K I N G S P O R T C I T Y S C H O O : S T U D E N T H A N D B O O KImply that submission to or rejection of such conduct will be used as a basis fordetermining the student's grades and/or participation in a student activity.Any student or any parent of a student attending a <strong>Kingsport</strong> <strong>City</strong> School shall reportany incident of harassment to the child's teacher, school administrator or counselor. Ifthe offending person is an employee, the victim of sexual harassment shall reportthese conditions to the immediate supervisor of the offending person. Confidentialitywill be maintained and no reprisals or retaliation will occur as a result of good faithreporting of charges of sexual harassment.Sexual harassment of one student by another student will be addressed in the schoolCode of Conduct, is classified as a Category II or III offense, and carries with it thepossibility of suspension and/or referral to an outside agency for further action.Sexual harassment will constitute cause for disciplinary action. In determining whetheralleged conduct constitutes sexual harassment, all of the circumstances, including thenature of the conduct and the context in which the alleged conduct occurred, will beinvestigated. The range of behaviors that may constitute sexual harassment include,but are not limited to:LeeringPinchingGrabbingSuggestive verbal commentsPressure for dates or sexual activityOther verbal, physical, or visual actionsCONFISCATION OF ITEMSAny student who retaliates against any person who reports alleged sexual harassmentor violence or any student who retaliates against any person who testifies, assists orparticipates in an investigation, proceeding or hearing will also be subject todisciplinary action, including suspension/expulsion. Retaliation includes, but is notlimited to, any form of intimidation, reprisal or harassment.Items that are prohibited by school policy or are used in violation of school rules will beconfiscated by school officials. The school assumes no responsibility for the safe keeping ofthese items. Refusal to relinquish a cell phone or any other item or device will be treated as anact of insubordination as defined under the student Code of Conduct.1 ST OFFENSE: The item will be confiscated and kept at the school for a minimum of five (5)consecutive school days (Upon reasonable suspicion all cell phone memory may be reviewed.)In order to retrieve the confiscated item, a parent or guardian must make contact with theappropriate administrator.2 ND OFFENSE: When a student has a second offense during the current semester, the item willbe confiscated for a minimum of ten (10) school days. A parent or guardian must retrieve theconfiscated item from the front office.3 RD OFFENSE: When a student has a third offense during the current semester, the item willbe confiscated for the remainder of the school year. A parent or guardian may retrieve theconfiscated item at the end of the school day on the last day of the school year.39
