HOW TO CARRY OUT A PHYSICALSEARCH ON A LAND TITLEStep 1Make a written Request for a search <strong>to</strong> theOffice of Titles giving the description ofthe <strong>Land</strong>:For MailoCounty, Block & Plot no;For LeaseholdLeasehold Register Volume & Folio No;For FreeholdFreehold Register Volume & Folio No.Step 2The application is presented <strong>to</strong> the Officeof Titles and stamped ‘received’. It isapproved by a Registrar of Titles on behalfof the Commissioner. The applicationis forwarded <strong>to</strong> the Records Section <strong>to</strong>retrieve the file, then the bearer is sent <strong>to</strong>pick a pay slip and pay UGX 10,000/=. TheCashier informs the bearer which bank <strong>to</strong>make the payment.Step 3The applicant pays that amount in the bankand obtains a receipt that is presented<strong>to</strong> the Office of Titles. On <strong>ver</strong>ification ofthe receipt, the registry copy is retrievedand a search letter signed by a Registrarof Titles is issued <strong>to</strong> the applicant withinthree working days after presenting theBank receipt.Documents required: Application letterfor a Search Fees paid through the bank:UGX 10,000/= (Search fee).2. HOW TO CARRY OUT A SUBDIVISION ON MAILO AND FREEHOLDLANDStep 1The Applicant must have in his/herpossession a duplicate Certificate ofTitle, fully filled Mutation Form, and twoauthentic Passport pho<strong>to</strong>graphs of theowner (seller). The Mutation Form musthave been stamped by the registeredSurveyor accompanied by form PPA(Under the Physical Planning Act, 2010),fully filled by the registered owner, datedand signed by all the necessary Parties.Step 2The Applicant presents the Originals anda Pho<strong>to</strong>copy of the documents <strong>to</strong> theMailo registry for checking and approvalof the subdivision, in order <strong>to</strong> proceed.The documents are received and thepho<strong>to</strong>copy is stamped ‘Received’ andreturned <strong>to</strong> the Applicant.Step 3The Applicant checks after 5 workingdays <strong>to</strong> pick the documents. The applicantpresents the pho<strong>to</strong>copy of the documentsstamped on received and on collection itis stamped ‘Returned’.Step 4On presentation of the Approved MutationForm from the District Surveyor, with anArea Schedule, Receipts of checking fees,Deed Plan fees, registration fees, and theduplicate Certificate of title and passportpho<strong>to</strong>graphs, and a set of pho<strong>to</strong>copieddocuments, the Applicant submits them<strong>to</strong> the Mailo registry. HOW TO ACQUIRE A SPECIALCERTIFICATE OF TITLE/ REPLACEA LOST OR DAMAGED TITLEStep 1The Applicant must have in his/herpossession an application for a SpecialTitle, Statu<strong>to</strong>ry declaration attached<strong>to</strong> application duly filled, signed bythe Applicant and Commissioned bya Commissioner for Oaths and twoPassport pho<strong>to</strong>graphs of the personrequesting for the Special Certificateof Title. The Applicant must have paidUGX 15,000/= as Registration feesand UGX 10,000/= as Stamp Duty(UGX 5,000/= on the Application &UGX 5,000/= on the declaration).Step 2The Applicant presents the fullset of original documents and apho<strong>to</strong>copy of the same <strong>to</strong> Office ofTitles for processing. The Pho<strong>to</strong>copyis stamped ‘Received’ and returned <strong>to</strong>the Applicant.Step 3The Applicant checks with the Officeof Titles after 5 working days <strong>to</strong>pick a letter <strong>to</strong> the <strong>Uganda</strong> Gazettefor notification of the public on theimpending issuance of a SpecialCertificate of Title.Step 4After 30 days notification, the Applicantpresents a receipt for the Gazette <strong>to</strong>the Office of Titles for confirmation ofthe publication.Step 5The Office of Titles <strong>ver</strong>ifies the receiptand the Gazette notice and proceeds <strong>to</strong>issue a Special Certificate of Title.Step 6After 10 days, the Applicant uponpresentation of the pho<strong>to</strong>copystamped ‘Received’ collects the SpecialCertificate of Title. The Pho<strong>to</strong>copy isStamped ‘Returned’ on completion.Documents required: Letter ofApplication for Special Title, Statu<strong>to</strong>ryDeclaration, Copy of the Gazette,Passport Pho<strong>to</strong>graphs and Generalreceipts of Payment.Fees paid:Registration fees – UGX 15,000/=Stamp Duty – UGX 10,000/=9. HOW TO CONVERT ALEASEHOLD TO A FREEHOLD LANDTITLEStep 1The Applicant must have in his/herpossession fully completed Forms 5& 19 in duplicate, a set of 3 authenticdeed plans, Duplicate Certificateof Title, 3 Passport Pho<strong>to</strong>graphs,Receipts of Payment and a forwardingletter requesting for a con<strong>ver</strong>sion fromLeasehold <strong>to</strong> Freehold title signedby the District <strong>Land</strong> Officer of therespective District where the land islocated.If the land was titled after the comingin<strong>to</strong> force of the <strong>Land</strong> Act (2 nd July1998), then a Surrender Deed/Agreement of the Lease is required. Itis prepared by the Secretary DLB <strong>to</strong> beexecuted by the DLB and the applicant/ registered proprie<strong>to</strong>r.Step 2The Applicant presents the full set oforiginal documents and a pho<strong>to</strong>copyof the same, <strong>to</strong> Department of <strong>Land</strong>Administration for Checking. ThePho<strong>to</strong>copy is stamped ‘Received’ andreturned <strong>to</strong> the Applicant. The Applicantchecks with the Department of <strong>Land</strong>Administration after 10 working days<strong>to</strong> confirm their approval or rejection,and is given a letter advising him/heron the fees <strong>to</strong> be paid.Step 3Once approved, the documents areforwarded <strong>to</strong> Office of Titles for issuanceof a Freehold Title. The Applicantchecks after 10 working days if thereis a Surrender Deed/Agreement <strong>to</strong> beprocessed.Step 4The Applicant presents the pho<strong>to</strong>copygiven <strong>to</strong> him/her by the Departmen<strong>to</strong>f <strong>Land</strong> Administration stamped‘Received’ and identificationdocuments on collecting the FreeholdTitle after 20 working days. Theapplicant signs and the Pho<strong>to</strong>copy isstamped ‘Returned’ on completion.Documents required: Forms 5 &19, Duplicate Certificate of Title,set of Deed Plans, set of Passportpho<strong>to</strong>graphs, General receipts ofPayment and a Requesting letter.Fees paid at the Ministry:Stamp duty- UGX 5,000/= andRegistration fees for the SurrenderDeed – UGX 10,000/=; RegistrationACCESS TO ACCURATE LAND INFORMATIONfees – UGX 10,000/=Assurance of Title – UGX 20,000/=issuance of the Title – UGX 20,000/=.10. HOW TO TRANSFER LANDUNDER LEASEHOLD AND FREEHOLDStep 1The Applicant must have in his/her possession fully completed se<strong>to</strong>f Transfer forms which include aTransfer form and two Consent forms,A pho<strong>to</strong>copy of the duplicate certificateof title and two authentic Passportpho<strong>to</strong>graphs of the buyer and seller.Step 2The Applicant presents the documents<strong>to</strong> the Valuation Division for valuationassessment for Stamp duty. TheApplicant checks with the ValuationDivision within a period of 3 workingdays <strong>to</strong> pick the form and proceed <strong>to</strong>pay stamp duty and registration feesin the Bank. Stamp duty is 1% of thevalue of the land as assessed by theChief Go<strong>ver</strong>nment Valuer.Step 3Pay the fees in the Bank, get a receiptand your Transfer form embossed. Getconsent from the Controlling Authorityof the Leasehold Title. Submit alldocumentation <strong>to</strong>gether with theDuplicate Certificate of Title, receiptsand pho<strong>to</strong>copies of all documents <strong>to</strong>the Office of Titles.Step 4The pho<strong>to</strong>copy is stamped ‘Received’and returned <strong>to</strong> the client. HOW TO CORRECT ACERTIFICATE OR RECTIFY A TITLEStep 1The Applicant draws the attention ofthe error <strong>to</strong> the attention of the Office ofTitles in writing and submits it <strong>to</strong>getherwith the duplicate Certificate of Title.Where the rectification or correctioninvolves giving notice <strong>to</strong> parties, theapplicant checks after 5 working days<strong>to</strong> confirm despatch of Notice andthere after checks after expiry of thenotice for a completed action.Where such Notice is not required, aclient checks after 10 working days.Documents required:Writen Communication and DuplicateCertificate of Title.Fees paid: No fees required.12. HOW TO REPLACE A MISSINGREGISTRY COPY OR WHITE PAGEStep 1The Applicant must have in his/her possession a transaction <strong>to</strong> beregistered, a Duplicate Certificateof Title and a request letter for aSubstitute, Passport Pho<strong>to</strong>graph and aset of Pho<strong>to</strong>copy of all the documents.Step 2The Applicant presents the full set oforiginal documents and a pho<strong>to</strong>copyof the same, <strong>to</strong> the Office of Titles forprocessing of the Substitute Certificateof Title. The Pho<strong>to</strong>copy is stamped‘Received’ and returned <strong>to</strong> theApplicant.Step 3The Applicant checks with the Office ofTitles after 10 working days <strong>to</strong> confirmthe replacement of the original RegistryCopy and or White Page.Documents required: Letter ofApplication for Substitute, PassportPho<strong>to</strong>graph, Transaction <strong>to</strong> beRegistered.Fees paid: No fees required.13. HOW TO REGISTER A VARIATIONOF A LEASEStep 1The Applicant must have in his/her possession a letter from theControlling Authority for variation ofthe Lease, Duplicate Certificate of Titleand two Passport pho<strong>to</strong>graphs. If thevariation involves change of <strong>Land</strong> use,then Form PPA 3 is included.Step 2The Applicant presents thedocuments <strong>to</strong> the Department of <strong>Land</strong>Administration for assessment ofrevised ground rent and premium perannum and collects the documentsafter 3 working days <strong>to</strong> confirm theassessment.Step 3The Department of <strong>Land</strong> Administrationforwards the documents <strong>to</strong> the Officeof Titles for drafting of the Variationdeeds.Step 4The Applicant collects the Variationdeeds after 5 working days and takesthem for payment of stamp duty andRegistration fees and execution by theParties.Step 5The Applicant returns the embosseddocuments, dated, signed and sealedby the Chairperson and Secretaryof the Controlling Authority and theowner. A pho<strong>to</strong>copy of all documentsis also submitted, which is stamped‘Received’ and returned <strong>to</strong> theApplicant.Step 6The Applicant checks after 10 workingdays <strong>to</strong> collect the completed DuplicateCertificate of Title.Documents required: Letter fromControlling Authority for variation ofLease, Duplicate Certificate of Title,Variation deeds, set of Passportpho<strong>to</strong>graphs, and General receipts ofPayment.Fees paid:Stamp duty – UGX 5,000/= per copyRegistration fees – UGX 20,000/=.14. HOW TO TRANSFER MAILO LANDStep 1The Applicant must have in his/herpossession:• A Transfer form;• Two Consent forms;• Pho<strong>to</strong>copy of the duplicate Certificateof Title;• Two authentic Passport pho<strong>to</strong>graphsof the buyer and seller.Step 2The property or land is assessed atmarket value for purposes of theApplicant paying stamp duty which is1%The Applicant Checks after 3 workingdays <strong>to</strong> collect Assessment.Step 3.The Applicant pays the stamp duty andregistration fees in the bank and gets areceipt and transfer form embossed by<strong>Uganda</strong> Revenue Authority (URA).Step 4Submit all documentation <strong>to</strong>getherwith the Duplicate certificate of Title,Receipts and Pho<strong>to</strong>copies of alldocuments <strong>to</strong> the Office of Title. Thepho<strong>to</strong>copy is stamped ‘Received’. Theapplicant is asked <strong>to</strong> check after 10working days <strong>to</strong> collect the Title.Documents Required:• Duplicate Certificate of Title• Set of Passport pho<strong>to</strong>graphs.• Embossed Transfer form and consentform duly witnessed and dated.• General receipts of Payment.Fees paid at the Ministry/DistrictStamp Duty=1% of the value of the landRegistration fees UGX 10,000/= (Extraplots UGX 5,000/= each). Companyseal attracts additional UGX 5,000/=.15. HOW TO REGISTER A MORTGAGEStep 1The Applicant must have in his/herpossession:• Two sets of embossed, duly signedDated and witnessed MortgagesDeeds• Duplicate Certificate of Title• Two Passport Pho<strong>to</strong>graphs of theperson registering the MortgageStep 2The Applicant presents the full set oforiginal documents and a pho<strong>to</strong>copy ofthe same, <strong>to</strong> the same, <strong>to</strong> the Office ofTitles for processing. HOW TO ACQUIRE A LEASEHOLDLAND TITLEStep 1 - At the District• The Applicant goes <strong>to</strong> the District<strong>Land</strong> Office or Area <strong>Land</strong> Committee<strong>to</strong> pick the Application Form 8, fill it,attach 4 passport pho<strong>to</strong>s and submitthem <strong>to</strong> the Area <strong>Land</strong> Committeeafter paying the required fees ofUGX 10,000/=.• The Area <strong>Land</strong> Committee receivesthe Application and issues a noticefor a public hearing using Form 10.• The Area <strong>Land</strong> Committee visits thesite and <strong>to</strong>gether with the neighboursfill and sign the Demarcation Form23. The Area <strong>Land</strong> Committee alsocomplies an inspection Report andsubmits the documents <strong>to</strong> the District<strong>Land</strong> Office.• The District <strong>Land</strong> officer preparesa technical report based on thePhysical Planning Guidelines, inconsultation with the establishedPhysical Planning Committee andforwards all the documents <strong>to</strong> theDistrict <strong>Land</strong> Board for approval, afterwhich, the documents are returned <strong>to</strong>the District <strong>Land</strong> Officer <strong>to</strong> preparethe lease offer using Form 18. TheDistrict <strong>Land</strong> Officer then forwardsall the documents <strong>to</strong> the Ministry of<strong>Land</strong>s for preparation of the <strong>Land</strong>Title.Step 2- At the MinistryThe Applicant must have in his/herpossession:• Fully completed Forms 8, 10, 18 and23• Area <strong>Land</strong> Committee Report• District <strong>Land</strong> Officer’s TechnicalReport• 3 Passport Pho<strong>to</strong>s• A forwarding letter and• Receipts of payment of Applicationfees, premium and Ground Rent.Step 3The Applicant presents the full set oforiginal documents and a pho<strong>to</strong>copyof the same <strong>to</strong> the Department of <strong>Land</strong>Administration for checking.The pho<strong>to</strong>copy is stamped ‘Received’and returned <strong>to</strong> the Applicant. TheApplicant checks with the Departmen<strong>to</strong>f <strong>Land</strong> Administration after 10 workingdays <strong>to</strong> confirm their approval orrejection.Step 4If the application is approved, theApplicant goes ahead <strong>to</strong> make paymen<strong>to</strong>f fees <strong>to</strong> URA; If rejected then a letterexplaining rejection is written and alldocuments returned <strong>to</strong> Applicant forcorrection and re-submission.LAND REGISTRATION PROCEDURESStep 4The documents are forwarded <strong>to</strong> theoffice of Titles for preparation andissuance of Lease agreements.The Applicant checks after 10 workingdays <strong>to</strong> pick up the Lease agreements forsigning and sealing by the Chairpersonand Secretary of the ControllingAuthority i.e <strong>Uganda</strong> <strong>Land</strong> Commissionor the respective District <strong>Land</strong> Boardand <strong>to</strong> pay stamp duty, which is 1%of the premium and 1% of the annualrent multiplied by the number of yearsgranted.Step 5The Applicant presents fully signed andsealed lease documents by the <strong>Uganda</strong><strong>Land</strong> Commission or the District <strong>Land</strong>Board Chairperson and Secretary andLease agreements embossed by URA.The Applicant is given a pho<strong>to</strong>copyof the Lease agreements stamped‘Received’ and checks after 20 workingdays.Documents Required:• Form 8, 10, 18 and 23• Set of Deeds Plans• Set of Passport Pho<strong>to</strong>graphs• General receipts of Payment• Requesting Letter.Fees paid at URA:1% of the Premium and Ground RentFees paid at the Ministry/District• Registration fees UGX 10,000/=• Assurance of Title UGX 20,000/=• Insurance fees UGX 20,000/=• Preparation of Lease UGX 20,000/=17. The Area <strong>Land</strong> Committee alsocompiles an Inspection Report andsubmits the documents <strong>to</strong> the District<strong>Land</strong> Office.• The District <strong>Land</strong> Officer prepares atechnical report based on the PhysicalPlanning Guidelines, in consultationwith the established PhysicalPlanning Committee and forwardsthe documents <strong>to</strong> the District <strong>Land</strong>Board for approval, after which, theDistrict <strong>Land</strong> Officer forwards thedocuments <strong>to</strong> the Ministry of <strong>Land</strong>sfor preparation of the <strong>Land</strong> Title.Step 2The Applicant must have in his/herpossession:• Fully completed Form 4, 10, and 23,In case of acquisition of a Freehold byGrant from a Controlling Authority,the Applicant fills Form 19• Area <strong>Land</strong> Committee Report• District <strong>Land</strong> Officer’s TechnicalReport• 3 Passport Pho<strong>to</strong>s• A forwarding letter andit• Receipts of payment of Applicationfees.Step 3The Applicant presents the full se<strong>to</strong>f original documents in Duplicateand a pho<strong>to</strong>copy of the same <strong>to</strong> theDepartment of <strong>Land</strong> Administration forchecking.The Pho<strong>to</strong>copy is stamped ‘Received’and returned <strong>to</strong> the Applicant.The Applicant checks with theDepartment of <strong>Land</strong> Administrationafter 10 working days <strong>to</strong> confirm theirapproval or rejection.Step 4If approval is given, the Applicant goesahead <strong>to</strong> make payment of fees <strong>to</strong> URAand if rejected, a letter explainingrejection is written and all documentsreturned <strong>to</strong> Applicant for correction andre-submission.Step 5Once approved the documents areforwarded <strong>to</strong> the Office of Titles forissuance of a Freehold <strong>Land</strong> Title. The Allocations areprocessed by Department of <strong>Land</strong>Administration and Departmen<strong>to</strong>f <strong>Land</strong> Registration Department(Office of Titles).►►Deed Plans are processed fromDepartment of Surveys and Mapping(Entebbe) or the respective DistrictSurvey Offices. Mutation forms arealso processed by Departmen<strong>to</strong>f Surveys & Mapping or theirrespective Districts Survey Offices.Only Subdivisions are approved bythe Office of Titles.►►Disputes on land are handledby Courts of Law.
