or any proceeding in court unless Equity specifically consents in writing. In no caseshall claims of <strong>Actors</strong> under employment contracts be handled or enforced byagents or attorneys of <strong>Actors</strong>, unless such handling is consented to by Equity inwriting.(B) Time Limit in Lodging Claims. Should the Actor deem that there is any claimagainst the Producer under the Actor's contract, the Actor shall present same toEquity or to the Producer within four weeks after the time when such claims shallhave arisen, unless the Actor shall give to Equity or to the Board of Arbitration or toeither of them a good and sufficient reason for any delay after such period of fourweeks. Should the Actor present his claim to Equity, Equity, upon receipt of aclaim, will immediately notify the Producer in writing of such claim.17. CLOSING NOTICES. [See also Rule 68, TERMINATION.](A) Closing the <strong>Theatre</strong>. The Producer may close the theatre by posting on theEquity Callboard one week's written notice to all members of the company, providedthe <strong>Actors</strong> shall receive not less than the minimum employment and/or paymentguaranteed under their contracts.(B) Where a theatre is closed in accordance with or after notice of closing to theentire company, such notice of closing shall supersede any individual notice thenoutstanding.(C) Closing the Production. The Producer may close a specific production byposting on the Equity Callboard two weeks' written notice to all members of thecompany, provided the <strong>Actors</strong> shall receive not less than the minimum employmentand/or payment guaranteed under their contracts.Anything to the contrary notwithstanding, a Stage Manager notice shall be anindividual notice and he/she shall not be terminated by a Closing of Productionnotice.(D) The Producer shall post the closing notice before the curtain up of the lastperformance of the week. Notice of termination or closing given before theperformance on Sunday, effective at the end of Sunday following, shall be deemedone week's notice; and such notice effective at the end of Sunday week followingshall be deemed two weeks' notice.(E) The closing notice must be signed by the Producer or a person specificallyauthorized by the Producer. In no case may it be signed by the Stage Manager orthe Assistant Stage Manager.(F) Unless <strong>Actors</strong>' Equity Association is notified of a change, in writing, thecontemplated closing date as stated on the face of the contract will stand asnotification to Equity that said production will close on that date. However, a <strong>Dinner</strong><strong>Theatre</strong> closing notice must be filed with Equity in writing.18. CLOTHES AND MAKE-UP.(A) General Provisions. The Producer shall furnish all <strong>Actors</strong> with all costumes andclothes (period and modern), including wigs, hats, beards, hairpieces, stockings,tights, hose, socks (as essential parts of the visible costume), and shall not expect18
the Actor to use any of his personal wardrobe on stage except modern andconventional undergarments not referred to above.When the Actor is provided with costumes by the Producer and the Actor chooseswith the consent of the Producer to wear the Actor's own clothing instead, then theProducer shall not be required to pay any rental fee.(B) Dramatic Productions. The Actor may agree to furnish such conventionalstreetwear clothes, footwear and appurtenances thereto as he may own. Principal<strong>Actors</strong> earning $1,000.00 or less per week shall receive rental for each week of useas set forth in a rider to his contract. Minimum terms shall be based upon theschedule agreed upon in writing between Equity and the Producer, which isannexed to this Agreement and posted on the callboard at each theatre. All otherclothes, costumes, wigs, footwear, including the properties and appurtenancespeculiar to any trade, occupation or sport shall be furnished and/or paid for by theProducer and at all times maintained by him, at his expense, in a clean and sanitarycondition. In no event shall a Producer require the Actor to purchase any specialclothes.(C) Musical Productions.(1) Principal. If the Actor receives $1,000.00 or less per week, the Producershall furnish him with all necessary clothes and footwear. An Actor receivingover $1,000.00 per week may agree to furnish such conventional streetwearclothes, and a dinner jacket or evening dress, footwear and appurtenancesthereto as he may own. All other clothes, costumes, wigs, footwear, includingthe properties and appurtenances peculiar to any trade, occupation, or sportshall be furnished, and/or paid for and at all times maintained by the Producer.In no event shall the Producer require the Actor to purchase any specialclothes.(2) Chorus. The Producer shall furnish <strong>Actors</strong> engaged on Chorus contractswith all hats, costumes (period or modern), wigs, beards, hairpieces, shoes,tights, hose, and stockings. In no circumstances shall <strong>Actors</strong> engaged onChorus contracts be required to furnish any of their outer clothing.Tights, hose, stockings and all other skin parts shall be new when issued to theActor.(3) Shoes.(a) General The <strong>Theatre</strong> shall provide properly fitted footwear which, if fordancing, shall be new. All other footwear shall be clean, sanitary, and ingood repair.(b) Dance Shoes The <strong>Theatre</strong> shall provide properly-fitted professionaldance shoes for all members of the cast who are required to dance. Danceshoes may represent the period of a production or nature of a specificcharacter (e.g., sneakers in WEST SIDE STORY; athletic shoes in DAMNYANKEES) and must conform to the appropriate style of the movement.
