Whenever a riot is committed for the benefit or on behalf of any person who is theowner or occupier of any land respecting which such riot takes place, or who claims anyinterest in such land, or in the subject of any dispute which gave rise to the riot, or who hasaccepted or derived any benefit there from. the agent or manager of such person shall bepunishable with fine, if such agent or manager, having reason to believe that such not waslikely to be committed, or that the unlawful assembly by which such riot was committed waslikely to be held, shall not use all lawful means in his power to prevent such riot, orassembly from taking place and for suppressing and dispersing the same.HarbouringPersons hired foran unlawfulassembly.Being hired totake Part in anunlawfulassembly or riot.Or to go armed.'Affray'.154. Whoever harbours, receives, or assembles in any house or premises in hisoccupation or charge or under his control, any persons, knowing that such persons havebeen hired, engaged, or employed, or are about to be hired, engaged ,or employed, to joinor become members of an unlawful assembly, shall be punished with imprisonment ofeither description for a term which may extend to six months, or with fine, or with both.155. Whoever is engaged or hired, or offers or attempts to be hired or engaged, to do orassist in doing any of the acts specified in section 138, shall be punished with imprisonmentof cither description for a term which may extend to six months, or with fine, or with both ;and whoever, being so engaged or hired as aforesaid, goes armed or engages or offers togo armed with any deadly weapon or with anything which, used as a weapon of offence, islikely to cause death, shall be punished with imprisonment of either description for a termwhich may extend to two years, or with fine, or with both.156. When two or more persons, by fighting in a public place disturb the public peace,they are said to " commit an, affray ".Punishment forcommitting affray.157. Whoever commits an affray shall be punished with imprisonment of either descriptionfor a term which may extend to one month, or with fine which may extend to one hundredrupees, or with both.Public servanttaking agratification otherthan legalremuneration inrespect of anofficial act.CHAPTER IXOF OFFENCES BY OR RELATING TO PUBLIC SERVANTS158. Whoever, being or expecting to be a public servant, accepts or obtains or agrees toaccept or attempts to obtain from any person, for himself or for any other person, anygratification whatever, other than legal remuneration, as a motive or reward for doing orforbearing to do any official act, or for showing or forbearing to show, in the exercise of hisofficial functions, favour or disfavor to any person, or for rendering or attempting to renderany service or disservice to any person with the Government of the Republic, or with anypublic servant as such, shall be punished with imprisonment of either description for a termwhich may extend to three years, or with fine, or with both-Explanations" Expecting to be a public servant ": If a person not expecting tobe in office, obtains a gratification by deceiving others into a beliefthat he is about to be in office, and that he will then serve them,he may be guilty of cheating, but he is not guilty of the offencedefined in this section."Gratification": The word "gratification" is not restricted to pecuniary gratifications or togratification estimable in money.http://www.lawnet.lk/process.php?st=2001Y1V19C&hword=''&path=5 (36 of 124)9/30/2008 2:10:41 PM
