Property/Casualty Insurance Renewal/Workers Compensation Self-Insurance Trust RenewalMrs. Steckel reviewed the renewal rate for the district’s Property/CasualtyInsurance through the Illinois School District Agency (ISDA) and the Worker’sCompensation insurance coverage thru the Worker’s Compensation Self-Insurance Trust (WCSIT). As a member of WCSIT, the district’s School BoardLegal Liability, the School District Treasurer’s Bond and Student AccidentInsurance are provided free of charge as a benefit. This year the Illinois SchoolDistrict Agency and the Worker’s Compensation Self Insurance Trust areoffering a 3 year rate guarantee. This rate guarantee is for the base rates only.The premiums are still subject to change due to the inflation of the building values,the district’s workers compensation experience model, and the age of our bus fleet.If the school district agrees to the multiyear rate, it is locked into maintainingits coverage through ISDA and WCSIT for the three years. After discussion, amotion was made by Hatfill seconded by Cory to adopt the following resolutionsto approve the renewal of membership in the Illinois School District Agency andthe Worker’s Compensation Self Insurance Trust until 6/30/2012 thus takingadvantage of the multiyear rate guarantee.
Illinois School District AgencyWHEREAS, pursuant to authority under Article VII of the Illinois Constitution of1970 and Section 6 of the Illinois Intergovernmental Cooperation Act, the IllinoisSchool District Agency (“ISDA”) was established as an intergovernmentalcooperative undertaking pursuant to the Illinois School District Agency Agreement(“ISDA Agreement”) to implement joint self-insurance of property and casualtyrisks and other risks among the school districts that execute the ISDA Agreementand thereby become members of ISDA (“Members”);self-WHEREAS, the District desires to execute the ISDA Agreement and become (orremain) a Member of ISDA so that the District can participate in ISDA’s jointinsurance program for property and casualty risks and other risks.WHEREAS, ISDA provides a multiyear Rate Guarantee Agreement under its jointinsurance program for property and casualty risks and other risks;WHEREAS, the District desires to have the benefits of ISDA’s multiyear RateGuarantee Agreement from 7/1/2009 to 7/01/2012;WHEREAS, the District desires to enter into such multiyear Rate GuaranteeAgreement;WHEREAS, the Board understands and acknowledges that pursuant to themultiyear Rate Guarantee Agreement the District’s rates will remain the same duringthe entire term of such Rate Guarantee Agreement; however, total contribution maychange because of changes in risk and exposure factors, which factors include butare not limited to property values, average daily student attendance, receipts from schoolevents, teacher census and number and type of vehicles; andWHEREAS, the board understands and acknowledges that the District will beobligated to remain a member of ISDA for the entire term of the multiyear RateGuarantee Agreement and that if the District were to attempt to withdraw or failto pay the entire amount of the contributions due for the entire term of the multiyear RateGuarantee Agreement, the District would be obligated to pay the total amount ofcontribution(s) due and/or the total amount that would have been due underPlan(s) of Coverage, which were in effect and/or would have been in effect but fortermination of the District’s membership in ISDA, during the entire term of the RateGuarantee Agreement.NOW, THEREFORE, BE TO RESOLVED, that the District agrees to fulfill (or tocontinue to fulfill) the obligations of a member under the terms of the ISDAAgreement and any By-Laws and Rules that may be adopted by the Board ofRegents of ISDA from time to time and to be obligated under a multiyear RateGuarantee Agreement pursuant to its terms; copies of such ISDA Agreement andRate Guarantee Agreement shall be entered in the minute book immediately afterthese resolutions.
