48. PHOTOGRAPHS AND PUBLICITY. (See also Rule 6, BILLING AND PROGRAMS andRule 67, TELEVISING, RECORDING, AND MOTION PICTURE.)(A) The Producer may require the Actor to pose not only for customary and usualphotographs, but also for photographs to appear in magazines or newspapers for the solepurpose of publicizing and advertising this production of the play. Said photographs mayalso be used to publicize the theatre or an upcoming season for a period not to exceedthree years. Any other use of said photographs require advance written authorization fromeach Actor appearing in the photograph in addition to any payments which may be dueunder this rule.(1) In all cases under the control of the Producer, the Actor’s name shall be properlycredited in the publicity whenever and wherever the photographs are used.(2) If the Actor does not receive proper credit in photographs or publicity under the controlof the Producer, Equity or the Actor shall notify the Producer by certified letter returnreceipt requested of the improper credit. If such error is not corrected by at least oneweek after receipt of said notice to the Producer, the Producer must pay the Actor oneseventhof Actor’s contractual salary for each day the error remains uncorrected.(B) Company picture calls, except those during the authorized rehearsal hours or dressrehearsals for replacement, shall be limited to:(1) A maximum of one during the rehearsal period.(2) A maximum of one during the run of the production.(C) Scheduling.(1) Picture calls shall take place immediately following the matinee or eveningperformance or during the authorized rehearsal hours or dress rehearsals required forreplacements.(2) Picture calls may be scheduled between performances when two performances aregiven in one day only with the consent of the majority of the <strong>Actors</strong> involved taken bysecret ballot. Notice of a picture call must be at least a 24 hour notice and must beposted before the half hour of a performance. If the Producer desires to take pictures atthe time auditions are held, such pictures may be taken prior or subsequent to theauditions with the written consent of the Actor, prior or subsequent to the auditions, but inno event during auditions.(3) The time during which said photographs may be taken shall not exceed two hours inthe case of a dramatic play or three hours in the case of a musical comedy or revue.When the photo call follows a performance, the time of the call shall commence at theconclusion of the performance.(4) When photograph calls are allowed between performances the Actor shall have notless than one hour rest period between performances on a two show day and theProducer shall, at the Producer’s own expense, provide the Actor(s) with a hot meal.
