26. DISCRIMINATION.(1) Discrimination shall not be permitted against any Actor because of race,color, creed, age, disability, national origin, gender, sexual orientation, politicalpersuasion or belief of such Actor.(2) The Actor shall not be permitted to perform in any theatre or other place ofperformance where discrimination exists because of race, color, creed, nationalorigin, gender, disability, age, sexual orientation, political persuasion or beliefagainst any Actor, or against any patron, as to admission to or seating in suchtheatre or other place of performance. As between Equity and the Actor orcast, Equity shall determine whether discrimination exists at the place ofperformance.27. DISCRIMINATION FOR UNION ACTIVITY.The Producer shall not dismiss or otherwise penalize any Deputy or Actor for fulfillinghis duties or obligations as a Deputy or as an Actor.In the event the employment of a Deputy or an Actor is terminated for alleged unionactivity, the Producer will furnish the reasons for this termination simultaneously to boththe Deputy or the Actor and Equity at the written request of the Deputy or the Actor whohas been dismissed.Any Actor who claims that the Producer has given him notice or otherwise penalizedhim for fulfilling his duties as an Actor may present his case to Equity who shall give theProducer an opportunity to be heard if he so desires. If Equity is satisfied that suchactivities are the real cause of dismissal or of any penalty, it may permit the Actor'sclaim to be arbitrated and shall have the power to determine the character and theamount of the claim to be submitted.Whenever an Equity Deputy is dismissed or otherwise penalized, Equity shallinvestigate the reasons for such dismissal or penalty. If the Executives of Equity aresatisfied upon investigation, that said Deputy was dismissed or otherwise penalized forfulfilling his duties or obligations as a Deputy, they shall present his case to Equity asherein provided, and Equity shall have the right to permit arbitration of the Deputy'sclaim and to determine the character and amount of the claim to be submitted.It is further agreed that if upon arbitration the claim of the Actor is sustained, thearbitrator in his discretion shall have the right to impose a penalty, the amount of saidpenalty to be determined by the arbitrator.28. DUES.The Producer shall deduct union dues, initiation fees, and assessments from the weeklysalary of every employee who is, or may become a member of Equity as provided for inthis Agreement, provided that the Producer receives from Equity notification and theproper authorization, agreed to and signed by the employee.Any monies actually so deducted shall be held in trust by the Producer for the benefit ofEquity and delivered to Equity not later than ten business days following the date onwhich the deductions were made.29
