Regulations/Activity Prior to January 31, 2012• Land Development Code– Prior to 1990, El Paso County considered oil and gas operations as Mineral ResourcesExtraction, regulated via Special Use permit (BOCC hearing).– 1990 Land Development Code Amendments clarified the definition of mineral and mineralresources extraction to effectively exclude oil and gas drilling from the definition of mineralresources extraction, without adding any specific new provisions addressing oil and gasoperations.– As a result of the amendments, the Code did not address specific zoning or developmentstandards for oil and gas operations (exploration or production).– Therefore, the Temporary Use Permit process was used to process applications for exploratorywells.• Development Activity– ETOCOReceived approval of two (2) temporary use applications for exploratory drilling(State and Ververs wells). Only the Ververs well was drilled.and testing– Pine Ridge Oil and Gas, LLCReceived approval of three (3) temporary use applications for exploratory drilling and testing(Naos, Vela, and Carina wells). Only the Naos well was drilled.– Ultra Resources, Inc.Received approval of three (3) temporary use applications for exploratory drilling and testing(Olive Oyl, Brutus, and Spinach wells). To date, the Olive Oyl well has been drilled andthe Brutus well pad earthwork is under construction.
