POOR MAINTENANCE of the Laguna Seca track is the<br />

reason a racecar driver finished in last place at a May 3 race<br />

and his team risks losing the championship this season,<br />

according to a lawsuit filed last week in Monterey County<br />

Superior Court.<br />

In the complaint filed Sept. 14, Tropacaval Media LLC<br />

alleges that a 12-15 inch steel piece of storm drain grate that<br />

was perpendicular to the track tore through the team’s No. 33<br />

Dodge Viper GT3R driven by Ben Keating as he struck the<br />

Continental Tire grand prix when the mishap occurred.<br />

<strong>The</strong> piece of grate that had become dislodged tore through<br />

the car “like a buzz saw through a tree trunk, ripping through<br />

the floor, diffuser, and metal shell of the fuel cell,” according<br />

to the lawsuit. Had the metal penetrated the fuel cell and ruptured<br />

its liner, “the entire racecar would have burst into<br />

flames.”<br />

<strong>The</strong> real damage, though, was to Keating — who finished<br />

dead last in the 100-lap race — and his team’s standings.<br />

Besides losing the Monterey race, Keating lost 15 points in<br />

the GT Daytona Tudor United SportsCar Championship<br />

Series, which crowns a team champion based on the cumulative<br />

number of points for winning races during a season.<br />

“As of last week, Mr. Keating was 15 points out of the<br />

lead, with only three races left for the year,” according to the<br />

lawsuit, filed for Tropacaval by Newport Beach attorney<br />

Jonathan A. Michaels. “<strong>The</strong>refore, if Mr. Keating had not had<br />

the Laguna Seca race ruined by the defendants’ failure to<br />

properly maintain the drainage gates, [the team] would have<br />

had the opportunity to finish in first place.”<br />

<strong>The</strong> complaint alleges gross negligence against defendants<br />

International Motor Sports Association, which promotes<br />

and sanctions the race series in which Keating competed,<br />

and the Sports Car Racing Association of the Monterey<br />

Peninsula, which manages the track. <strong>The</strong> lawsuit is another<br />

headache for SCRAMP, which is facing scrutiny from the<br />

county over its operation of Laguna Seca.<br />

David Hart, public relations manager for Mazda Raceway<br />

Laguna Seca, told <strong>The</strong> <strong>Pine</strong> <strong>Cone</strong> that SCRAMP is aware of<br />

the lawsuit and that it was filed “as a standard step in an<br />

insurance settlement procedure.”<br />

Though the metal from the grate “sliced through the racecar’s<br />

floor,” Keating wasn’t injured. But it took pit crews<br />

more than 10 minutes — an “eternity in racing” — to repair<br />

the damage so Keating could finish, according to the suit.<br />

As a result of Keating’s “dramatic fall in the standings,”<br />

the team “will likely lose valuable sponsorship money that it<br />

otherwise would have gained,” the complaint says. Keating<br />

and teammate Jeroen Bleekemolen alternated driving during<br />

the two-hour-and-40-minute race.<br />

Tropacaval Media is seeking $58,289.93 in damages for<br />

car repairs; $300,000 in travel, transport, crew costs and<br />

other expenses; a $15,000 “fee” for Bleekemolen, “as well as<br />

virtually eliminating the team’s ability to compete to win” the<br />

2015 season. <strong>The</strong> prize money for the winner of the May race<br />

was $20,000.<br />

Furthermore, the complaint alleges Keating had raced the<br />

2.24-mile Laguna Seca on three prior occasions, and in 2013<br />

experienced a similar issue with a drainage grate at the<br />

track’s famous Corkscrew, the lawsuit says.<br />

“<strong>The</strong> defendants knew of the propensity for the drainage<br />

grates on the Laguna Seca Raceway to create life-threatening<br />

hazards for the racers,” the suit says, “and yet failed to take<br />

any measures to secure the grates and protect the drivers<br />

from this risk of death or serious injury.”<br />

Ironically, before the May race at Laguna Seca, Keating<br />

commented on his prospects there.<br />

“For some reason, I have never loved Laguna Seca,”<br />

Keating said. “I hope to change that this weekend,” according<br />

to a report on the International Motor Sports Association<br />

website. “I love Monterey, I love that area of California, but<br />

the track has always been a little difficult for me.”<br />
