<strong>Home</strong> Office, <strong>Occupation</strong> <strong>or</strong> <strong>Business</strong>Planning In<strong>f<strong>or</strong></strong>mation Sheet No. 2<strong>Home</strong> UsesThe <strong>City</strong>’s Town Planning Scheme No. 4 provides use classes <strong>of</strong> ‘<strong>Home</strong> Office, ‘<strong>Home</strong> <strong>Occupation</strong>’ and ‘<strong>Home</strong><strong>Business</strong>’ that allows low impact occupations <strong>or</strong> hobbies to be conducted from a person’s own home in areas where thezoning may otherwise not allow such uses. It also enables the <strong>City</strong> to maintain sufficient controls to ensure that nodisturbance <strong>or</strong> nuisance is created <strong>f<strong>or</strong></strong> neighbours.<strong>Home</strong> OfficeA ‘<strong>Home</strong> Office’ is defined in Town Planning Scheme No.4 as “a home occupation limited to a business carried outsolely within a dwelling by a resident <strong>of</strong> the dwelling but which does not – Entail clients <strong>or</strong> customers travelling to and from the dwelling; Involve any advertising signs on the premises; and Require any external change to the appearance <strong>of</strong> the dwelling”.A ‘<strong>Home</strong> Office’ is a “permitted development” under clause 8.2 <strong>of</strong> Town Planning Scheme No. 4 and a planningapplication is there<strong>f<strong>or</strong></strong>e not required where it satisfies and strictly complies with the abovementioned definition.By way <strong>of</strong> clarification, a <strong>Home</strong> Office is considered to be the use <strong>of</strong> the premises by a person who conducts the activity<strong>of</strong>f site (e.g. mobile mechanic) and only conducts the administration component <strong>of</strong> the enterprise at their residence.<strong>Home</strong> <strong>Occupation</strong>A ‘<strong>Home</strong> <strong>Occupation</strong>’ is defined in Town Planning Scheme No.4 as “an occupation carried out in a dwelling <strong>or</strong> on landaround a dwelling by a resident <strong>of</strong> the dwelling which – Does not entail employment <strong>of</strong> any person not a member <strong>of</strong> the occupier’s household; Will not cause injury to <strong>or</strong> adversely affect the amenity <strong>of</strong> the neighbourhood; Does not occupy an area greater than 20m²; Does not display a sign exceeding 0.2m² in area; Does not entail the retail sale, display <strong>or</strong> hire <strong>of</strong> goods <strong>of</strong> any nature; In relation to vehicles and parking, will not result in the requirement <strong>of</strong> a greater number <strong>of</strong> parkingfacilities than n<strong>or</strong>mally required <strong>f<strong>or</strong></strong> a single dwelling <strong>or</strong> an increase in traffic volumes in theneighbourhood, does not involve the presence, use <strong>or</strong> calling <strong>of</strong> a vehicle m<strong>or</strong>e than 2 tonnes tareweight, and does not include the provision <strong>f<strong>or</strong></strong> the fuelling, repair <strong>or</strong> maintenance <strong>of</strong> mot<strong>or</strong> vehicles;and Does not involve the use <strong>of</strong> essential services <strong>of</strong> greater capacity than n<strong>or</strong>mally required in the zone”.Version 4 Sept 2012 PLN Info No.2 Page 1 <strong>of</strong> 3


<strong>Home</strong> <strong>Business</strong>The <strong>City</strong>’s Scheme defines a ‘<strong>Home</strong> <strong>Business</strong>’ as “a business, service <strong>or</strong> pr<strong>of</strong>ession carried out in a dwelling <strong>or</strong> on land<strong>or</strong> on land around a dwelling by an occupier <strong>of</strong> the dwelling, which: Does not employ m<strong>or</strong>e than 2 people not members <strong>of</strong> the occupier’s household’ Will not cause injury to <strong>or</strong> adversely affect the amenity <strong>of</strong> the neighbourhood; Does not occupy an area greater than 50m 2 ; Does not involve the retail sale, display <strong>or</strong> hire <strong>of</strong> goods <strong>of</strong> any nature; In relation to vehicles and parking, does not result in traffic difficulties as a result <strong>of</strong> the inadequacy <strong>of</strong>parking <strong>or</strong> an increase in traffic volumes in the neighbourhood, does not involve the presence, use <strong>or</strong>calling <strong>of</strong> a vehicle m<strong>or</strong>e than 3.5 tonnes tare weight; and Does not involve the use <strong>of</strong> an essential service <strong>of</strong> greater capacity than n<strong>or</strong>mally required in thezone”.Health Requirements and <strong>Application</strong>s <strong>f<strong>or</strong></strong> Hairdressing, Beauty Therapy and FoodPreparation<strong>Application</strong>s involving hairdressing, beauty therapy and food preparation require additional approval from the <strong>City</strong>’sHealth Services. A separate application and fee will need to be submitted to the <strong>City</strong>’s Health Services Department <strong>f<strong>or</strong></strong>consideration. The <strong>City</strong>’s Health Department should be consulted in this regard on 9399 0111.<strong>Application</strong>An application is necessary if any part <strong>of</strong> your home <strong>or</strong> property is being used in association with a business. F<strong>or</strong>example, using a study as an <strong>of</strong>fice contact point, <strong>or</strong> conducting w<strong>or</strong>k <strong>f<strong>or</strong></strong> pr<strong>of</strong>it in a shed. It is noted that depending onscale, noise, dust, fumes etc, w<strong>or</strong>k that could potentially disturb neighbouring properties may not be permitted, as suchuses are m<strong>or</strong>e appropriate to an ‘Industrial’ zoning.Any resident wishing to apply <strong>f<strong>or</strong></strong> a home use shall provide: A completed application <strong>f<strong>or</strong></strong>m (Schedule 6 – <strong>Application</strong> <strong>f<strong>or</strong></strong> Planning Approval to CommenceDevelopment / Use) signed by ALL land owners <strong>of</strong> the land. A completed <strong>Home</strong> Use Details <strong>f<strong>or</strong></strong>m; Fee as per the Schedule <strong>of</strong> Fees and Charges.These <strong>f<strong>or</strong></strong>ms are available from the <strong>City</strong>’s <strong>of</strong>fices <strong>or</strong> via the <strong>City</strong>’s website:http://www.armadale.wa.gov.au/<strong>Home</strong>/Services_and_Facilities/PlanningNB: Additional in<strong>f<strong>or</strong></strong>mation may be required.Assessment ProcessWhen an application is lodged, the <strong>City</strong>’s Planning Services staff will assess the in<strong>f<strong>or</strong></strong>mation provided by the applicantand give consideration to what effect the home use may have upon the general locality.The maj<strong>or</strong>ity <strong>of</strong> applications <strong>f<strong>or</strong></strong> the operation <strong>of</strong> a <strong>Home</strong> <strong>Occupation</strong> do not require public advertising and may be dealtwith under delegated auth<strong>or</strong>ity by the <strong>City</strong>’s <strong>of</strong>ficers.All applications however <strong>f<strong>or</strong></strong> the operation <strong>of</strong> a <strong>Home</strong> <strong>Business</strong> will be the subject <strong>of</strong> a process <strong>of</strong> public advertising inacc<strong>or</strong>dance with clause 9.4 <strong>of</strong> Town Planning Scheme No. 4. Local residents will be given the opp<strong>or</strong>tunity to comment,<strong>f<strong>or</strong></strong> which a 14 day period is allowed <strong>f<strong>or</strong></strong> submissions to be received.The <strong>City</strong> has a statut<strong>or</strong>y time frame <strong>of</strong> 60 days in which to make a decision (<strong>or</strong> 90 days if advertised). Determination <strong>of</strong> <strong>Application</strong>s and RenewalsIn determining an application <strong>f<strong>or</strong></strong> a home use, the <strong>City</strong> may:Grant approval with <strong>or</strong> without conditions as it deems necessary to the development; <strong>or</strong>Refuse to grant its approval giving its reasons <strong>f<strong>or</strong></strong> refusal.If the application is approved, the application fee will cover the first 12 months <strong>of</strong> operation. Approvals <strong>f<strong>or</strong></strong> <strong>Home</strong><strong>Occupation</strong> and <strong>Home</strong> <strong>Business</strong> are valid <strong>f<strong>or</strong></strong> one year and must be renewed annually. <strong>Application</strong>s <strong>f<strong>or</strong></strong> renewal need tobe lodged with the <strong>City</strong> pri<strong>or</strong> to the current approval expiring and application fees are payable.
