<strong>Chamber</strong> brings together members and legislators<br />
April 19 marked the first <strong>of</strong> the <strong>Camarillo</strong> <strong>Chamber</strong>’s Legislator<br />
Meet & Greet series, with an intimate gathering to welcome Assemblyman<br />
Jeff Gorell back from his one year tour in Afghanistan<br />
with the US Navy.<br />
On hand was <strong>Camarillo</strong> City Councilmember Don Waunch to<br />
present Gorell with a certificate <strong>of</strong> appreciation from the City for<br />
his service, as well as numerous business and governement leaders<br />
eager to greet Gorell as he begins his campaign for reelection to the<br />
California Assembly.<br />
The coctail reception was held at Spanish Hills Country Club<br />
and sponsored by Southern California Edison (SCE).<br />

Since 1940, the <strong>Camarillo</strong> <strong>Chamber</strong><br />
<strong>of</strong> <strong>Commerce</strong> has been working “To<br />
promote and enhance a positive business<br />
and community environment.” That is<br />
the <strong>Chamber</strong>’s mission, which it accomplishes<br />
through a variety <strong>of</strong> programs and<br />

It’s hard to believe that this is my<br />
last Chairman <strong>of</strong> the <strong>Chamber</strong> article.<br />
Just a few short years ago when I was<br />
Chairman it seems as if I had so many<br />
more to write and so much more <strong>of</strong>ten.<br />
Oh yeah, we did have. All <strong>of</strong> us who<br />
were Chair “persons” had one a month.<br />
This term as Chairman I have 4. That is 8<br />
less that Lara has to go through,<br />
fix my punctuation, correct my<br />
political errors and make sure<br />
the words that make it from my<br />
little pea brain to this word document<br />
actually fit into the little<br />
box it is supposed to.<br />
When any <strong>of</strong> us pass a<br />
gavel we always wonder how<br />
history will look at our tenure.<br />
Even now it’s hard for me to<br />
remember what happened last<br />
week, let alone how my Chairmanship<br />
from years ago will be remembered,<br />
however as we look back at this year perhaps<br />
we can find something to remember<br />
me by.<br />
How about the fact that our little<br />
<strong>Chamber</strong> Newspaper now reaches over<br />
27,000 people every month. Is that impressive<br />
or what? That happened while I<br />
was Chairman! That is something to remember<br />
me by….well perhaps not. That<br />

Isn’t this great! We now have a magazine<br />
newsletter that comes out quarterly with<br />
EVERY member listed. This is it….well<br />
no; this also was planned long before I<br />
was asked to step in.<br />
Can you believe how attendance has<br />
been at all <strong>of</strong> our events!! Just about everything<br />
we have done has been sold out.<br />
Even with Board attendance, Stan who<br />
knows more about what has happened<br />
with the <strong>Chamber</strong> Board than any 3 or<br />
4 <strong>of</strong> us combined commented that he has<br />
never seen such attendance. For the first<br />
time in history, we had 2 meetings in a<br />
row with only one person missing. Can<br />
I take credit for that, no I guess I cannot.<br />

When any <strong>of</strong> us pass the gavel,<br />
we always wonder how history will<br />
look at our tenure . . . as we look<br />
back at this year perhaps we can find<br />
something to remember me by . . .<br />
Over 25 Years<br />
Let’s see, I was needed for exactly<br />
what I did. I filled a quick void between<br />
Michael Lavenant and Charles Sandlin.<br />
I was needed to give Jennifer and staff<br />
just a little more time to gel so that we<br />
as a <strong>Chamber</strong> could become what we are<br />
today. That is what I did.<br />
Since this is my last article I really<br />
need to say what the <strong>Chamber</strong><br />
has done for me. Allowing me<br />
the opportunity to serve as<br />
Chairman pulled me out <strong>of</strong> a<br />
tunnel that some never come<br />
out <strong>of</strong>. Giving me the venue<br />
to be needed allowed me to<br />
move forward and start working<br />
towards serving others.<br />
Just watching Jennifer lead<br />
has confirmed to me what I<br />
have always thought leadership<br />
to be that others do not see.<br />
Perhaps history will not remember<br />
anything I did last time as Chairman and<br />
there is no reason what so ever why the<br />
books will say Bob did this or that at this<br />
point. However I think I will be remembered<br />
by the time I am done. Stan, be<br />
ready to record one. Those <strong>of</strong> you who<br />
make it to our luncheon on June 21 will<br />
get to see one for the books. My promise<br />

<strong>Chamber</strong> Referral Groups<br />
provide members valuable business leads<br />
One <strong>of</strong> the biggest challenges <strong>of</strong><br />
all business people is to get client and<br />
customer leads. Many have found that<br />
the best leads come from one-on-one<br />
referrals from people who know you<br />
and trust you.<br />
A leads group is a business referral<br />
network that gives members the opportunity<br />
to develop sources and contacts<br />

A typical meeting includes all<br />

format; each is limited to one person<br />

The <strong>Chamber</strong> CI Connection Committee<br />

Ambassador <strong>of</strong> the Quarter<br />
Q: How long have you been a<br />
<strong>Chamber</strong> member and Ambassador?<br />
A: I’ve been a <strong>Chamber</strong> member<br />
for over 3 years and an Ambassador for<br />
almost a year. I became Chair <strong>of</strong> the<br />
Ambassadors in January.<br />
Q: What does being a <strong>Chamber</strong><br />
Ambassador mean to you?<br />
A: Being an Ambassador is<br />
about building relationships – relationships<br />
among chamber members as well<br />
as with the chamber. As an ambassador,<br />
I enjoy connecting with new members<br />
and facilitating connections between<br />
others. I also believe that the Ambassa-<br />
dors can speak to the benefits <strong>of</strong> chamber<br />
membership in a compelling, firsthand<br />
way.<br />
Q: What is your favorite memory<br />
or story <strong>of</strong> your time as an Ambassador?<br />
A: I’m just enjoying the camaraderie<br />
with other Ambassadors and getting<br />
to know them better at events and at<br />
our monthly meeting. It’s like anything<br />
else – you get out what you put in.<br />
Q: What is your personal philosophy,<br />
either in business or life in<br />
general?<br />
A: My personal and pr<strong>of</strong>essional<br />

The <strong>Camarillo</strong> <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong> <strong>Chamber</strong> Ambassadors are key to the successful<br />
workings <strong>of</strong> the <strong>Chamber</strong>. They act as an extension <strong>of</strong> the <strong>Chamber</strong>’s member services department,<br />
reaching out to new members and existing members, making them feel welcome,<br />
answering questions and acting as liaisons between the <strong>Chamber</strong> staff and members.<br />
Gloria Miele (Optimal Development Coaching) was recently named Ambassador <strong>of</strong> the<br />
Quarter for the third quarter <strong>of</strong> the 2011/<strong>2012</strong> fiscal year. In order to receive this honor, a<br />
<strong>Chamber</strong> Ambassador must have completed certain tasks like delivering plaques to new members, attending events such<br />
as ribbon cuttings, breakfasts and luncheons, as well as recruiting new member leads for the Membership Director.<br />
Miele, who is the new Chair for the Ambassadors, is a very well rounded individual. She likes to keep busy and<br />
is one <strong>of</strong> those people who is always participating and helping out. In her “real life” Miele works as a business coach,<br />
mother and avid volunteer, yet she still managed to fit all her ambassadorial duties into her busy schedule, going above<br />
and beyond to help the <strong>Chamber</strong> reach its mission.<br />
philosophy is to play to your strengths<br />
as much as possible. Focus on what you<br />
do well and what you love to do, and<br />
you’ve got the best chance to be at the<br />
top <strong>of</strong> your game.<br />
Q: What do you like to do in your<br />
spare time?<br />
A: I try to strike a balance between<br />
family, service and self-care. Our<br />
family really enjoys live music and theatre.<br />
My husband plays in a band and<br />
our daughter is involved in choir and<br />
theatre, so there’s always some kind <strong>of</strong><br />
performance, rehearsal or practice. I<br />
like to travel and <strong>of</strong>ten have the opportunity<br />
to go to different places on business<br />
and extend my stay to explore the area<br />
and visit friends or family who might<br />
be nearby. I’m also a Girl Scout leader,<br />
which is a lot <strong>of</strong> fun and really gratifying.<br />
I serve on a number <strong>of</strong> boards and<br />
committees for other non-pr<strong>of</strong>its that<br />
support education, the arts, and the empowerment<br />
<strong>of</strong> girls and women. I also<br />

Economic development<br />
The Economic Development Committee<br />
(EDC) focuses on “helping to<br />
create a strong local economy”. The<br />
committee connects business leaders,<br />
community leaders and government<br />
leaders on an ongoing basis. The EDC<br />
hears and discusses issues and opportunities<br />
related to <strong>Camarillo</strong>’s economic<br />
health. There are presentations on “hot<br />
topics” such as future development<br />
projects or activities at CSUCI. Economic<br />
Development <strong>of</strong>ficials from the<br />
area are invited to meet with the group.<br />
It is a good forum to better understand<br />
city, county and state economic development<br />
efforts and to engage civic leaders<br />
on economic issues.<br />
Regular attendees include the City<br />
Manager and staff, business representative<br />
in the area <strong>of</strong> real estate, retail, finance,<br />
education, banking, health care,<br />
etc. Many regular attendees are active<br />
on various other <strong>Chamber</strong> Boards.<br />

Last year the hotels in the cities <strong>of</strong><br />
<strong>Camarillo</strong>, Ventura, and Oxnard began<br />
collecting an assessment on room rates<br />
(TBID) that now go into a collective<br />
pool <strong>of</strong> funding for local tourism marketing.<br />
The Ventura County Lodging Association<br />
was formed and a board oversees<br />
this Association. The <strong>Camarillo</strong> <strong>Chamber</strong><br />
<strong>of</strong> <strong>Commerce</strong> CEO Jennifer Wells is<br />
a board member for what is known as the<br />
VCLA. Though the agreement to form<br />
the TBID, each city will individually<br />
receive 20% <strong>of</strong> the funds that city collects<br />
to be used on local tourism marketing.<br />
Several months ago the <strong>Chamber</strong><br />
formed the <strong>Camarillo</strong> Tourism Commit-<br />
tee that now oversees tourism marketing<br />
for <strong>Camarillo</strong>.<br />
This is exciting for <strong>Camarillo</strong>! The<br />
other two cities have established Visitors<br />
and Convention Bureaus that have been<br />
promoting their cities with tourism marketing.<br />
While the <strong>Chamber</strong> is housed in<br />
the Visitors Center, it has had no funding<br />
to do any type <strong>of</strong> marketing for <strong>Camarillo</strong><br />
as a tourism destination. Well,<br />
now we are able to promote <strong>Camarillo</strong> as<br />
the wonderful place we all know it to be!<br />

Last month the California Supreme<br />
Court issued its long awaited decision in<br />
the case Brinker v. Superior Court (Hohnbaum),<br />
S166350.<br />
The Brinker decision involved a<br />
class action against a number <strong>of</strong> restaurants<br />
operated by Brinker Restaurant Corporation,<br />
alleging that Brinker failed to<br />
provide meal and rest periods required by<br />
California law and required employees to<br />
work <strong>of</strong>f the clock, and seeking to certify<br />
a class <strong>of</strong> approximately 60,000 restaurant<br />
employees.<br />
The Brinker case centered on the<br />
proper interpretation <strong>of</strong> California’s meal<br />
and rest period laws and regulations and<br />
how those interpretations inform and affect<br />
class certification.<br />
The central, and long anticipated,<br />
holding in this case is that employers need<br />
not ensure employees take 30 minute <strong>of</strong>f<br />
the clock meal periods, but do need to<br />
provide meal periods, one for a shift longer<br />
than 5 hours, and a second for a shift<br />
over 10 hours. Also, employers need only<br />
“authorize and permit” 10 minute on the<br />
clock rest periods, for every 4 hour period<br />
<strong>of</strong> work or major fraction there<strong>of</strong>.<br />
The Brinker decision outlined detailed<br />
requirements under the law, and the Court<br />
specifically ruled as follows:<br />
As to 30 minute <strong>of</strong>f the clock<br />
meal periods:<br />
• A company’s obligation is to provide<br />
(give the opportunity for) employees to<br />
take meal periods, but not to “police”<br />
employees to ensure they took the meal<br />
period.<br />
• The meal period must be at least 30<br />
minutes, and the employee must be relieved<br />
<strong>of</strong> all duty and allowed to leave<br />
the work premises (except in limited<br />
circumstances.)<br />
• Employees must be allowed to take one<br />
meal period if they work shifts over five<br />

hours, and that meal period must start<br />
no later than the end <strong>of</strong> the fifth hour<br />
<strong>of</strong> work.<br />
• Employees must be allowed to take a<br />
second meal period if they work shifts<br />
over ten hours, and that meal period<br />
must start no later than the end <strong>of</strong> the<br />
tenth hour <strong>of</strong> work. The second meal<br />
period does not need to be provided<br />
within 5 hours <strong>of</strong> the first meal period.<br />
It is important to note that even<br />
though an employer does not need to ensure<br />
employees take meal periods, if the<br />
employer actually knows that employees<br />
are not taking 30 minute meal periods in<br />
which employees are relieved <strong>of</strong> all duties<br />
and free to do what they want, it will<br />
be held liable. Also, if an employer has a<br />
policy that contradicts these regulations, it<br />
will be held liable, because the employee<br />
will not be given the opportunity to waive<br />
anything.<br />
As to 10 minute rest<br />
periods:<br />
• The employer must authorize and permit<br />
10 minute on the clock rest periods<br />
for its employees.<br />
• Again, the employer need not ensure<br />
they are taken by the employees.<br />
• One 10 minute rest period must be provided<br />
for every four hours <strong>of</strong> work “or<br />
major fraction there<strong>of</strong>.”<br />
• To calculate the number <strong>of</strong> rest periods<br />
required, an employer should divide<br />
the total number <strong>of</strong> hours <strong>of</strong> the shift by<br />
four, then round up if the fractional part<br />
is over 2 hours. For example, an employee<br />
who works 6 hours or more is<br />
entitled to two rest periods, not just one.<br />
• The rest period must be provided in the<br />
middle <strong>of</strong> the four hour period “ins<strong>of</strong>ar<br />
as practicable.”<br />
• The first rest period need not necessarily<br />
be provided before the first meal<br />
period, if an employer’s specific circumstances<br />
prevent it from doing so.<br />
However, an employee is entitled to no<br />
rest periods for shifts <strong>of</strong> 3 ½ hours or<br />
less.<br />
The court in Brinker relied heavily on<br />
the existence <strong>of</strong> company-wide policies to<br />
decide whether the case should be certified<br />
as a class action. In fact, in Brinker<br />
the Court ruled that the portion <strong>of</strong> the case<br />
dealing with rest periods could proceed as<br />
a class action, because <strong>of</strong> Brinker’s rest<br />
period policies. (The Court did not decide<br />
whether those policies violated the law.)<br />
Courts will first look to a company’s<br />
meal and rest period policies (or lack <strong>of</strong><br />
such policies) to help decide whether a<br />
lawsuit against the employer can be treated<br />
as a class action, because such policies<br />
show that the issue can be resolved for<br />
the entire class. This is just one factor, the<br />
company must also ensure that its practices<br />
do not impede employees from taking<br />
breaks. It will be the employer’s burden<br />
to establish that the opportunity to take<br />
breaks was provided to employees.<br />
Having specific policies that fully<br />
comply with the law, and these new Supreme<br />
Court rulings, is crucial for the<br />
defense <strong>of</strong> any class action that might be<br />
filed against your company. Companies<br />
who do not have such policies should<br />
work to implement policies as soon as<br />
possible and inform employees directly<br />
<strong>of</strong> these policies. Employers should also<br />
seek legal counsel to ensure their policies<br />
comply with these detailed requirements.<br />

Supreme Court issues decision on meal/rest<br />
periods in Brinker Case<br />
The California Supreme Court has<br />
released its long-awaited decision in a<br />
case involving employers’ obligations<br />
relating to meal and rest breaks.<br />
The most critical part <strong>of</strong> the unanimous<br />
ruling in Brinker Restaurant Corp.<br />
v. Superior Court is that employers do<br />
not have to ensure that employees take<br />
their meal breaks, but must merely make<br />
them available. The court also provided<br />
flexibility to employers with regard to<br />
the timing <strong>of</strong> meal and rest breaks.<br />

<strong>of</strong> <strong>Commerce</strong> general counsel and vice<br />
president <strong>of</strong> legal affairs, commented<br />
on the ruling: “Employers have finally<br />
received some much-needed clarity in a<br />
common-sense decision from the California<br />
Supreme Court that will provide<br />
certainty and flexibility to employers<br />
and employees, allowing them to effectively<br />
manage their workload and serve<br />
their customers and clients.<br />
“One <strong>of</strong> the most significant benefits<br />
<strong>of</strong> this ruling is that it will reduce<br />
employers’ exposure to costly and frivolous<br />
litigation.”<br />
Court Decision<br />
According to the court: “To summarize:<br />
An employer’s duty with respect<br />
to meal breaks under both section<br />
512, subdivision (a) and Wage Order<br />
No. 5 is an obligation to provide a meal<br />
period to its employees.<br />
“The employer satisfies this obligation<br />
if it relieves its employees <strong>of</strong><br />
all duty, relinquishes control over their<br />
activities and permits them a reasonable<br />
opportunity to take an uninterrupted<br />
30-minute break, and does not impede<br />
or discourage them from doing so.<br />
“What will suffice may vary from<br />
industry to industry, and we cannot in<br />
the context <strong>of</strong> this class certification<br />
proceeding delineate the full range <strong>of</strong><br />
approaches that in each instance might<br />
be sufficient to satisfy the law.”<br />
The Cal<strong>Chamber</strong> submitted a<br />
friend-<strong>of</strong>-the-court brief in the case.<br />

There is no question that California<br />
has some <strong>of</strong> the most stringent<br />
and complex labor laws in the nation.<br />
The California <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong><br />
white paper, “The Top 10 Things<br />
Employers Do to Get Sued," details<br />
some <strong>of</strong> the mistakes that could lead<br />
to employment lawsuits.<br />
Cal<strong>Chamber</strong> knows that one <strong>of</strong><br />
the toughest tasks for an HR manager<br />
or business owner is managing risk<br />
to prevent lawsuits. Employers may<br />
unintentionally violate employment<br />
laws and never realize the risk they<br />
create for the company. Trying to provide<br />
some flexibility for an employee,<br />
saving money for the company, or<br />
just being nice are all ways that an act<br />
<strong>of</strong> kindness can become a business<br />
liability.<br />
Although this list does not apply<br />
to all employers (regulations and collective<br />
bargaining agreements may<br />
override these general rules), these 10<br />
HR examples can help employers better<br />
manage their risk:.<br />
1. Classify all employees as exempt,<br />
whether they are or not.<br />
2. Be nice to employees — let them<br />
work through lunch so they can<br />
take <strong>of</strong>f early.<br />
3. Make everyone an "independent<br />
contractor" because having employees<br />
is too much trouble.<br />
4. Don't bother providing training<br />
about harassment and<br />
discrimination to managers and<br />
supervisors. They won't need the<br />
information.<br />
5. Let employees decide which<br />
hours and how many they want<br />
to work each day.<br />
6. Terminate any employee who<br />
takes a leave <strong>of</strong> absence, whatever<br />
the reason. It is too much<br />
trouble to administer leaves <strong>of</strong><br />
absence, and who knows if the<br />
employee will return.<br />
7. Don't give employees their final<br />
check if they fail to return company<br />
property.<br />
8. Provide loans to employees and<br />
deduct the money from their<br />
paycheck each pay period.<br />
9. Use non-compete agreements to<br />
protect confidential information<br />
such as business secrets, customer<br />
lists and pricing information<br />
and prevent employees from<br />
working for the competition.<br />
10. Implement a "use it or lose it"<br />
vacation policy and avoid paying<br />
out all the money at termination.<br />

reviewed and taken positions on the two<br />
ballot initiatives that will be on the June<br />
5th ballot.<br />
The <strong>Chamber</strong> supports Proposition<br />
28 – Limits on Legislators’ Term in In Office.<br />
This initiative constitutional amendment<br />
will alter the term limits created<br />
when voters approved Proposition 140 in<br />
1990. Proposition 28 will reduce the total<br />
time a person may serve in the state Legis-<br />

The <strong>2012</strong> Legislative session is underway<br />
in Sacramento, but the big public<br />
policy initiatives being proposed are likely<br />
to be decided by voters.<br />
As lawmakers continue to either cut<br />
funding for cities or borrow against public<br />
education resources, some local governments<br />
are considering asking voters to<br />
tax themselves to make up for lost state<br />
revenues. For instance, Santa Barbara<br />
Unified School District is asking its voters<br />
on June 5 to pass two $56 parcel taxes,<br />
and other school districts are expected to<br />
follow suit.<br />
Recently, the <strong>Chamber</strong> Alliance<br />
helped to defeat a proposal by Santa Bar-<br />
<strong>Chamber</strong> takes business friendly<br />
positions on June ballot measures<br />
lature from 14 years to 12 years. It allows<br />
a person to serve a total <strong>of</strong> 12 years in the<br />
Assembly or the Senate, or a combination<br />
<strong>of</strong> both. Only legislators first elected after<br />
the proposition passes will be affected<br />
by the change. The <strong>Chamber</strong> views this<br />
measure as a much needed improvement<br />
to the current term limits law, and feels it<br />
will allow the legislators to be more effective<br />
by serving a longer time in one <strong>of</strong>fice.<br />
The <strong>Chamber</strong> opposes Proposition<br />
29 – Imposes Additional Tax on Cigarettes<br />
for Cancer Research. Prop 29 imposes<br />
an additional $1 per pack tax on cigarettes<br />
and the equivalent tax increase on<br />
other tobacco products to fund research<br />
for cancer and tobacco-related diseases.<br />
bara County Supervisors to place a 10%<br />
oil severance tax on the Nov. 6 ballot. The<br />
Alliance cautioned supervisors that our<br />
member chambers had consistently opposed<br />
similar legislation applying to all<br />
counties in California, and we were not<br />
about to look the other way if one county<br />
were to have such a tax that neighboring<br />
counties would not have. Meanwhile,<br />
signature gatherers are trying to qualify a<br />
statewide oil severance tax.<br />
Right now, there are three significant<br />
tax hikes being proposed for California’s<br />
general election on Nov. 6, all <strong>of</strong> which<br />
seek to increase funding for schools after<br />
several years <strong>of</strong> dramatic budget cuts by<br />
legislators. Each <strong>of</strong> these proposals would<br />
either raise the state’s sales tax or income<br />
tax to help balance the budget over the<br />
There is nothing in the measure to assure<br />
the revenue raised will be spent in California.<br />
While the <strong>Chamber</strong> is in favor <strong>of</strong><br />
healthy living and measures to reduce the<br />
use <strong>of</strong> tobacco, we believe this measure<br />
created a new program and added layer <strong>of</strong><br />
bureaucracy when the State is cutting other<br />
existing essential programs. The Legislative<br />
Analyst’s Office concluded that the<br />
revenue stream to fund these new cancer<br />
research programs would be declining<br />
and the <strong>Chamber</strong> Board was concerned<br />
that it would once again put existing programs<br />
at risk to keep these new programs<br />
funded with general funds as the tax collected<br />
diminishes.<br />

However, the backers <strong>of</strong> these initiatives<br />
are not on the same page and polling<br />
continues to suggest that voters are more<br />
likely to reject all three instead <strong>of</strong> pick<br />
just one. Efforts continue to pressure the<br />
backers to get behind a single tax increase<br />
initiative.<br />
An interesting measure that did recently<br />
qualify for the Nov. 6 ballot is a referendum<br />
on the State Senate boundaries<br />
recently drawn up by the independent Citizens<br />
Redistricting Commission, which<br />
was established by Prop. 14 in 2008.<br />
The <strong>Chamber</strong> Alliance is reviewing<br />
initiatives on the June 5 ballot and will announce<br />

President Obama’s 2013 budget<br />
proposes cutting funding for the U.S.<br />
Department <strong>of</strong> Defense. Part <strong>of</strong> these<br />
cuts is Defense Secretary Leon Panetta’s<br />
plan to ask Congress to approve two<br />
rounds <strong>of</strong> military base closures, one as<br />
early as next year and one in 2015.<br />
Military bases in Ventura County<br />
provide a huge economic impact to our<br />
local community. These bases employ<br />
nearly 19,000 people who live on or<br />
around the bases. These are people who<br />
spend their hard-earned money at local<br />
businesses and restaurants and give<br />
back to their community daily.<br />
At a time when the world is unstable<br />
with Iran, North Korea, and the<br />
Middle East, our military bases are in-<br />

New legislation by Senator Tom<br />
Harman would direct California’s three<br />
tax agencies to work toward the goal<br />
<strong>of</strong> consolidating tax self-services into a<br />
single taxpayer-friendly website.<br />
In these difficult economic times,<br />
it’s more important than ever for government<br />
to eliminate the bureaucratic<br />
red-tape that entangles businesses.<br />
Many California businesses have to file<br />
and pay taxes to three separate agencies,<br />
and taxpayers are <strong>of</strong>ten confused<br />
as to which agency is responsible for a<br />
particular tax: BOE, EDD or FTB.<br />
SB 1326 would streamline this process.<br />
Under the bill’s provisions, the<br />

Simply put, the positive effect<br />
<strong>of</strong> our military bases is invaluable and<br />
I plan to fight to make sure these bases<br />
are kept open.<br />
I recently introduced Senate Joint<br />
Resolution 19, which encourages the<br />
California Congressional delegation to<br />
help preserve these bases that provide<br />
economic support to our local community,<br />
as well as national security for our<br />
nation.<br />
Congress has the authority to approve<br />
the base closures, so we need to<br />
send a clear message to our representatives<br />
in Washington, D.C. not to go forward<br />
with the deep defense cuts and let<br />
them know just how important California<br />
military bases are.<br />
I have also asked Governor Jerry<br />
Brown to authorize the formation <strong>of</strong><br />
an unpaid, volunteer task force for the<br />
strategic purpose <strong>of</strong> preserving California’s<br />
military bases. Similar task forces<br />
website www.taxes.ca.gov would be<br />
enhanced to allow taxpayers to file tax<br />
returns, claim refunds, and request for<br />
relief <strong>of</strong> interest or penalties with one<br />
login. Taxpayers would no longer need<br />
to navigate through three separate tax<br />
agencies to access forms and information,<br />
saving taxpayers time and increasing<br />
voluntary compliance.<br />
As Senator Harman pointed out,<br />
“This is something that should have<br />
been done a long time ago. Businesses<br />
should be spending their resources to<br />
create jobs not to hire teams <strong>of</strong> attorneys<br />
and accountants to manage filling<br />
out California’s patchwork <strong>of</strong> tax forms.<br />
With technological advances, it is about<br />
time California’s tax system moves out<br />

were created in the past by Governor<br />
Schwarzenegger in 2004 and Governor<br />
Wilson in 1993, but have since expired.<br />
According to a 2006 Economic Impact<br />
Study performed by the Workforce<br />
Investment Board <strong>of</strong> Ventura County,<br />
our military bases produced an estimated<br />
$1.2 billion in goods and services,<br />
over $900 million <strong>of</strong> which was retained<br />
locally. This is money that went directly<br />
back into our community, helping boost<br />
local small businesses.<br />
Additionally, approximately $166<br />
million in taxes were attributed to Naval<br />
Base Ventura County in 2006, almost<br />
$70 million <strong>of</strong> which went to state<br />
and local governments.<br />
Clearly, these bases are vital to local<br />
businesses, my constituents, and<br />
California as a whole. Shutting them<br />
down would be hugely detrimental, so<br />
I will to work to make sure our military<br />
bases continue to be positive resources<br />
for the people <strong>of</strong> California.<br />

<strong>of</strong> the dark ages.”<br />
Just as online banking has provided<br />
individuals and businesses with<br />
easier access to banking account information<br />
and services, a single website<br />
will make voluntary compliance with<br />
tax programs simpler. Senate Bill 1326<br />
received the unanimous support <strong>of</strong> the<br />
Senate Governance and Finance Committee<br />
and now moves to the Senate<br />
Appropriations Committee for further<br />
consideration.<br />
