Story 33: Killing of a rebel returnee in front of his wife<br />
Victim: Rolando Antolihao, village coordinator for a political<br />
party, Bayan Muna.<br />
Alleged perpetrators: Unidentified armed man<br />
Date of incident: 10 November 2008 at 6pm<br />
Place of incident: At his house in Purok 7, Barangay Gabuyan,<br />
Municipality of Kapalong, Davao del Norte<br />

On 10 november at 6pm, Rolando Antolihao was in his house<br />
when an unidentified person, who claimed to be his neighbour,<br />
came knocking on their door. Before Rolando allowed the person<br />
in, he heard him from inside to have introduced himself by a<br />
name known to him.<br />
however, soon after Antolihao opened the door, the person<br />
shot him dead with a .45 calibre pistol. he suffered several<br />
gunshot wounds to his body. his wife, Elvira, claimed that her<br />
husband was a rebel returnee; and was also the head of the village<br />
watchman at the time of his death.<br />
Antolihao was a village coordinator for a political party, Bayan<br />
muna, whose members and leaders have been targeted for<br />
extrajudicial killings in recent years.<br />
Story 34: Detention of a man for six years without<br />
trial<br />
Victim: Pegie Boquecosa, 27, he is accused of being a member<br />
of the NPA.<br />
Date of incident: in 11 September 2002. He is presently detained<br />
at the Provincial Jail in Alabel in the same province.<br />
Place of incident: Barangay Colon, Maasim, Sarangani<br />

A prosecutor neglected and failed to resolve the charges filed<br />
against Pegie Boquecosa, a man detained without trial. For over<br />
two years, Alfredo Barcelona Jr., a prosecutor attached to the<br />
Office of the Provincial Prosecutor in Alabel, Sarangani could<br />
not conclude as to whether or not there is a “probable cause” to<br />
charge Boquecosa in court.<br />
Boquecosa was arrested on 11 September 2002 for murder and<br />
a variety of other offences. his continued detention after his arrest,<br />
despite the lack of formal charges filed in court, was due to the<br />
prosecutor’s repeated request to extend the deadline in concluding<br />
his resolution over variety of excuses. In one occasion, Barcelona<br />
claimed he needed to gather further evidence and testimonies<br />
from other witnesses, but still did not resolve the complaint for<br />
several months thereafter.<br />
