Throughout 2007, the ProsecutionsDivision operated within the parameters of its establishedprosecution policy guidelines, and prosecutors tookthe decisions they believed to be just. Prosecutorsacted without fear or favour, and were not influenced bycriticism from any quarter. Acting as a minister of justice, his role is crucialto the fairness of criminal proceedings. The prosecutorshould properly guide the investigator, adequately assistthe defence, and fairly present the case at court. Aprosecution must only be instituted if there is a reasonableprospect of conviction on the available evidence, and if itis in the public interest to proceed. Wherever possible,prosecution is used as a sanction of last resort, andalternatives to prosecution are considered where thecircumstances allow. In August, Mr Simon Tam, SGC,told Sing Tao Daily that the prosecutor must have a senseof justice, and that he saw his role as ‘not merely a job, butas helping the court uphold justice’.Fundamental to prosecution policy is the protection of theinterests of all of those involved in legal proceedings, inwhatever capacity. In March, after a decision had beentaken to terminate a private prosecution because of theweakness of the case against the accused, Mr WilliamTam, SGC, told the Eastern Magistrates Court that ‘toallow a prosecution to proceed in the absence of sufficientevidence would be an abuse of legal process’ (ESS13730, 13731 & 2983 of 2006). In July, the reasons forconcealing the identity of a senior official who was allegedlyblackmailed by a hostess for $500,000 were questioned,and the DPP replied that if blackmail victims did notreceive special protection ‘victims would be reluctant toreport their cases to the police and testify in court, thusallowing the offenders to escape justice’ (DCCC 624 of2007).
