It’s hard to believe that this is my
last Chairman of the Chamber article.
Just a few short years ago when I was
Chairman it seems as if I had so many
more to write and so much more often.
Oh yeah, we did have. All of us who
were Chair “persons” had one a month.
This term as Chairman I have 4. That is 8
less that Lara has to go through,
fix my punctuation, correct my
political errors and make sure
the words that make it from my
little pea brain to this word document
actually fit into the little
box it is supposed to.
When any of us pass a
gavel we always wonder how
history will look at our tenure.
Even now it’s hard for me to
remember what happened last
week, let alone how my Chairmanship
from years ago will be remembered,
however as we look back at this year perhaps
we can find something to remember
me by.
How about the fact that our little
Chamber Newspaper now reaches over
27,000 people every month. Is that impressive
or what? That happened while I
was Chairman! That is something to remember
me by….well perhaps not. That
bOb taylOr
Chairman of the board
Just a few words
before I go . . .
was in the works long before I became
Chairman.
Look at what you are reading this in.
Isn’t this great! We now have a magazine
newsletter that comes out quarterly with
EVERY member listed. This is it….well
no; this also was planned long before I
was asked to step in.
Can you believe how attendance has
been at all of our events!! Just about everything
we have done has been sold out.
Even with Board attendance, Stan who
knows more about what has happened
with the Chamber Board than any 3 or
4 of us combined commented that he has
never seen such attendance. For the first
time in history, we had 2 meetings in a
row with only one person missing. Can
I take credit for that, no I guess I cannot.
Chair’s Corner
Bob Taylor shares some parting thoughts
about accomplishments, membership and
the Chamber as he gets ready to pass the
gavel in June
When any of us pass the gavel,
we always wonder how history will
look at our tenure . . . as we look
back at this year perhaps we can find
something to remember me by . . .
Over 25 Years
Let’s see, I was needed for exactly
what I did. I filled a quick void between
Michael Lavenant and Charles Sandlin.
I was needed to give Jennifer and staff
just a little more time to gel so that we
as a Chamber could become what we are
today. That is what I did.
Since this is my last article I really
need to say what the Chamber
has done for me. Allowing me
the opportunity to serve as
Chairman pulled me out of a
tunnel that some never come
out of. Giving me the venue
to be needed allowed me to
move forward and start working
towards serving others.
Just watching Jennifer lead
has confirmed to me what I
have always thought leadership
to be that others do not see.
Perhaps history will not remember
anything I did last time as Chairman and
there is no reason what so ever why the
books will say Bob did this or that at this
point. However I think I will be remembered
by the time I am done. Stan, be
ready to record one. Those of you who
make it to our luncheon on June 21 will
get to see one for the books. My promise
to you!
Membership Benefits
Reap the rewards of Chamber
membership...almost without lifting a finger!
How many times have you
heard other Chamber members
tell you, “You get what you put
in,” or “What events
have you attended
lately?” While attending
networking
events, participating
on committees and
purchasing paid advertising
certainly
help you grow your
business faster and more easily,
it is not necessary to do any of
these things to benefit from your
Chamber membership.
When a business joins the
Chamber they receive certain
benefits that are automatic and
instantaneous. One of these is
the member listing in our online
Business Directory which
is publicly accessible through
the Chamber website, CamarilloChamber.org,
as well as all
popular search engines.
When a potential customer
accesses a member’s online listing,
that access is recorded in
the Chamber database, resulting
in a “click.” Likewise for when
a member’s personal webpage is
accessed through the Chamber
website. Each month the Chamber
runs a “Click Report” to ensure
that members are receiving
their benefits (see chart at right).
The click report shows exactly
how many times a member’s
listing has been viewed, if
their personal website has been
accessed, how many times the
company has shown up in search
results and if they have been
emailed directly from their online
Chamber listing. The report
can then be analyzed to show
which businesses are getting
more hits and, through market
analysis, why. This information
is then used to advise members
to either beef up their listing with
more key words, a better busi-
Membership Benefits
Chamber Referral Groups
provide members valuable business leads
One of the biggest challenges of
all business people is to get client and
customer leads. Many have found that
the best leads come from one-on-one
referrals from people who know you
and trust you.
A leads group is a business referral
network that gives members the opportunity
to develop sources and contacts
that can help generate sales for their
business. The system works because
members of each group help each other
generate leads and new relationships.
A typical meeting includes all
group members giving their 30 second
elevator speech. Then on a rotating
basis, members present a 15-20 minute
“trade presentation” about their business,
to help other members learn more
about them and their company.
Every member of a group takes the
responsibility to help get leads for other
group members. The premise underly-
ing the success of these groups is that
people would rather do business with
a known entity, and that providing a
referral reduces the risk factor for the
buyer because a recommendation carries
high value
Chamber members are welcome
to visit a group twice before joining. A
guest doesn’t even have to be a Chamber
member to visit; however, to be a
leads group member, a person’s business
must join the Chamber first. The
leads groups follow a non-competing
format; each is limited to one person
per industry or profession and slots are
filled on a first come, first served basis.
Currently, there are four Chamber
Leads Groups.
Expert tips & tricks
lOuis vargas
CEO, localleads hQ
As a New
Year finally gets
going it’s time to
look seriously at
the state of affairs
of your business.
Is it on track for
record profits and
increase in sales for 2012? Are you strategically
implementing the steps of your
Business Blueprint for success? Or is it
stuck, stalled or struggling? If so, don’t
fret. DO something about it!
Preparation and strategy are the basic
foundations (Blueprints) for business success
and turning things around quickly.
Here are initial strategic implementation
actions you need to take and blueprints
you need:
1. Win the Strategic Mental Game.
Banish the negative thinking and feeling
of insecurity about not succeeding
further. Build on your passion and
purpose for starting your business.
Dig deep and remember that purpose
and passion. It’s time to get up, regroup
and move ahead with a strategic
battle plan.
2. GPS (“Greater Profits System”)
Blueprint. Figure out where you are
and where you want to go: A “GPS”
for business with revenue and profit
metrics to measure each week, each
month and each quarter. If you’re at
$160K and want increase it to $210K,
then each week you need to increase
revenue by $160 per day. Break it
Call 764-2440 • ridgedesign.com
7 Strategies to help grow your
stuck, stalled, or struggling business
down further until you know how
many new clients, new patients, or
new products need to be sold to get
there. Decrease expenses and, if necessary,
increase prices. Make sure
you have stellar service and quality
products before increasing, but AL-
WAYS go above and beyond.
3. Strategic Multi-Channel Marketing
& Positioning Blueprint. You
need to engage/market to your customers
on different mediums via
videos, online infomercials, reviews,
emails, text marketing, smart phones
(mobile marketing), social media, direct
mail, customer loyalty programs,
and local search. Position yourself as
the “expert.” Write articles, newsletters,
a book, ask questions, take surveys,
or give insights on new products
that fill a need: i.e. educate your
clients!
4. Strategic Customer Service &
Relations Blueprint System. As
humans we love to be welcomed,
wooed and “wowed.” Is your business
doing that each and every time
with its clients, walk-ins, callers or
prospects? Are you filling their needs
and wants or merely “taking orders?”
Feel their pain, be a friend and a go-to
person. Do that and you’ll have loyal
fan base.
5. Strategic Referral Marketing Blueprint
System. You need to pick up
a “shovel” and dig for gold in your
existing customer roster. Ask what
I know Camarillo Well...
ask to place them on a Preferred VIP
Customer List, and ask for referrals.
Bribe them with a discount, a gift
card, or a Starbucks gift card. 55% of
your revenue increase can be found
lying here.
6. Recurring Product & Revenue
Blueprint System. By keeping a
pulse on customers you are able to
gauge what they may buy in the future.
A high-end boutique client of
ours increased revenue by 28% within
a month after we uncovered new
products customers kept asking about
and were informed they did not carry.
Why? Figure out where that speciality
item is sold and get it for the client.
Later ask her/him who else they
know needs it or would also buy it.
That’s how to create new product revenue
streams.
7. Automated Marketing Blueprint.
Keep in contact with your client base
via technology. Experiencing a slow
day or have cancelled appointments?
Then use text marketing to send discount
announcements and book your
restaurant, shop, dental practice, etc.
back-up in a matter of hours. Create
e-mail campaigns, RSS alerts for clients.
Again, it’s about staying in front
of your clients/prospects constantly
that is a key to revenue increase.
New Committee Chair named
Ambassador of the Quarter
Q: How long have you been a
Chamber member and Ambassador?
A: I’ve been a Chamber member
for over 3 years and an Ambassador for
almost a year. I became Chair of the
Ambassadors in January.
Q: What does being a Chamber
Ambassador mean to you?
A: Being an Ambassador is
about building relationships – relationships
among chamber members as well
as with the chamber. As an ambassador,
I enjoy connecting with new members
and facilitating connections between
others. I also believe that the Ambassa-
dors can speak to the benefits of chamber
membership in a compelling, firsthand
way.
Q: What is your favorite memory
or story of your time as an Ambassador?
A: I’m just enjoying the camaraderie
with other Ambassadors and getting
to know them better at events and at
our monthly meeting. It’s like anything
else – you get out what you put in.
Q: What is your personal philosophy,
either in business or life in
A: My personal and professional
Committees
The Camarillo Chamber of Commerce Chamber Ambassadors are key to the successful
workings of the Chamber. They act as an extension of the Chamber’s member services department,
reaching out to new members and existing members, making them feel welcome,
answering questions and acting as liaisons between the Chamber staff and members.
Gloria Miele (Optimal Development Coaching) was recently named Ambassador of the
Quarter for the third quarter of the 2011/2012 fiscal year. In order to receive this honor, a
Chamber Ambassador must have completed certain tasks like delivering plaques to new members, attending events such
as ribbon cuttings, breakfasts and luncheons, as well as recruiting new member leads for the Membership Director.
Miele, who is the new Chair for the Ambassadors, is a very well rounded individual. She likes to keep busy and
is one of those people who is always participating and helping out. In her “real life” Miele works as a business coach,
mother and avid volunteer, yet she still managed to fit all her ambassadorial duties into her busy schedule, going above
and beyond to help the Chamber reach its mission.
philosophy is to play to your strengths
as much as possible. Focus on what you
do well and what you love to do, and
you’ve got the best chance to be at the
top of your game.
Q: What do you like to do in your
spare time?
A: I try to strike a balance between
family, service and self-care. Our
family really enjoys live music and theatre.
My husband plays in a band and
our daughter is involved in choir and
theatre, so there’s always some kind of
performance, rehearsal or practice. I
like to travel and often have the opportunity
to go to different places on business
and extend my stay to explore the area
and visit friends or family who might
be nearby. I’m also a Girl Scout leader,
which is a lot of fun and really gratifying.
I serve on a number of boards and
committees for other non-profits that
support education, the arts, and the empowerment
of girls and women. I also
love Zumba, yoga, and time at the spa.
Q: Do you have any parting
words of wisdom you would like to impart
to our readership?
A: It’s always important to have
a positive attitude. Studies show that
positivity is related to creative thinking,
greater productivity, longevity, better
health and a host of other positive
outcomes. Plus it feels good and has
a positive impact on those around you.
So smile and enjoy!
business advocacy
Last month the California Supreme
Court issued its long awaited decision in
the case Brinker v. Superior Court (Hohnbaum),
S166350.
The Brinker decision involved a
class action against a number of restaurants
operated by Brinker Restaurant Corporation,
alleging that Brinker failed to
provide meal and rest periods required by
California law and required employees to
work off the clock, and seeking to certify
a class of approximately 60,000 restaurant
employees.
The Brinker case centered on the
proper interpretation of California’s meal
and rest period laws and regulations and
how those interpretations inform and affect
class certification.
The central, and long anticipated,
holding in this case is that employers need
not ensure employees take 30 minute off
the clock meal periods, but do need to
provide meal periods, one for a shift longer
than 5 hours, and a second for a shift
over 10 hours. Also, employers need only
“authorize and permit” 10 minute on the
clock rest periods, for every 4 hour period
of work or major fraction thereof.
The Brinker decision outlined detailed
requirements under the law, and the Court
specifically ruled as follows:
As to 30 minute off the clock
meal periods:
• A company’s obligation is to provide
(give the opportunity for) employees to
take meal periods, but not to “police”
employees to ensure they took the meal
period.
• The meal period must be at least 30
minutes, and the employee must be relieved
of all duty and allowed to leave
the work premises (except in limited
circumstances.)
• Employees must be allowed to take one
meal period if they work shifts over five
MiChaEl lavEnant
Landegger Baron Lavenant Ingber
Brinker decision by
California Supreme
Court clarifies employer
meal & rest period obligations
hours, and that meal period must start
no later than the end of the fifth hour
of work.
• Employees must be allowed to take a
second meal period if they work shifts
over ten hours, and that meal period
must start no later than the end of the
tenth hour of work. The second meal
period does not need to be provided
within 5 hours of the first meal period.
It is important to note that even
though an employer does not need to ensure
employees take meal periods, if the
employer actually knows that employees
are not taking 30 minute meal periods in
which employees are relieved of all duties
and free to do what they want, it will
be held liable. Also, if an employer has a
policy that contradicts these regulations, it
will be held liable, because the employee
will not be given the opportunity to waive
anything.
As to 10 minute rest
periods:
• The employer must authorize and permit
10 minute on the clock rest periods
for its employees.
• Again, the employer need not ensure
they are taken by the employees.
• One 10 minute rest period must be provided
for every four hours of work “or
major fraction thereof.”
• To calculate the number of rest periods
required, an employer should divide
the total number of hours of the shift by
four, then round up if the fractional part
is over 2 hours. For example, an employee
who works 6 hours or more is
entitled to two rest periods, not just one.
• The rest period must be provided in the
middle of the four hour period “insofar
as practicable.”
• The first rest period need not necessarily
be provided before the first meal
period, if an employer’s specific circumstances
prevent it from doing so.
However, an employee is entitled to no
rest periods for shifts of 3 ½ hours or
less.
The court in Brinker relied heavily on
the existence of company-wide policies to
decide whether the case should be certified
as a class action. In fact, in Brinker
the Court ruled that the portion of the case
dealing with rest periods could proceed as
a class action, because of Brinker’s rest
period policies. (The Court did not decide
whether those policies violated the law.)
Courts will first look to a company’s
meal and rest period policies (or lack of
such policies) to help decide whether a
lawsuit against the employer can be treated
as a class action, because such policies
show that the issue can be resolved for
the entire class. This is just one factor, the
company must also ensure that its practices
do not impede employees from taking
breaks. It will be the employer’s burden
to establish that the opportunity to take
breaks was provided to employees.
Having specific policies that fully
comply with the law, and these new Supreme
Court rulings, is crucial for the
defense of any class action that might be
filed against your company. Companies
who do not have such policies should
work to implement policies as soon as
possible and inform employees directly
of these policies. Employers should also
seek legal counsel to ensure their policies
comply with these detailed requirements.
Supreme Court issues decision on meal/rest
periods in Brinker Case
The California Supreme Court has
released its long-awaited decision in a
case involving employers’ obligations
relating to meal and rest breaks.
The most critical part of the unanimous
ruling in Brinker Restaurant Corp.
v. Superior Court is that employers do
not have to ensure that employees take
their meal breaks, but must merely make
them available. The court also provided
flexibility to employers with regard to
the timing of meal and rest breaks.
Erika Frank, California Chamber
of Commerce general counsel and vice
president of legal affairs, commented
on the ruling: “Employers have finally
received some much-needed clarity in a
common-sense decision from the California
Supreme Court that will provide
certainty and flexibility to employers
and employees, allowing them to effectively
manage their workload and serve
their customers and clients.
“One of the most significant benefits
of this ruling is that it will reduce
employers’ exposure to costly and frivolous
litigation.”
Court Decision
According to the court: “To summarize:
An employer’s duty with respect
to meal breaks under both section
512, subdivision (a) and Wage Order
No. 5 is an obligation to provide a meal
period to its employees.
“The employer satisfies this obligation
if it relieves its employees of
all duty, relinquishes control over their
activities and permits them a reasonable
opportunity to take an uninterrupted
30-minute break, and does not impede
or discourage them from doing so.
“What will suffice may vary from
industry to industry, and we cannot in
the context of this class certification
proceeding delineate the full range of
approaches that in each instance might
be sufficient to satisfy the law.”
The CalChamber submitted a
friend-of-the-court brief in the case.
Top ten things employers do to get sued
CalChamber highlights top mistakes that cause employment lawsuits
There is no question that California
has some of the most stringent
and complex labor laws in the nation.
The California Chamber of Commerce
white paper, “The Top 10 Things
Employers Do to Get Sued," details
some of the mistakes that could lead
to employment lawsuits.
CalChamber knows that one of
the toughest tasks for an HR manager
or business owner is managing risk
to prevent lawsuits. Employers may
unintentionally violate employment
laws and never realize the risk they
create for the company. Trying to provide
some flexibility for an employee,
saving money for the company, or
just being nice are all ways that an act
of kindness can become a business
liability.
Although this list does not apply
to all employers (regulations and collective
bargaining agreements may
override these general rules), these 10
HR examples can help employers better
manage their risk:.
1. Classify all employees as exempt,
whether they are or not.
2. Be nice to employees — let them
work through lunch so they can
take off early.
3. Make everyone an "independent
contractor" because having employees
is too much trouble.
4. Don't bother providing training
about harassment and
discrimination to managers and
supervisors. They won't need the
information.
5. Let employees decide which
hours and how many they want
to work each day.
6. Terminate any employee who
takes a leave of absence, whatever
the reason. It is too much
trouble to administer leaves of
absence, and who knows if the
employee will return.
7. Don't give employees their final
check if they fail to return company
property.
8. Provide loans to employees and
deduct the money from their
paycheck each pay period.
9. Use non-compete agreements to
protect confidential information
such as business secrets, customer
lists and pricing information
and prevent employees from
working for the competition.
10. Implement a "use it or lose it"
vacation policy and avoid paying
out all the money at termination.
The Camarillo Chamber of Commerce
Business Advocacy Committee has
reviewed and taken positions on the two
ballot initiatives that will be on the June
5th ballot.
The Chamber supports Proposition
28 – Limits on Legislators’ Term in In Office.
This initiative constitutional amendment
will alter the term limits created
when voters approved Proposition 140 in
1990. Proposition 28 will reduce the total
By Brendan Hoffman
Chamber Alliance
The 2012 Legislative session is underway
in Sacramento, but the big public
policy initiatives being proposed are likely
to be decided by voters.
As lawmakers continue to either cut
funding for cities or borrow against public
education resources, some local governments
are considering asking voters to
tax themselves to make up for lost state
revenues. For instance, Santa Barbara
Unified School District is asking its voters
on June 5 to pass two $56 parcel taxes,
and other school districts are expected to
follow suit.
Recently, the Chamber Alliance
helped to defeat a proposal by Santa Bar-
Chamber takes business friendly
positions on June ballot measures
lature from 14 years to 12 years. It allows
a person to serve a total of 12 years in the
Assembly or the Senate, or a combination
of both. Only legislators first elected after
the proposition passes will be affected
by the change. The Chamber views this
measure as a much needed improvement
to the current term limits law, and feels it
will allow the legislators to be more effective
by serving a longer time in one office.
The Chamber opposes Proposition
29 – Imposes Additional Tax on Cigarettes
for Cancer Research. Prop 29 imposes
an additional $1 per pack tax on cigarettes
and the equivalent tax increase on
other tobacco products to fund research
for cancer and tobacco-related diseases.
bara County Supervisors to place a 10%
oil severance tax on the Nov. 6 ballot. The
Alliance cautioned supervisors that our
member chambers had consistently opposed
similar legislation applying to all
counties in California, and we were not
about to look the other way if one county
were to have such a tax that neighboring
counties would not have. Meanwhile,
signature gatherers are trying to qualify a
statewide oil severance tax.
Right now, there are three significant
tax hikes being proposed for California’s
general election on Nov. 6, all of which
seek to increase funding for schools after
several years of dramatic budget cuts by
legislators. Each of these proposals would
either raise the state’s sales tax or income
tax to help balance the budget over the
There is nothing in the measure to assure
the revenue raised will be spent in California.
While the Chamber is in favor of
healthy living and measures to reduce the
use of tobacco, we believe this measure
created a new program and added layer of
bureaucracy when the State is cutting other
existing essential programs. The Legislative
Analyst’s Office concluded that the
revenue stream to fund these new cancer
research programs would be declining
and the Chamber Board was concerned
that it would once again put existing programs
at risk to keep these new programs
funded with general funds as the tax collected
diminishes.
However, the backers of these initiatives
are not on the same page and polling
continues to suggest that voters are more
likely to reject all three instead of pick
just one. Efforts continue to pressure the
backers to get behind a single tax increase
initiative.
An interesting measure that did recently
qualify for the Nov. 6 ballot is a referendum
on the State Senate boundaries
recently drawn up by the independent Citizens
was established by Prop. 14 in 2008.
President Obama’s 2013 budget
proposes cutting funding for the U.S.
Department of Defense. Part of these
cuts is Defense Secretary Leon Panetta’s
plan to ask Congress to approve two
rounds of military base closures, one as
early as next year and one in 2015.
Military bases in Ventura County
provide a huge economic impact to our
local community. These bases employ
nearly 19,000 people who live on or
around the bases. These are people who
spend their hard-earned money at local
businesses and restaurants and give
back to their community daily.
At a time when the world is unstable
with Iran, North Korea, and the
Middle East, our military bases are in-
By George Runner
New legislation by Senator Tom
Harman would direct California’s three
tax agencies to work toward the goal
of consolidating tax self-services into a
single taxpayer-friendly website.
In these difficult economic times,
it’s more important than ever for government
to eliminate the bureaucratic
red-tape that entangles businesses.
Many California businesses have to file
and pay taxes to three separate agencies,
and taxpayers are often confused
as to which agency is responsible for a
particular tax: BOE, EDD or FTB.
SB 1326 would streamline this process.
Under the bill’s provisions, the
Local military bases provide
positive impact for California
credibly important to our national defense.
Simply put, the positive effect
of our military bases is invaluable and
I plan to fight to make sure these bases
are kept open.
I recently introduced Senate Joint
Resolution 19, which encourages the
California Congressional delegation to
help preserve these bases that provide
economic support to our local community,
as well as national security for our
nation.
Congress has the authority to approve
the base closures, so we need to
send a clear message to our representatives
in Washington, D.C. not to go forward
with the deep defense cuts and let
them know just how important California
military bases are.
I have also asked Governor Jerry
Brown to authorize the formation of
an unpaid, volunteer task force for the
strategic purpose of preserving California’s
military bases. Similar task forces
website www.taxes.ca.gov would be
enhanced to allow taxpayers to file tax
returns, claim refunds, and request for
relief of interest or penalties with one
login. Taxpayers would no longer need
to navigate through three separate tax
agencies to access forms and information,
saving taxpayers time and increasing
voluntary compliance.
As Senator Harman pointed out,
“This is something that should have
been done a long time ago. Businesses
should be spending their resources to
create jobs not to hire teams of attorneys
and accountants to manage filling
out California’s patchwork of tax forms.
With technological advances, it is about
time California’s tax system moves out
Opinion / Editorials
were created in the past by Governor
Schwarzenegger in 2004 and Governor
Wilson in 1993, but have since expired.
According to a 2006 Economic Impact
Study performed by the Workforce
Investment Board of Ventura County,
our military bases produced an estimated
$1.2 billion in goods and services,
over $900 million of which was retained
locally. This is money that went directly
back into our community, helping boost
local small businesses.
Additionally, approximately $166
million in taxes were attributed to Naval
Base Ventura County in 2006, almost
$70 million of which went to state
and local governments.
Clearly, these bases are vital to local
businesses, my constituents, and
California as a whole. Shutting them
down would be hugely detrimental, so
I will to work to make sure our military
bases continue to be positive resources
for the people of California.
Bill would create one-stop tax portal for CA businesses
of the dark ages.”
Just as online banking has provided
individuals and businesses with
easier access to banking account information
and services, a single website
will make voluntary compliance with
tax programs simpler. Senate Bill 1326
received the unanimous support of the
Senate Governance and Finance Committee
and now moves to the Senate
Appropriations Committee for further
consideration.
Runner represents more than nine million
Californians as a member of the State Board
of Equalization. For more information, visit
