1. Introduction1.1 This report considers the <strong>process</strong> for dealing with the planning applicationsin respect of the <strong>Folkestone</strong> <strong>seafront</strong> area, currently under consideration.1.2 Planning application Y12/0897/SH seeks outline planning permission forthe redevelopment of the harbour and <strong>seafront</strong> to provide a comprehensivemixed use development comprising up to 1000 dwellings (C3), up to10,000 square metres of commercial floorspace including A1, A3, A4, A5,B1, D1 and D2 uses as well as seasports and beach sports facilities.Proposals include improvements to the beaches, pedestrian and cycleroutes and accessibility into, within and out of the <strong>seafront</strong> and harbour,together with associated parkin. The application is accompanied by anEnvironmental Statement.1.3 On 21 st June 2006 the resolution below was agreed by Council. Therequest was made by Councillor Love and followed a petition received bySDC from Go <strong>Folkestone</strong>, supporting the Roger De Haan masterplan forthe <strong>seafront</strong> development as an alternative to the proposal that was underconsideration at the time under applications Y05/0084/SH andY05/0085/SH (the Trent scheme).1) That, in view of the significance of <strong>Folkestone</strong>’s <strong>seafront</strong>, until such time asthe future of the <strong>seafront</strong> area development is settled, all major planningapplications for the <strong>seafront</strong> come for determination to the full Councilrather than the Development Control Committee, as is the case with Lyddairport.2) That, following the procedure above, the two current, and as yetundecided, planning applications (Y05/0084/SH and Y05/0085/SH) relatingto <strong>Folkestone</strong>’s <strong>seafront</strong>* be referred to the full Council for determination toenable full consideration to be taken of the outstanding environmental,highways and affordable housing issues.3) That consultations be undertaken on the desirability of incorporating theprinciples of the De Haan/Foster’s scheme into Shepway’s Local Plan orDevelopment Framework.* Note These two applications (Y05/0084/SH and Y05/0085/SH) undecided atthe time of the resolution have now been withdrawn.1.4 Whilst the 2006 resolution requires the application to be determined by fullCouncil it does not set out the procedures that Council will need to agree toin order to be able to determine the application.2.0 Proposed procedure2.1 The proposed procedure is set out in the appendix.2.2 In brief it is suggested that the council consider the application (“incommittee”) and allow public speaking.4. Appendix - Procedures for determining the applicationPROPOSED PROCEDURE AT A COUNCIL MEETING RELATING TOSPEAKING IN RESPECT OF FOLKESTONE SEAFRONT PLANNINGAPPLICATION Y12/0897/SH1 Firstly to propose that the Council consider the applications “in committee”in accordance with council procedure rule 16.14. This in turn will involvethe suspension of procedure rule 16.3 (the right of a councillor seconding amotion to reserve their speech until later in the debate), rule 16.4 (limit onlength of speeches), rule 16.5 (curtailment of councillors’ right to speakmore than once) and rule 22.1 (requirement to stand while speaking).2. To allow the following to speak for up to three minutes: one representativefrom <strong>Folkestone</strong> Town Council and Sandgate Parish Council; one localresident to speak in support of the application and one against; onerecognised lobby group to speak in support of the application and oneagainst; the ward members for <strong>Folkestone</strong> Harbour and <strong>Folkestone</strong> HarveyCentral wards; and the county councillor for the <strong>Folkestone</strong> South division.The order for such addresses shall therefore be as follows:• Representative from <strong>Folkestone</strong> Town Council• Representative from Sandgate Parish Council• One resident in support of the application (if any)• On resident against application (if any)• One lobby group speaker in support of the application (if any)• One lobby group speaker against the application (if any)• Ward member(s) for <strong>Folkestone</strong> Harbour ward• Ward member(s) for <strong>Folkestone</strong> Harvey Central ward• County councillor for <strong>Folkestone</strong> South divisionWard councillors addressing the meeting will, of course, be free to makeadditional contributions as part of the general debate.3.
