<strong>Hinesburg</strong> <strong>Zoning</strong> <strong>Regulations</strong> – October 12, 2009 Article 3(9) Dead storage.(10) Residential dwellings on the second or third stories <strong>of</strong> structures with the followingconditions:(a) Residential use is compatible with the use occupying the first level <strong>of</strong> thestructure including, but not limited to, noise levels, vibration levels, hours <strong>of</strong>operation and traffic/parking consideration.(b)(c)Adequate outdoor space must be made available for outdoor residential use.Residential uses shall not be permitted where toxic, flammable or otherwisehazardous materials not generally associated with residential uses are stored orused on the first level <strong>of</strong> the structure.(11) Ro<strong>of</strong>top solar hot water.(12) Ro<strong>of</strong>top photovoltaics.(13) Ro<strong>of</strong>top wind turbines.(14) Photovoltaic trackers.(15) Small wind energy systems.3.8.5 CONDITIONAL USES(1) Laboratories for research or photo processing.(2) Outdoor recreational facilities.(3) Public utility substations and transmission lines.(4) Convenience or variety stores.(5) Restaurants (excluding drive-through).(6) Banks or other monetary institutions with drive-through(7) Hotels, motels, hostels, and inns.(8) Public and private educational institutions and accompanying customary recreationareas.(9) Public and private hospitals.(10) Places <strong>of</strong> worship including parish houses.(11) Commercial parking lots and storage garages.(12) Motor vehicles, farm equipment sales, service, and repair facilities with the followingconditions:(a) Entrance and exit driveways shall be located not nearer than fifteen (15) feetto any property line unless the driveway is designed for shared access betweentwo lots, and shall be so laid out as to avoid the necessity <strong>of</strong> any vehicleleaving the property to back out across any public right-<strong>of</strong>-way or portionthere<strong>of</strong>.(b) Vehicle lifts or pits, dismantled and disabled motor vehicles, trailers and allparts or supplies shall be located within a building enclosed on all sides.(c) All service or repair <strong>of</strong> motor vehicles, other than such minor servicing aschange <strong>of</strong> tires or sale <strong>of</strong> gasoline or oil, shall be conducted in a building fullyenclosed on all sides.(d) <strong>The</strong> storage <strong>of</strong> gasoline or flammable oils in bulk shall be located fullyunderground or screened and not nearer than thirty-five (35) feet to anyproperty line other than the street line.(e) No gasoline pumps shall be located nearer than fifteen (15) feet to anyproperty line.(f) No building permit shall be issued for a motor vehicle service station located- Page 26 -
