Convention CallFifty-Fifth Conventionfrom the International Headquarters of the<strong>Amalgamated</strong> <strong>Transit</strong> <strong>Union</strong>5025 Wisconsin Avenue, NWWashington, DC 20016-4139April 1, 2007Fellow ATU Members:In compliance with the Constitution and General Laws of our <strong>Union</strong>,I am notifying you that the Fifty-Fifth Convention of our <strong>Union</strong> willconvene at the Bally’s Las Vegas hotel, 3645 Las Vegas Boulevard, SouthLas Vegas, NV 89109, on Monday, September 17, 2007, at 9:00 a.m.BASIS OF REPRESENTATIONThe basis of representation regulating the election of delegates to theConvention is found in the following sections of the Constitution andGeneral Laws:Section 6.4 Representation; L.U. The basis of representation to theConvention shall be one (1) delegate for each L.U. [Local <strong>Union</strong>] havingthree hundred (300) or fewer members. A L.U. having three hundredand one (301) up to six hundred and fifty (650) members shall be entitledto two (2) delegates. A L.U. having six hundred and fifty one (651) upto nine hundred and fifty (950) members shall be entitled to three (3)delegates. A L.U. having from nine hundred and fifty one (951) up totwelve hundred and fifty (1,250) members shall be entitled to four (4)delegates and for each additional four hundred (400) members or fractionthereof, shall be entitled to one (1) additional delegate. In totalingmembership only those in good standing for the month of May precedingthe Convention are to be counted.NOTE: In accordance with Section 6.4, representation of Local <strong>Union</strong>swill be based on the membership of the Local in good standing for the month ofMay preceding the Convention. Accordingly, credentials cannot be forwarded toLocals until the May 2007 monthly membership report has been received at theInternational Office.Section 6.5 Representation; J.B.C. The basis for representation to theConvention by a J.B.C. [Joint Bargaining Council], formed for collectivebargaining purposes pursuant to Section 23 of [the] Constitution, shallbe one (1) delegate, except that a J.B.C. representing more than fivethousand (5,000) members shall be entitled to two (2) delegates. AJ.B.C. representing more than twelve thousand (12,000) members shallbe entitled to three (3) delegates. No member represented by the J.B.C.who is, by virtue of his or her office in the L.U. or otherwise, a delegatefrom his or her L.U., shall be eligible to serve as delegate from the J.B.C.Delegates from a J.B.C. shall not have the right to vote in the electionof International officers unless elected by secret ballot vote among themembership represented by the J.B.C. The provisions of the Constitutionrelating to delegates from L.U.s shall also govern delegates from a J.B.C.unless clearly inapplicable.Section 6.6 Representation; C.C. The C.C. [Canadian Council]shall be entitled to one (1) delegate. No member of a Canadian L.U.participating in the C.C. who is, by virtue of his or her office in the L.U.or otherwise, a delegate from his or her L.U., shall be eligible to serve asdelegate from the C.C. The delegate from the C.C. shall not have theright to vote in the election of International officers. The provisions of[the] Constitution relating to delegates from the L.U.s shall also govern thedelegate from the C.C. unless clearly inapplicable.DELEGATESSection 6.7 Delegates. The election of delegates must be held at leastfour (4) weeks previous to the Convention. A member, to be eligible asa delegate, must have been a member in continuous good standing of hisor her L.U. the two (2) years next preceding the day of the nominationmeeting. When a L.U. has not been in existence for the two year period,the L.U. shall elect its other delegates from among its members.Except where, pursuant to Section 14.2 of [the] Constitution, a meetingattendance requirement is imposed as a condition of eligibility for suchan office, the president-business agent, F.S./B.A., or R.S./B.A. whereapplicable, shall, by virtue of his or her office, be the first (1st) L.U.convention delegate and the F.S. (president in L.U.s where the presidentis not B.A.) shall, by virtue of his or her office, be the second (2nd) L.U.convention delegate and the election ballot shall in each instance so state.Except where, pursuant to Section 14.2 of [the] Constitution, a meetingattendance requirement is imposed as a condition of eligibility for any suchoffice, a L.U. may provide in local bylaws that local officers and executiveboard members may be delegates to Conventions of the A.T.U. byvirtue of their office. In such case, where the number of executive boardmembers exceeds the number of convention delegate positions allocatedto the L.U. under Section 6.4, the L.U. shall designate by position andlimit the number of delegates elected by virtue of their offices to the totalnumber of delegate positions. The remaining executive board membersshall be elected to numbered positions as alternate delegates for purposesof filling vacancies and any additional delegate positions to which the L.U.may finally be entitled under Section 6.4. The local officers and executiveboard members elected as delegates and alternate delegates by virtue of8 IN TRANSIT www.atu.org
their office under the L.U. bylaws shall represent the L.U. as conventiondelegates to the extent of the available positions. Where L.U. bylawsprovide that local officers and executive board members may be delegatesto Conventions of the A.T.U. by virtue of their office, the ballot must state“and Convention Delegate” or “and Alternate Delegate,” as appropriate,after each such office.Section 6.8 Alternates. L.U.s shall provide in their bylaws for theelection of alternate delegates to the Convention by secret ballot, providedthat nothing herein shall prohibit L.U.s from providing in their bylawsthat L.U. officers may serve as alternate delegates by virtue of their officeunless and except where, pursuant to Section 14.2 of [the] Constitution, ameeting attendance requirement is imposed as a condition of eligibility forsuch an office.Section 6.9 Disqualifications. Members who have voluntarily left theservice in which the L.U. or J.B.C. or the I.U. is engaged, shall not beeligible as delegates to a Convention of this <strong>Union</strong>.Section 6.12 International Officers. All International officers notelected as delegates by their L.U.s shall be delegates to the Conventionby virtue of their office but shall not have the right to vote in the electionof International officers. International officers who are elected by themembership of their L.U.s by secret ballot may serve as delegates to theConvention, their expenses to be paid by the said L.U.s and, in such cases,they shall have all the voting rights and all powers of other delegates electedby the L.U.s.Section 6.15 Excused Absences. The policies, laws and plans for thedirection of this <strong>Union</strong> shall be adopted and put into force from timeto time by direction of the regular Conventions of this <strong>Union</strong>, and itshall be the duty of each and every local of this <strong>Union</strong> to be representedat these Conventions by one (1) or more delegates. No L.U. shall beexcused from being represented except from distressed conditions, owingto lockouts, strikes or causes of that kind. In such cases the L.U. affectedshall apply to the I.P. no later than the tenth (10th) of May in the year inwhich the Convention is held for permission to be excused from sendingdelegates to the Convention. The I.P. shall investigate and rule upon suchapplications. Unless excused by the I.P., all L.U.s shall be represented asthis Constitution provides.CREDENTIALSSection 6.10 Credentials. Each delegate shall establish his or her claimto a seat by credential signed by the president and R.S. of the L.U. he orshe represents, with the seal of said L.U. attached. L.U.s shall send namesof the respective delegates and alternates elected to the International officeof the A.T.U. at least two (2) weeks prior to the date of the Convention.Credentials shall be given each delegate elected, signed by the presidentand R.S. and the seal of the L.U. attached thereto.Section 6.14 Financial Requirements. Delegates shall not be entitledto a seat in the Convention unless all taxes and assessments of their L.U.have been paid in full.RESOLUTIONSSection 6.16 Resolutions. Resolutions contemplative of amendmentsto the Constitution and General Laws of the I.U. shall first be approvedby the L.U. and bear its official seal and then shall be forwarded to theInternational office in time to be in the hands of the I.P. not later than thefirst (1st) of August in the year in which the Convention is held. Suchresolutions so received by the I.P. shall be printed and placed in the handsof convention delegates at the opening of the particular Convention atwhich said resolutions are proposed to be presented. All resolution(s)received by the first (1st) of April in the year in which the Convention isheld will be published in the May/June issue of In <strong>Transit</strong> in the year inwhich the Convention is held. No resolution contemplative of amendingthe Constitution and General Laws, except as herein provided, shall beconsidered by Conventions, except on permission or direction by vote oftwo thirds of the delegates present.VOTINGSection 6.11 Voting. Each delegate shall be entitled to one (1) vote, noproxy votes being allowed.EXPENSESSection 6.13 Delegate Expenses. The I.U. shall pay one thousanddollars ($1,000.00) to each L.U, J.B.C., and C.C. towards the mileageand legitimate expenses of a L.U., J.B.C. and C.C.’s first delegate and anadditional seven hundred and fifty dollars ($750.00) to a L.U., J.B.C. andC.C. sending two (2) or more delegates. All other mileage and legitimateexpenses for delegates shall be borne by the L.U., J.B.C. and C.C. theyrepresent.NOTE: Pursuant to Section 6.2 the General Executive Board has enactedto require payment of a registration fee of $150 for each delegate and $150for each guest. Registration fees for delegates and guests should be paid whencredentials are returned to the International Office.HeadquartersThe headquarters for the Convention will be the Bally’s Las Vegas hotel,3645 Las Vegas Boulevard, South Las Vegas, NV 89109. All requests forhotel reservations must be made through the hotel itself, either by calling1-800-634-3434 and providing the ATU Convention “group code” of SBATU 7, or by using the ATU-dedicated internet reservation process whichcan be accessed via the link posted on the International <strong>Union</strong>’s website.(Any hotel reservations made by other means, including a travel agent oran internet travel service, will not be within the more favorable ATU groupblock of accommodations.)Hotel RatesBally’s daily guest room rate is: $129.00 (USD) for single or double (plus9% applicable taxes).TransportationDelegates must make their own arrangements for transportationindividually or in groups by bus, rail, air or private automobile accordingto their own desires.VisitorsMembers who are not delegates, and friends of the members anddelegates, who desire to visit the Convention can register as guests and takeadvantage of all hotel and other Convention arrangements. I cordiallyinvite them to attend our Convention, and those wishing to do so maymake reservations directly with Bally’s.AttendanceI call to the attention of each Local <strong>Union</strong> Section 6.15 of theConstitution, which provides that it shall be the duty of every Local <strong>Union</strong>to be represented at the Convention by one or more delegates.Value of AttendingThe laws and policies of this <strong>Union</strong> are amended and adopted by theConventions of our <strong>Union</strong>. It is essential that all of our Local <strong>Union</strong>srecognize the importance of the coming Convention and arrange to senddelegates.Hoping to see all Local <strong>Union</strong>s and Joint Bargaining Councilsrepresented by full delegations, I remain,Fraternally,Warren S.
