The whilk day Alexr Scrimgeour Deane of gild his assessors and ye whole bodie of ye
merchandes friemen brothers of ye gild of ye brugh of Dundie conveined in ye counsel house
yairof considering yr liberties friedomes and priviledges of ye gildrie and wthers granted be
yem and yair predecessors be our soveraine lord and his most noble projenitors respecting
alsua ye actes of parliament ald ancient actis of yis brugh and wthers actis statutis and
ordinances maid in yair favors and guidsoles deliberation had yranent and for ye more sure
observation and keeping of sick covenents as may tend to ye braking of ye saids priviledges or
be hurtfull to ye samen and in speciall for obedience mantainance fortification and defence of
ye wholl lawis statutis and ordinances granted given maid and constitute to as said is or any
wtherwayes heirefter and for ye maire substantious doing yrof and with standing of sick
novations and in coveniences as may be som curiouss persones be done and is begun already
to be practised throw ye iniquitie of ye tyme tending to ye utter wrack of thair estaite. It is
concluded and ordained yat ye whole lawes actis statutes and ordinances maid in ony way in
favoris of ye merchand estaite and maintenance of yr libertries and in speciall ye actis and
statutes maid yat no merchand frieman within yis brugh in contrair yair oath and fideletie
transport trafect or handle with unfremens goodis be ratefied and approved in all articles
clauses and points contained yrin and yat sharp and diligent execution be maid upon ye
offenders without respect of any person with thir additions following to wit yat forsamilke as

Alsua considering and understanding how hurtfull it is dangerous it is to ane freman
merchand who hes trafect and handling of his own to be ane factor in any way to ane
unfreman stranger in respect of ye great defrane folshood yat may be vsed and done under
colour of his own handling not onlie to ye frie merchandes of yis brugh but als weill to ye
strangers to whom he sall be factor to in respect of his own merchand frieman be factor
intromemtt nichtbuyer or seller to any unfreman stranger his guids geire and merchandise
without first and except befor ye receaving and acception of ye said factorie ye said free
merchand compeire befor ye Deane of gild and his assessors and yaire renunce discharge and
ower give his traid handling and transact nor vse any kind of merchandise yrefater ather in
buying or selling but only to keip and hald him at his office and trade of factorie and not
exceed ye bounds yrof but do all thinges belonging yrto as ane factor to strangers goods under
ye paine of ane hundreth lib. to be applied as said is and gif it happens ony merchand samen
to be factor to any unfreman stranger in maner foirsaid factor yat incontinent efter ye aryvell
of ye goods and merchandise to yis brugh ye freman deput factor sall give up ye samen and
enter yem in ye towns buiks as if ye owner yrof unfreman were pnt him self to be sold used
and disponed vpon to frie merchandise as unfremens goods according to ye actis of
parliament and liberties of yis brugh under ye paine foirsaid.
And sicklyk ye selling and disponing of ye said goods ye said factor sall wair and imploy ye
money of ye samen with fremen merchandise upon goods or merchandise out of yaire handes
