36. INTIMIDATION(A) An Actor shall not be compelled to participate in encounter groups or sensitivity sessionswhich the Actor deems dangerous to Actor’s mental health or an infringement upon Actor’smental or physical privacy.(B) If an Actor makes claim in writing to Equity within seven days that Actor was intimidatedinto terminating his contract by being compelled to participate in such encounter group orsensitivity session, Equity shall promptly notify the Producer. If such intimidation isacknowledged or established, the Actor shall be reinstated and shall be made whole for anyloss.(C) Neither the Producer, nor any personnel under the Producer’s control, shall intentionallyintimidate, harass or humiliate any Actor at any time, including, but not limited to, allcommunications to <strong>Actors</strong> in connection with artistic notes. However, it is understood thatthere is no intent to interfere with the original Director’s or original Choreographer’s ability tocritique <strong>Actors</strong> in connection with artistic notes.37. JUVENILE ACTORS.The following special provisions shall apply to <strong>Actors</strong> aged under 16 years at the time of signing:(A) Producer shall provide a responsible person to supervise Juvenile <strong>Actors</strong> during therehearsal period and, after the first public performance, from the half-hour call until JuvenileActor(s) is called for by a responsible parent or guardian after curtain down. This personshall not be the Stage Manager or the required Assistant Stage Manager.(B) If tutoring is required, when the Juvenile Actor(s) are rehearsing and/or performing on“10 out of 11 ½ “ hour day, all such required tutoring must be held during the permittedrehearsal hours.(C) Dressing Rooms. Producer shall use best efforts to provide separate dressing rooms formale and female Juveniles which shall be separate from the adult dressing rooms.(D) Working Papers. The Juvenile’s working papers must be filed with the New York StateDepartment of Labor (copy to Equity) by the Juvenile’s first day of rehearsal.(E) The foregoing shall apply until the Juvenile Actor reaches the age of 16.(F) When Juvenile <strong>Actors</strong> are employed, the Producer will adhere to the provisions of theChild Performer Education & Trust Act of 2003.38. LAWS GOVERNING.(A) All contracts of employment shall be subject to, be construed by and all the rights of theparties thereto shall be determined by the laws of the State of New York except asotherwise may be provided. If there are any valid provisions of law applicable to a contractof employment which are in conflict herewith, the provisions of the contract which conflict32
