The KGCA Hall is a valuable resource for the citizens of Killarney-<br />
Glengarry. When you hold your birthday parties, special events, team<br />

Perspective<br />
I spent a day of insights at the Subdivision and Development<br />
Appeal Board last week. The appeal was<br />
made by an applicant, the Designer, against the refusal<br />
of his Development Permit. The house would have<br />
been beautiful and different - a good addition to Killarney’s<br />
eclectic streetscape - unfortunately it required<br />
too many relaxations to the Land Use Bylaw and because<br />
of this, the SDAB upheld the refusal.<br />
The first insight came from the information put<br />
together by the City for the appeal, which included<br />
the File Manager’s emails with the designer, letters<br />
from neighbours, the comments from the KGCA, the<br />
detailed review of the development application to the<br />
bylaw, and final drawings. This complete file package<br />
is something that the KGCA would not normally see<br />
and it was enlightening and encouraging. If you ever<br />
think that the City does not have the interests of ordinary<br />
citizens at heart then you need to read one of<br />

meeting-agendas.html). The hard work that this File<br />
Manager put in with the applicant to adjust the design<br />
to fit the Land Use Bylaw and to the needs of the<br />
Killarney Community is praiseworthy.<br />
The next insight although not new is worth restating:<br />
An SDAB hearing is always a great place to see balance<br />
and fairness in action. The City organization and the<br />
SDAB themselves make it easy and simple for people<br />
who are not accustomed to attending or presenting<br />
at hearings to have their views heard and considered.<br />
SDAB judgements are always fair and balanced and in<br />
every judgement are bound by the Land Use Bylaw.<br />
The final insight came from the Designer. This appeal<br />
gave us a chance to sit down and really talk about<br />
what would be needed to make the development a<br />
reality. The Designer felt that elements of the building<br />
design could have been amended to fit LUB parameters<br />
if there was a clear message that the approval or<br />
refusal of the Development Permit hinged upon these<br />
design elements, specifically lot coverage and a deep<br />
staggered front setback designed specifically for this<br />
unusual parcel of land.<br />
So just before the SDAB hearing started, we came to<br />
an agreement about changes to the lot coverage and<br />
set-backs from the lot boundaries that would have<br />
mitigated the placement of the building. Yes, the<br />
Development Committee has discussed this before<br />
with the Developer, but in the real world the crunch<br />
point is usually where the views of all parties are pared<br />
down to simple understanding, and consequently the<br />
crunch point is where most agreements can happen.<br />
Life is like that.<br />
Although we had come to an agreement it was not<br />
possible to present revised plans that could have<br />
been incorporated into an SDAB ruling. It was too late<br />
to incorporate changes, and the SDAB had to uphold<br />
the refusal of the development permit.<br />
And that is a shame, because the building would<br />
have been an interesting addition to Killarney. These<br />
insights may help change our perspective of the excellent<br />
work of the City File Managers - they really do<br />
care. They may help our perspective of the equally<br />
excellent work of the designers and developers who<br />
spend their time and money to redevelop Killarney.<br />
Sure it’s for profit; profit is good; profitable business<br />
creates jobs. For the Killarney Glengarry Community<br />
Association the ongoing message is that we must<br />
open doors and keep conversations moving forward<br />
toward development that benefits all of us.<br />
