SHORT NOTICE INVITING BID (SNIB)Sealed bid in prescribed format affixing non refundable Court Fee Stamp of Rs 8.25(Rupees Eight & Paisa Twenty Five) only are invited from reputed manufacturers and authorizeddealers for supply of “2/80’s fast coloured Dyed Mercerized Cotton Hank Yarn” for thebeneficiaries of Mukhya Mantrir Karmajyoti Achani (MMKA) being implemented by Industries& Commerce Department for the year 2012-13. The yarn should be dyed with after treatment toavoid bleaching of Colours and fastness to sunlight and washing. Preference will be given tounits having registration under APSP / single point registration under NSIC.Manufacturers /Authorized dealers can submit their offer for supply of themachinery.The bid document containing detailed Terms & Conditions can be obtained from theoffice of the Commissioner of Industries & Commerce , Udyog Bhawan, Bamunimaidan ,Guwahati-21 from 11.03.2013 to 20.03.2013 during office hours on payment of Rs 1000/-(Rupees One Thousand) only by cash or demand draft drawn in favour of Commissioner ofIndustries & Commerce, Assam and payable at Guwahati. Bid DocumentThe Bid shall be in two parts viz. Technical Bid (Part I) and Price Bid (Part II) which areto be submitted in two separate envelopes ( Lac sealing at all the joints of envelopes and dulysuper scribed with name of machinery & bid no. ) inside the main envelope.1.1 Part –I ( Technical Bid) shall consists of the following :(a)(b)(c)(d)(e)(f)(g)Covering letter of the offer.Court Fee Stamp of Rs 8.25 (Rupees Eight & Paisa Twenty Five) only tobe affixed on the covering letter.Bid Security in the form of Demand Draft/ Fixed Deposit Receipt/Banker’s Cheque/ Bank Guarantee valid for 45 (forty five) days beyond thedate of submission of the bid, duly pledged in favour of “Commissioner ofIndustries & Commerce, Assam” payable at “Guwahati”.Demand draft/ money receipt of payment towards the cost of bid document.Constitution of the bidder along with supporting documents.Photocopies of E.M. part-II /SSI Regn./IEM part-II in case of manufacturer/ Original Copy of Authorised Dealership certificate issued by themanufacturing company in case of dealer.Copy of Supply Order/ Completion certificate of similar nature of workfrom any Government Department/Govt. undertaking/ Public SectorUndertaking indicating Name of work, Supply order No. & date, Value ofwork, Signature & Designation of the issuing authority.The bidder should have experience of successfully completing similar worksduring the last 7 (Seven) years ending last day of the month previous to theone ( i.e on or after 1 st March,2006) in which bids are invited should be eitherof the following :(i) 3 (Three) similar completed supply order of value not less thanRs. 40.00 lacs (each)Page | 3

or(ii) 2 (Two) similar completed supply order of value not less thanRs. 50.00 lacs (each)or(iii) 1 (One) similar completed supply order of value not less thanRs. 80.00 lacsSimilar nature of work means Supply of Yarn.(h) Total volume of Similar nature of works performed during the last threeyears :(i) 2009-10(ii) 2010-11(iii) 2011-12(i) Certificate from Registered Chartered Accountant indicating annual financialturnover during the last three years, ending 31 st March of the previousfinancial year (i.e 2009-10, 2010-11 & 2011-12). Average annual financialturnover for the period should be at least Rs. 100.00 lacs(j) Copy of PAN Card.(k) Copy of VAT Registration.(l) Photo copy of entire set of tender document without indicating any rate oramount at any place, with the tender endorsement ( signature with stamp)on each page thereof, as token of acceptance of the terms & conditions,specifications etc.(m) Sample of “2/80’s fast coloured Dyed Mercerized Cotton Hank Yarn” in atleast 4 (Four) different colours.1.2 Part- II (Price Bid) shall consists of :(a)Original set of price bid duly filled in with rate and amounts. (b)(c)(d)The quoted rate ( to be indicated in ANNEXURE-I ) should be indicatedboth in figure and words . In case of any clerical mistake/error between therates indicated in figure and words, the lower rate would prevail.The rate quoted should be complete in all respect and should include allroyalties, taxes, duties , transportation cost, loading & unloading etc .Quoted rate shall be firm, fixed and final, irrespective of any variation ofquantities.2. Bid Security :(a)Bid should be accompanied by Lump Sum Bid Security of Rs. 2.00 lacs(Rupees Two lakh) only in the form of Demand Draft/ Fixed DepositReceipt/ Banker’s Cheque/ Bank Guarantee valid for 45 (forty five) daysbeyond the date of submission of the bid, duly pledged in favour of“Commissioner of Industries & Commerce, Assam” payable at“Guwahati”.(b) Bid Security so paid, will be returned to the unsuccessful bidders after awardof work is finalized. In case of successful bidder, the Bid Security will bereleased after submission of Performance Security @ 5% (Five percent) of thevalue of supply order.(c) In no case, exemption in submission of Bid Security shall be considered.(d) No interest shall be paid on the Bid Security.(e)For non submission of Bid Security or submission of Bid Security in the formother than mentioned in Para 2(a) above or submission of Bid Security forlesser amount, the offer shall be rejected.3. Performance Security :(a)Within 7 (seven) days of receipt of Supply order, the Successful bidder willhave to deposit Performance Security @ 5% (Five percent) of the total Workvalue in the form of Demand Draft/ Fixed Deposit Receipt/ Banker’sCheque/ Bank Guarantee with a validity of 60 (sixty) days beyond theexpiry of warranty period, duly pledged in favour of “Commissioner ofIndustries & Commerce, Assam” payable at “Guwahati”.Page | 5

(b) No interest shall be paid on the Performance Security.(c)Performance Security shall be released after completion of Supply of Yarn tothe concerned GM, DI&CCs.(d) Failure of the successful bidder in depositing the Performance Security within(e)the stipulated time, shall constitute sufficient grounds for cancellation of theaward and forfeiture of the Bid Security.Commissioner of Industries & Commerce, Assam will be at liberty to deductappropriate amount from the Performance Security for the value of Yarnwhich is found to be inferior and sub standard.4. Submission of Bids :(a)Bids addressed to the Commissioner of Industries & Commerce, Assam,Udyog Bhawan, Bamunimaidam, Guwahati-21 can be submitted either inperson or through Registered Post/ Speed Post / Courier up to 1.00 PM on21.03.2013. The date and time of submission of bid shall be reckoned as dateand time of the receipt of offer at the office of the Commissioner of Industries& Commerce, Assam.(b) Commissioner of Industries & Commerce, Assam will not be responsible forany delay including postal delay in submitting sealed offer.(c) No offer shall be accepted after the due date and time.(d) Tender forms are non transferable.(e) Submission of offer shall be as per instructions given at Para 1.1 & Para 1.2.Submission of offer in variance to instructions given at Para 1.1 & Para 1.2shall result in outright rejection of the offer.5. Opening of Bids :(a) Bids shall be opened at 2.30 PM on 21.03.2013.(b) In case 21.03.2013 happens to be a Govt. holiday, the Bids will be opened at(c)2.30 PM on the next working day.The envelope marked Part-I consisting of Technical part of the offer shall beopened as per schedule given at Para 5(a) & 5(b) above, in presence of thePage | 6

idders or their authorized representatives. The bidder/representative shouldbe conversant with the bid document/enclosures and should be able to clarifyany or all Technical matters and Commercial aspects.(d) The envelope marked Part-II consisting of Price Bid of bidders whose offer(e)are found technically suitable after scrutiny and accepted by the State LevelCommittee, shall be opened for further evaluation as per recommendation ofthe State Level Committee.After opening of bid, no communication from the bidder shall be entertained,unless formally asked for.Page | 7

General Conditions of Contract1. Validity of Offer :(a) The offer shall remain valid for a period of 1 (One) year from the date ofopening of Price Bid.2. Execution of work :(a)The successful bidder will have to sign a “Deed of Agreement” with the“Commissioner of Industries & Commerce, Assam or his representative”,within 7 (Seven) days from the date of issue of the supply order.(b) If the successful bidder fails to deposit the Performance Security and execute(c)the Deed of Agreement within the stipulated time, the bid security depositedshall be forfeited.The supply order will have to be carried out and completed within 3 (Three)months from the date of signing of the Deed of Agreement, failing which, thesupplier shall be liable to pay “Defaulter Charge” @ 1% of the total Workvalue per month for the period of delay.(d) The Yarn must be supplied in 10 (Ten) kg firm packet wrapped in polithene.The total quantity per district should then be supplied in 100 kgs bulkpackaging.3. Completion Certificate and payment :(a) Supply of Yarn shall be deemed to have been completed in all respect on theday General Manager, DI&CC certify that the Yarn has been received in goodcondition.(b) After completion of the supply, the Supplier shall submit bills in duplicateindicating all deductions, to the Commissioner of Industries & Commerce,Assam for payment.Page | 8

(c) Original Challans duly certified by General Manager, DI&CC shall besubmitted with the bill.(d) No advance on any account shall be made unless special circumstances ariseduring supply of machinery/equipments.(e) No escalation on any account shall be paid.(f) Taxes, as applicable, will be deducted at source.4. Arbitration :(a) In case any dispute, difference or question that may arise between the supplierand the Commissioner of Industries & Commerce, Assam in respect of supplyof Yarn, taxes, liabilities, duties etc., shall appoint a Sr. Officer as an arbitratorto sort out the difference and settle the matter amicably.(b) Only court at Guwahati, Kamrup (M) shall have territorial jurisdiction toentertain a claim.5. Other conditions :(a) Erasing and overwriting are not allowed.(b) All cancellations/insertions should be duly signed by the bidder.(c) Bidder should sign each and every page of the bid document including thesupporting document submitted along with the bid document.(d) The supplier shall comply with all Acts, Rules, Bye-laws, Regulation and otherstatutory requirements of local or other authorities having jurisdiction over thesite.(e) Commissioner of Industries & Commerce, Assam reserves the right toaccept/reject any or all the Tenders without assigning any reason thereof.Page | 9
