If the employee fails to return from FMLA leave for reasons other than:1. The continuation of a serious health condition of the employee or a covered family member,or2. Circumstances beyond the employee’s controlthe <strong>BOCES</strong> will seek reimbursement from the employee for the employer’s portion of the premiums paidby the <strong>BOCES</strong> on behalf of the employee during the period of leave. (Certification is required within 30days of failure to return for either reason)._______ By initialing, I understand how continuation of my health & dental insurance will work while onFMLA leave and I agree to the above policy and procedures.Special Rules for Instructional EmployeesAn instructional employee who begins any type of FMLA leave at least five (5) weeks before the end ofan academic term, may be required not to return until the new term begins if the leave is at least three(3) weeks long and the employee would return during the last three (3) weeks of the term. Aninstructional employee who begins leave, for any purpose other than personal illness, less than five (5)weeks prior to the end of an academic term, may be required not to return until the new term begins ifthe leave is greater than two (2) weeks and the employee would return during the lsat two (2) weeks ofthe term.For instructional employees who request intermittent medical leave and it is forseeable that the medicaltreatment shall cause the employee to be on leave more thaln 20% of the total number of working daysin the period of leave, this <strong>BOCES</strong> may require thel employee to take a block of time or to transfer to anequivalent position for which the employee is qualified, but which better accommodates intermittentperiods of leave.Rev 02/2011
