Property/Casualty Insurance Renewal/Workers Compensation Self-Insurance Trust RenewalMrs. Steckel reviewed the renewal rate for the district’s Property/CasualtyInsurance through the Illinois School District Agency (ISDA) and the Worker’sCompensation insurance coverage thru the Worker’s Compensation Self-Insurance Trust (WCSIT). As a member of WCSIT, the district’s School BoardLegal Liability, the School District Treasurer’s Bond and Student AccidentInsurance are provided free of charge as a benefit. This year the Illinois SchoolDistrict Agency and the Worker’s Compensation Self Insurance Trust areoffering a 3 year rate guarantee. This rate guarantee is for the base rates only.The premiums are still subject to change due to the inflation of the building values,the district’s workers compensation experience model, and the age of our bus fleet.If the school district agrees to the multiyear rate, it is locked into maintainingits coverage through ISDA and WCSIT for the three years. After discussion, amotion was made by Hatfill seconded by Cory to adopt the following resolutionsto approve the renewal of membership in the Illinois School District Agency andthe Worker’s Compensation Self Insurance Trust until 6/30/2012 thus takingadvantage of the multiyear rate guarantee.


Illinois School District AgencyWHEREAS, pursuant to authority under Article VII of the Illinois Constitution of1970 and Section 6 of the Illinois Intergovernmental Cooperation Act, the IllinoisSchool District Agency (“ISDA”) was established as an intergovernmentalcooperative undertaking pursuant to the Illinois School District Agency Agreement(“ISDA Agreement”) to implement joint self-insurance of property and casualtyrisks and other risks among the school districts that execute the ISDA Agreementand thereby become members of ISDA (“Members”);self-WHEREAS, the District desires to execute the ISDA Agreement and become (orremain) a Member of ISDA so that the District can participate in ISDA’s jointinsurance program for property and casualty risks and other risks.WHEREAS, ISDA provides a multiyear Rate Guarantee Agreement under its jointinsurance program for property and casualty risks and other risks;WHEREAS, the District desires to have the benefits of ISDA’s multiyear RateGuarantee Agreement from 7/1/2009 to 7/01/2012;WHEREAS, the District desires to enter into such multiyear Rate GuaranteeAgreement;WHEREAS, the Board understands and acknowledges that pursuant to themultiyear Rate Guarantee Agreement the District’s rates will remain the same duringthe entire term of such Rate Guarantee Agreement; however, total contribution maychange because of changes in risk and exposure factors, which factors include butare not limited to property values, average daily student attendance, receipts from schoolevents, teacher census and number and type of vehicles; andWHEREAS, the board understands and acknowledges that the District will beobligated to remain a member of ISDA for the entire term of the multiyear RateGuarantee Agreement and that if the District were to attempt to withdraw or failto pay the entire amount of the contributions due for the entire term of the multiyear RateGuarantee Agreement, the District would be obligated to pay the total amount ofcontribution(s) due and/or the total amount that would have been due underPlan(s) of Coverage, which were in effect and/or would have been in effect but fortermination of the District’s membership in ISDA, during the entire term of the RateGuarantee Agreement.NOW, THEREFORE, BE TO RESOLVED, that the District agrees to fulfill (or tocontinue to fulfill) the obligations of a member under the terms of the ISDAAgreement and any By-Laws and Rules that may be adopted by the Board ofRegents of ISDA from time to time and to be obligated under a multiyear RateGuarantee Agreement pursuant to its terms; copies of such ISDA Agreement andRate Guarantee Agreement shall be entered in the minute book immediately afterthese resolutions.


FURTHER RESOLVED, the Superintendent, for and on behalf on the District, isauthorized and directed to execute the ISDA Agreement, the Rate GuaranteeAgreement and any other related documents and to do any other acts that arearequired to commence (or continue) membership I ISDA and participate in the RateGuarantee Agreement.Workers’ Compensation Self-Insurance TrustWHEREAS, pursuant to authority under Article VII of the Illinois Constitution of1970 and Section 6 of the Illinois Intergovernmental Cooperation Act, the IllinoisAssociation of School Boards Workers’ Compensation Self-Insurance Trust(“WCSIT”) was established as an intergovernmental cooperative undertakingpursuant to the Illinois Association of School Boards Workers’ Compensation Self-Insurance Trust Agreement (“Trust Agreement”) to implement joint self-insurance ofworkers’ compensation and employers’ liability risks and other risks among theschool districts that execute the Illinois Association of School Boards Workers’Compensation Self- Insurance Trust Pooling Agreement (“Pooling Agreement”) andthereby become members of WCSIT (“Members”);andWHEREAS, the District desires to execute the Pooling Agreement and become (orremain) a Member of WCSIT so that the District can participate in WCSIT’s jointself-insurance program for workers’ compensation and employers’ liability risksother risks;WHEREAS, WCSIT provides a multiyear Rate Guarantee Agreement under itsjoint insurance program for workers’ compensation and employers’ liability risks andother risks;WHEREAS, the District desires to have the benefits of WCSIT’s multiyear RateGuarantee Agreement from 7/07/2009 to 7/01/2012;WHEREAS, the District desires to enter into such multiyear Rate GuaranteeAgreement;WHEREAS, the Board understands and acknowledges that pursuant to themultiyear Rate Guarantee Agreement the District’s rates will remain the same duringthe entire term of such Rate Guarantee Agreement; however, total contribution maychange because of changes in risk and exposure factors, which factors areexpressed in part through an experience modification number and include but are notlimited to payroll and class of employees, and;WHEREAS, The Board understands and acknowledges that the District will beobligated to remain a Member of WCSIT for the entire term of the multiyear RateGuarantee Agreement and that if the District were to attempt to withdraw or failto pay the entire amount of the contributions due for the entire term of the multiyear RateGuarantee Agreement, the District would be obligated to pay the total amount of

On roll call, Cory, yes; Hatfill, yes; Nairn, yes; Pohlman, yes; Test, yes; Brown, yes.Motion carried.RESOLUTION TO RETAIN INTEREST EARNINGS AS INTERESTEffective the 2008-09 fiscal year, the Illinois State Board of Education implemented anew rule limiting the power to transfer interest between school district funds. Section 10-22.44 of the School Code allows school boards to freely transfer interest accruing on anydistrict fund (except Tort, IMRF, Life Safety and Capital Improvement) to any otherdistrict funds. However, the ISBE rule <strong>100</strong>.50 of Title 23 provides that unless otherwisespecified by board resolution adopted prior to June 30 of a fiscal year, interest earningwill be added to the principal as of June 30 of the fiscal year and will no longer beconsidered interest. The only fund that the school district transfers interest from is theWorking Cash Fund. A motion was made by Hatfill, seconded by Nairn to approve thefollowing resolution which declares that the interest earned in the Working Cash Fundwill remain interest thus maintaining the school district’s flexibility with regards totransferring the interest to another fund.WHEREAS, the Board of Education of <strong>Jersey</strong> Community Unit School District no. <strong>100</strong>,counties of <strong>Jersey</strong> and Greene, Illinois has earned interest in the following funds:a. Educational Fundb. Operations & Maintenance Fundc. Transportation Fundd. Working Cash Fund; andWHEREAS, the Illinois Program Accounting Manual administrative regulations (23Ill.Adm.Code Section <strong>100</strong>.50(a)(4)) as revised effective July 1, 2008 provide that unlessotherwise provided by statute or specified by board resolution adopted prior to June 30 ofa fiscal year, interest earnings of a fund shall be added to and become part of the principalof the fund as of June 30 of the fiscal year; andWHEREAS, the District desires to retain interest earnings described herein as interest inorder to maintain maximum flexibility to allow for the possible transfer of said funds inaccordance with Section 10-22.44 of the Illinois School Code (105 ILCS 5/10-22.44) oras otherwise authorized by law.NOW, THEREFORE, BE IT RESOLVED by the Board of Education as follows:Section 1. Incorporation of preambles. The recitals set forth above are herebyincorporated by reference and shall have the same force and effect as though fullyset forth herein.Section 2. Earnings retained as interest. The Board of Education hereby declaresthat all interest which has been earned as of June 30, 2009 and which has


previously been retained as interest earnings in the following funds shall be retainedas interest earnings and shall not accumulate as principal in said funds:a. Working Cash FundSection 3. Amounts to be determined by audit. The amount of interest in saidFund subject to this resolution shall be the amount of interest earned in said Fund as ofJune 30, 2009, and all interest which has been earned in said fund in prior years asdetermined by the final certified audit of the District’s funds for those years andwhich has been retained as interest in those funds.Section 4. Use of interest retained. The Board shall retain the discretion to retainthe amounts referred to in Section 3 above as interest in the respective Fundidentified in this resolution, or to transfer said interest in accordance with Section10-22.44 of the Illinois School Code, or to use said interest in any other mannerauthorized by law.anySection 5. Repeal of inconsistent resolutions; effective date. A motion was made byTest, seconded by Hatfill to adopt the following resolution:WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers,mechanics and other workers employed in any public works by the State, county, city or


any public body or any political subdivision or by any one under contract for publicworks," approved June 26, 1941, codified as amended, 820 ILCS 130/1 et seq. (1993),formerly Ill. Rev. Stat., Ch. 48, par. 39s-1 et seq. andWHEREAS, the aforesaid Act requires that Community Unit School District <strong>No</strong>. <strong>100</strong> ofthe Counties of <strong>Jersey</strong> and Greene investigate and ascertain the prevailing rate of wagesas defined in said Act for laborers, mechanics and other workers in the locality of saidCounties of <strong>Jersey</strong> and Greene employed in performing construction of public works, forsaid Community Unit School District <strong>No</strong>. <strong>100</strong>.NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF EDUCATION OFCOMMUNITY UNIT SCHOOL DISTRICT NO. <strong>100</strong>:Section l: To the extent and as required by "An Act regulating wages of laborers,mechanics and other workers employed in any public works by State, county, city or anypublic body or any political subdivision or by any one under contract for public works,"approved June 26, l941, as amended, the general prevailing rate of wages in this localityfor laborers, mechanics and other workers engaged in construction of public workscoming under the jurisdiction of Community Unit School District <strong>No</strong>. <strong>100</strong> is herebyascertained to be the same as the prevailing rate of wages for construction work in the<strong>Jersey</strong> County area as determined by the Department of Labor of the State of Illinois asof June of the current year a copy of that determination being attached hereto andincorporated herein by reference. As required by said Act, any and all revisions of theprevailing rate of wages by the Department of Labor of the State of Illinois shallsupersede the Department's June determination and apply to any and all public worksconstruction undertaken by Community Unit School District <strong>No</strong>. <strong>100</strong>. The definition ofany terms appearing in this Ordinance which are also used in aforesaid Act shall be thesame as in said Act.Section 2: <strong>No</strong>thing herein contained shall be construed to apply said general prevailingrate of wages as herein ascertained to any work or employment except public worksconstruction of Community Unit School District <strong>No</strong>. <strong>100</strong> to the extent required by theaforesaid Act.Section 3: The Community Unit School District <strong>No</strong>. <strong>100</strong> Clerk shall publicly post orkeep available for inspection by any interested party in the main office of CommunityUnit School District <strong>No</strong>. <strong>100</strong> this determination or any revisions of such prevailing rate ofwage. A copy of this determination or of the current revised determination of prevailingrate of wages then in effect shall be attached to all contract specifications.Section 4: The Community Unit School District <strong>No</strong>. <strong>100</strong> Clerk shall mail a copy of thisdetermination to any employer, and to any association of employers and to any person orassociation of employees who have filed their names and addresses, requesting copies ofany determination stating the particular rates and the particular class of workers whosewages will be affected by such rates.

Mrs. Steckel also reported the guaranteed natural gas price provided through Tylex showsa 26% savings compared to last year; and also reported on the State and Federal moneythat has not been received.Tax Extension RatesMrs. Steckel reviewed the estimated 2008 tax extension rates comparing the rates to theprevious year.Freedom of Information Request• A Freedom of Information request was received from James Monge• A Freedom of Information request was received from Polly ByrneSchool Board ConventionDiscussion was held regarding the 2009 School Board Convention – Lighting the Wayheld <strong>No</strong>vember 20-22, 2009. The Board will discuss attendance at the School BoardConvention at the July meeting.Board PolicyThe Board Policy Committee met on May 28 to review the latest policy updaterecommendations from the Illinois Association of School Boards policy update service.The policies listed below are recommended for the first reading of changes and will bevoted on at the July meeting. She feelsthis is a great district, a great place to work, and a great place to live.Greg Brown thanked Ms. Legge for serving as our Superintendent and wished her best ofluck in Kankakee.With the passing of Mr. Dick Brown, condolences were extended to Bryan and MichelleBrown, district employees.Greg Brown announced a new Superintendent has not been hired due to a time restraintof July 1. It is possible an Interim Superintendent will be hired in the near future.A motion was made by Hatfill, seconded by Pohlman to adjourn. The regular meeting ofJune 17, 2009 adjourned at 9:20 P.M.
