</strong>ry<br />

<strong>in</strong> the State of Qatar. Built<br />

on an area of 70,200 m², the<br />

fac<strong>to</strong>ry is <strong>in</strong> a jo<strong>in</strong>t venture<br />

with Doha Cables a subsidiary<br />

of Aamal Hold<strong>in</strong>gs. Accord<strong>in</strong>g<br />

<strong>to</strong> its website, the planned<br />

production capacity of the fac<strong>to</strong>ry<br />

is estimated <strong>to</strong> be a <strong>to</strong>tal<br />

of 40,000 <strong>to</strong>ns (copper) for the<br />

com<strong>in</strong>g five years.<br />

The Elsewedy Cables Group<br />

has its facility for polymeric<br />

compounds, a key component<br />

of the PVC (polyv<strong>in</strong>yl chloride)<br />

material for the outer jacket<br />

material of the low and medium<br />

voltage (LV and MV) cables and<br />

HDPE (High Density Polyethylene)<br />

material for high and extra<br />

high voltage (EHV) cables. The<br />

group’s vision is <strong>to</strong> be one of<br />

When asked about the turnkey<br />

solution that Elsewedy Cables<br />

offers, Eng Thamim reiterated<br />

that the company’s knowledge<br />

of different products enabled<br />

it <strong>to</strong> offer opera<strong>to</strong>rs a product<br />

based on the perspective for<br />

each solution.<br />

He added that the company’s<br />

systems <strong>in</strong>tegration facilities<br />

<strong>in</strong> Dubai, Abu Dhabi and Cairo<br />

were “used <strong>to</strong> assemble, configure<br />

and test systems and<br />

solutions as well as provide the<br />

facilities <strong>to</strong> host <strong>in</strong>tegrated fac<strong>to</strong>ry<br />

acceptance test<strong>in</strong>g (IFAT)<br />

of various equipment prior <strong>to</strong><br />

<strong>in</strong>stallation <strong>in</strong> the field”.<br />

He said that Elsewedy not only<br />

manufactured cable but also<br />

designed the cable route. He<br />

said: “We give a complete solution,<br />

an EPC solution.”<br />

Elsewedy Cables works as a<br />

subsidiary of Doha Cables<br />

which is <strong>in</strong> a jo<strong>in</strong>t venture with<br />

the Aamal group.<br />

Most of the noted cable makers<br />

<strong>in</strong> the region are members of<br />

the <strong>Arab</strong> Cab (<strong>Arab</strong> Cable Manufacturers<br />

Association founded<br />

<strong>in</strong> 2004) but not all. For example,<br />

Oman Fibre Optics which<br />

produces optical fibre and fibre<br />

optic cable and Teleco Câbles<br />

<strong>in</strong> Tunisia, are not listed as<br />

members. There are also many<br />

cable companies <strong>in</strong> the non-<br />

<strong>Arab</strong> countries of Mena (Turkey,<br />

Israel and Iran), and these do<br />

not, of course, belong <strong>to</strong> <strong>Arab</strong><br />

Cab.<br />

Accord<strong>in</strong>g <strong>to</strong> <strong>in</strong>dustry sources,<br />

when look<strong>in</strong>g at global <strong>in</strong>vestments<br />

<strong>in</strong> the Mena cable <strong>in</strong>dustry,<br />

manufactur<strong>in</strong>g activity by<br />

the major global cable groups <strong>in</strong><br />

this region, other than <strong>in</strong> Turkey,<br />

is relatively limited. The ma<strong>in</strong><br />

exception is Nexans, which has<br />

a number of <strong>in</strong>terests <strong>in</strong> North<br />

Africa and the Middle East,<br />

<strong>in</strong>clud<strong>in</strong>g Lebanon, Morocco,<br />

Egypt as well as Turkey.<br />

Prysmian has a substantial<br />

presence <strong>in</strong> Turkey while Corn<strong>in</strong>g<br />

Cable Systems has manu-<br />

factur<strong>in</strong>g operations <strong>in</strong> both<br />

Turkey and Egypt. Elsewhere <strong>in</strong><br />

the region, Draka has a stake<br />

<strong>in</strong> Oman Cables Industry. Except<br />

for Corn<strong>in</strong>g, US <strong>in</strong>terests <strong>in</strong><br />

the region are limited <strong>to</strong> Israel,<br />

where the Alp<strong>in</strong>e Group is the<br />

largest shareholder <strong>in</strong> Superior<br />

Cables, a company formed from<br />

the merger of three established<br />

players.<br />

There has been some development<br />

of cross-border <strong>in</strong>terests<br />

<strong>in</strong> the region, as cable companies<br />

based <strong>in</strong> one country<br />

with<strong>in</strong> Mena <strong>in</strong>vest <strong>in</strong> manufactur<strong>in</strong>g<br />

operations <strong>in</strong> another,<br />

either through acquisition or<br />

through build<strong>in</strong>g green-field<br />

operations. Examples of cable<br />

companies based <strong>in</strong> Mena that<br />

have established or bought<br />

cross-border operations are<br />

Saudi Cable Company (Turkey<br />

and Bahra<strong>in</strong>), Riyadh Cables<br />

(the UAE) and the Egyptian<br />

group El Sewedy (Saudi <strong>Arab</strong>ia,<br />

Sudan and Qatar).<br />

But the cable <strong>in</strong>dustry <strong>in</strong> Mena<br />

rema<strong>in</strong>s fragmented, as no<br />

really large groups have yet<br />

emerged <strong>in</strong> this region with a<br />

pan-national presence comparable<br />

with, for example,<br />

Nexans, Prysmian or Draka <strong>in</strong><br />

the European market. This is<br />

not surpris<strong>in</strong>g as the region is<br />

not <strong>in</strong>tegrated economically,<br />

though there are develop<strong>in</strong>g<br />

areas of economic co-operation<br />

such as the GCC and Maghreb<br />

countries.<br />

In Egypt the ma<strong>in</strong> cable mak<strong>in</strong>g<br />

companies are El Sewedy<br />

group, Electro Cable Egypt,<br />

Giza Cables Company and International<br />

Cable Company.<br />

The latter company is a subsidiary<br />

of the Nexans group.<br />

Cable operations <strong>in</strong> El Sewedy<br />

group <strong>in</strong>clude <strong>Arab</strong> Cables, Egytech<br />

Cables, Egytech Telecom<br />

Cables & Networks and United<br />

Industries. In addition <strong>to</strong> these<br />

larger groups, there are also<br />

several other smaller Egyptian<br />

cable producers, ma<strong>in</strong>ly active<br />

<strong>in</strong> LV energy cables.<br />

The Gulf region’s ma<strong>in</strong> cable<br />

producers are <strong>in</strong> Saudi <strong>Arab</strong>ia<br />

and the UAE. There are three<br />

large cable producers <strong>in</strong> Saudi<br />

<strong>Arab</strong>ia: Riyadh Cables, Saudi<br />

Cable and Jeddah Cable, each<br />

of which produces a range of<br />

energy and communication<br />

cables. After Saudi <strong>Arab</strong>ia, the<br />

UAE is the second largest cable<br />

market <strong>in</strong> the GCC region. Two<br />

of the lead<strong>in</strong>g UAE-based cable<br />

companies are Dubai Cable<br />

and National Cable Industries.<br />

The Saudi <strong>Arab</strong>ian Riyadh Cable<br />

group also has a substantial<br />

operation <strong>in</strong> the UAE. Three<br />

smaller cable companies also<br />

operate <strong>in</strong> the UAE: Tekab (part<br />

of the GIBCA group), Abu Dhabi<br />

Cables and Sharjah Cables.<br />

Smaller players <strong>in</strong>clude Kuwait,<br />

Bahra<strong>in</strong> and Oman.<br />

Accord<strong>in</strong>g <strong>to</strong> <strong>in</strong>dustry experts,<br />

the cable <strong>in</strong>dustry is both highly<br />

capital <strong>in</strong>tensive and dependent<br />

on the price of raw materials:<br />

labour and energy do not<br />

account for a significant share<br />

of the <strong>to</strong>tal end-product cost.<br />

Consequently, little cost reduction<br />

marg<strong>in</strong>s are <strong>to</strong> be obta<strong>in</strong>ed<br />

by manufactur<strong>in</strong>g cables locally.<br />

However, high transportation<br />

costs justify the rational for local<br />

production.<br />

Elsewedy Cables was chosen as<br />

a vendor with<strong>in</strong> Phase 9 of Kahramaa’s<br />

<strong>in</strong>frastructure development<br />

plan. Phase 9 <strong>in</strong>cluded<br />

work with<strong>in</strong> the Ezdan project<br />

as well as Lusail City. Although<br />

the ma<strong>in</strong> project owners were<br />

from the private sec<strong>to</strong>r, Kahramaa<br />

is solely responsible for<br />

specifications as well as<br />

the project owner’s needs. Currently<br />

Elsewedy has four projects<br />

onl<strong>in</strong>e.<br />

1) Lusail City: CP1. This is worth<br />

QR156 million and due <strong>to</strong> additions<br />

<strong>to</strong> the scope of work will<br />

<strong>in</strong>crease <strong>to</strong> somewhere <strong>in</strong> the<br />

range of QR250 million. This<br />

project starts from design <strong>to</strong> <strong>in</strong>stallation.<br />

2) Lusail City: CP2. The ma<strong>in</strong><br />

contrac<strong>to</strong>r is Al Jaber and partners.<br />

The contract is worth<br />

$24,4 million.<br />

3) ABB: Project number 2 –<br />

Ezdan and Gharaffa Mall substation.<br />

This project is worth<br />

QR26,5 million/$7,05 million.<br />

4) Yuksel/Midmac. Elsewedy<br />

has a subcontract <strong>to</strong> divert the<br />

current 66KV cable that is obstruct<strong>in</strong>g<br />

the construction of<br />

the Salwa Road Expressway.<br />

It has just completed a project<br />

for Kahramaa (Contract No:<br />

GTC 330) which was worth<br />

QR4,185 million. The project<br />

was completed on schedule,<br />

with no accidents and <strong>to</strong> the<br />

cus<strong>to</strong>mer’s satisfaction. Accord<strong>in</strong>g<br />

<strong>to</strong> Eng Thamim, one of<br />

the objectives of the projects<br />

division is <strong>to</strong> ensure that the<br />

client is satisfied and that the<br />

project is completed with no accidents.<br />

He emphasized that a<br />

healthy “balance sheet” is good<br />

for the company but “a good<br />

reputation is even better”.

‘Guaranteed’<br />

outlet for gas<br />

The Golden Pass LNG Term<strong>in</strong>al<br />

will provide a “guaranteed outlet”<br />

for Qatar <strong>in</strong><strong>to</strong> the <strong>world</strong>’s largest<br />

natural gas market, which is the<br />

US, ConocoPhillips Qatar president<br />

Erec Isaacson has said. The<br />

term<strong>in</strong>al will facilitate “steady<br />

production” from Qatargas 3, <strong>in</strong><br />

which ConocoPhillips has a significant<br />

stake. “The jo<strong>in</strong>t ownership<br />

with Qatar Petroleum allows us<br />

<strong>to</strong> ma<strong>in</strong>ta<strong>in</strong> a balanced relationship<br />

Japan gets more<br />

LNG from Qatar<br />

Qatargas will supply an additional<br />

4 million <strong>to</strong>nnes of<br />

liquefied natural gas (LNG)<br />

<strong>to</strong> Japan, which was hit by<br />

an earthquake and tsunami<br />

recently. The Qatari LNG will<br />

be dispatched <strong>to</strong> long-term<br />

cus<strong>to</strong>mers <strong>in</strong> Japan over the<br />

next 12 months. Qatargas is<br />

already contracted <strong>to</strong> supply<br />

6 million <strong>to</strong>nnes per year (tpy)<br />

over a 25-year period. Qatargas<br />

had signed two sales and<br />

purchase agreements with<br />

Chubu Electric and seven<br />

other Japanese power and<br />

gas companies <strong>in</strong> 1992 and<br />

1994.<br />

Qatargas said the additional<br />

supply of 4 million <strong>to</strong>nnes<br />

would be enough <strong>to</strong> generate<br />

approximately 28 terrawatthours<br />

(TWh) of electricity, or<br />

meet the average electricity<br />

consumption of 5 million Japanese<br />

households for a year.<br />

Qatargas CEO Sheikh Khalid<br />

b<strong>in</strong> Khalifa al-Thani had visited<br />

Japan recently. Dur<strong>in</strong>g his<br />

talks with officials and LNG<br />

cus<strong>to</strong>mers, Sheikh Khalid re-<br />

iterated Qatar’s support <strong>to</strong> Japan<br />

at its time of need.<br />

Qatargas, established <strong>in</strong><br />

1984, is the largest LNG<br />

producer <strong>in</strong> the <strong>world</strong>, with<br />

an annual production capacity<br />

of 42 million <strong>to</strong>nnes per<br />

year. Qatargas has seven<br />

LNG tra<strong>in</strong>s, of which four are<br />

“mega tra<strong>in</strong>s” and the largest<br />

<strong>in</strong> the <strong>world</strong>. Each one has a<br />

production capacity of 7.8 million<br />

<strong>to</strong>nnes per year.<br />

The magnitude-9 quake, the<br />

ensu<strong>in</strong>g tsunami and aftershocks<br />

<strong>in</strong> March smashed<br />

Japan’s <strong>in</strong>frastructure and<br />

wiped out communities <strong>in</strong> a<br />

wide area of north-east Honshu.<br />

The disasters damaged<br />

the Fukushima a<strong>to</strong>mic power<br />

plants, spark<strong>in</strong>g the most<br />

serious nuclear crisis s<strong>in</strong>ce<br />

the 1986 Chernobyl reac<strong>to</strong>r<br />

explosion. Analysts expect<br />

imports of fuels such as LNG<br />

and fuel oil for thermal power<br />

mechanical construction<br />
