Federal34Repayment of <strong>the</strong> principal does not begin until six months after <strong>the</strong> borrowergraduates or attends less than half time. Repayment may continue for ten <strong>to</strong> twentyfiveyears.The Unsubsidized Stafford Loan is not need-b<strong>as</strong>ed. <strong>Student</strong>s may borrow up <strong>to</strong>$18,500 in subsidized and unsubsidized loans per academic year. The federalgovernment does not subsidize interest on <strong>the</strong> unsubsidized loan while <strong>the</strong> borrowerattends school; interest will accrue and capitalize on <strong>the</strong> principal at a frequencydetermined by <strong>the</strong> specific lender. There are two fees <strong>as</strong>sessed when borrowing anunsubsidized loan, (1) an origination fee (currently 3% of <strong>the</strong> <strong>to</strong>tal amount borrowed)and (2) a guarantee fee (currently 1% of <strong>the</strong> <strong>to</strong>tal amount borrowed). The interest rateand repayment conditions are <strong>the</strong> same <strong>as</strong> <strong>the</strong> subsidized Federal Stafford Loan.Stafford Loans are partly forgivable for lawyers, but only if <strong>the</strong> recipient enters anAmeriCorps, Vista or Peace Corps program. Those entering an AmeriCorps or Vistaprogram have <strong>the</strong>ir loans placed in forbearance during <strong>the</strong>ir service year, and receivea $4,725 education award following service.Loan Repayment Programs Administered by Federal Government AgenciesIn 1990, Congress p<strong>as</strong>sed a law authorizing <strong>the</strong> use of loan repayment <strong>as</strong> anincentive in recruiting and retaining members of <strong>the</strong> federal workforce. 43 The lawpermitted loan repayment <strong>as</strong>sistance of up <strong>to</strong> $6,000 per year, with a maximum overtime of $40,000. Not until January 2001, however, did <strong>the</strong> Office of PersonnelManagement take any steps <strong>to</strong> implement <strong>the</strong>se incentives. On January 11, 2001, <strong>the</strong>Office of Personnel Management finally issued regulations 44 allowing federal agencies<strong>to</strong> establish programs under which <strong>the</strong>y may repay federally insured student loans offederal employees in order <strong>to</strong> recruit or retain highly qualified professional, technicalor administrative personnel. To receive <strong>the</strong> benefit, an employee must sign anagreement <strong>to</strong> remain in <strong>the</strong> service of <strong>the</strong> agency for not less than three years.Agencies may pay up <strong>to</strong> $6,000 a year per employee, not <strong>to</strong> exceed a <strong>to</strong>tal of $40,000.There is no general budgetary authority for <strong>the</strong>se programs, so an agency mustfund its loan repayment program by reallocating funds from its own existing budget.In fiscal year 2002, <strong>the</strong> Office of Personnel Management reported that 16 Federalagencies provided more than $3.1 million in student loan repayments for 690 Federalemployees. 45 In addition, eight o<strong>the</strong>r agencies reported that <strong>the</strong>y had established anagency loan repayment plan and expected <strong>to</strong> use <strong>the</strong> program in <strong>the</strong> near future.
