<strong>4.</strong>19.0<strong>4.</strong> Seasonal Promotions and Sales<br />

A. General Requirements<br />

Seasonal and holiday related promotions and sales including, but not limited to,<br />

Christmas tree sales, pumpkin sales, fireworks, etc., may be permitted subject to<br />

the following:<br />

1. The use is consistent with the zoning, development, and dimensional<br />

standards <strong>of</strong> that parcel;<br />

2. If a tent, electric, or water is used, a building permit is required;<br />

3. All local business license taxes shall be paid;<br />

<strong>4.</strong> The use may be permitted <strong>for</strong> a maximum period <strong>of</strong> <strong>for</strong>ty-five (45)<br />

consecutive days;<br />

5. Written, notarized permission from all owners <strong>of</strong> record <strong>of</strong> the property, or<br />

authorized agent <strong>of</strong> the owner (must provide pro<strong>of</strong> <strong>of</strong> being an authorized<br />

agent), shall be submitted to the <strong>City</strong>.<br />

6. A plan shall be submitted illustrating the location <strong>of</strong> the space <strong>for</strong> the<br />

seasonal sale and depicting, at a minimum, the following:<br />

a. Adequate and safe ingress and egress;<br />

b. On-site parking availability; and<br />

c. Sanitary facilities.<br />

7. The use does not result in the reduction <strong>of</strong> any existing parking spaces to less<br />

than the minimum number <strong>of</strong> spaces required <strong>for</strong> the primary use.<br />

B. Determination <strong>of</strong> Additional Seasonal Events<br />

The Land Use Administrator shall determine the types <strong>of</strong> event, other than those<br />

listed herein, that constitute a seasonal holiday related promotion or sale.<br />

<strong>4.</strong>19.05. Special Events<br />

Refer to the <strong>City</strong> <strong>of</strong> <strong>Palm</strong> <strong>Coast</strong> Code <strong>of</strong> Ordinances.<br />

Section <strong>4.</strong>20. Wireless Communication Facilities<br />

<strong>4.</strong>20.01. Purpose and Intent<br />

The purpose <strong>of</strong> this section is to promote the health, safety, and general welfare <strong>of</strong> the<br />

public by regulating the siting <strong>of</strong> wireless communication facilities. It is also to<br />

encourage the location and collocation <strong>of</strong> wireless communication equipment on<br />

existing structures thereby minimizing new visual, aesthetic, and public safety<br />

impacts, minimizing effects upon the natural environment and wildlife, and reducing<br />

the need <strong>for</strong> additional support structures. This section is also intended to encourage<br />

the use <strong>of</strong> public lands, buildings, and structures as locations <strong>for</strong> wireless<br />

telecommunications infrastructure demonstrating concealed (stealth) technologies<br />

and revenue generating methodologies. As the growing need and demand <strong>for</strong><br />

wireless communication services exist, this section should minimize the impacts <strong>of</strong><br />

wireless communication facilities on surrounding areas by establishing standards <strong>for</strong><br />

location, structural integrity, and land use compatibility. As a result, this section will<br />

<strong>City</strong> <strong>of</strong> <strong>Palm</strong> <strong>Coast</strong> Unified Land Development Code<br />
