<strong>EEB</strong> <strong>Memor<strong>and</strong>um</strong> <strong>to</strong> the <strong>Czech</strong> EU <strong>Presidency</strong>- Prohibit new uses of mercury, <strong>and</strong> phase-out its use in products <strong>and</strong>processes based upon the availability of safe <strong>and</strong> cost effectivealternatives.- Phase out international trade of mercury <strong>and</strong> mercury products.- Minimise anthropogenic atmospheric emissions of mercury whereprocesses or products cannot be phased-out or mercury use isunintentional, through such mechanisms as Best Available Technique(BAT)/BEP requirements.- Address the environmentally sound management of wastes containingmercury, including environmentally sound s<strong>to</strong>rage.- Enhance the global moni<strong>to</strong>ring of mercury, particularly in the food suppliesof humans <strong>and</strong> wildlife.- Provide opportunities <strong>to</strong> facilitate the effective remediation ofcontaminated sites.- Ensure sufficient new <strong>and</strong> additional financial <strong>and</strong> technical resourcesincluding technology transfer, capacity building, <strong>and</strong> information exchange<strong>to</strong> enable developing <strong>and</strong> transition countries <strong>to</strong> control mercury sourceseffectively without disrupting poverty reduction goals.- Encourage public information <strong>and</strong> awareness-raising especially forwomen, children, Indigenous Peoples, Fisher Folk, consumers of fish, <strong>and</strong>the least educated.- Ensure strong, fair, <strong>and</strong> balanced mechanisms <strong>to</strong> support transparency,effective implementation, <strong>and</strong> compliance with the regime.In its Decision, the Governing Council should also provide for the possibility tha<strong>to</strong>ther metals can be added <strong>to</strong> the mercury LBI at a future time.Therefore <strong>EEB</strong> urges the <strong>Presidency</strong> <strong>to</strong>:- Present a unified <strong>and</strong> strong position of the EU at the February session ofthe UNEP Governing Council for a free-st<strong>and</strong>ing legally binding instrumentaddressing, amongst other things, the reduction of mercury supply(including s<strong>to</strong>rage <strong>and</strong> trade), its use in products <strong>and</strong> processes <strong>and</strong>atmospheric mercury emissions (through BAT or otherwise).- Insist that an International Negotiating Committee will immediately begindrafting text.- Continue intensive dialogue with key non-EU governments <strong>and</strong>stakeholders <strong>and</strong> work actively <strong>to</strong>wards resolving remaining differences <strong>to</strong>ensure a positive result.7.2. Biodiversity <strong>and</strong> Climate Change AdaptationDuring the last week of the French <strong>Presidency</strong>, the Commission published its midterm review of the Biodiversity Action Plan, giving its assessment of how Europeis progressing <strong>to</strong>wards the target of halting the loss of biodiversity by 2010.25
