protect the character <strong>of</strong> the <strong>City</strong> while meeting the needs <strong>of</strong> its citizens to enjoy the<br />
benefits <strong>of</strong> wireless communication services.<br />
<strong>4.</strong>20.02. Applicability<br />
Except as provided in Subsection <strong>4.</strong>20.03, this section shall apply to the development<br />
activities including, but not limited to, installation, construction, or modification <strong>of</strong><br />
the following wireless communications facilities:<br />
A. Existing antenna support structures<br />
B. Proposed antenna support structures<br />
C. Public antenna support structures<br />
D. Replacement <strong>of</strong> existing antenna support structures<br />
E. Collocation on existing antenna support structures<br />
F. Attached wireless communication facilities<br />
G. Concealed wireless communication facilities<br />
<strong>4.</strong>20.03. Exempt Installations<br />
The following uses are exempt from the provisions <strong>of</strong> this section notwithstanding<br />
any other provision <strong>of</strong> this Code, but are subject to all applicable building code<br />
compliance and building permit reviews:<br />
A. Noncommercial, amateur radio antennas as provided <strong>for</strong> in Section 125.561,<br />
Florida Statutes.<br />
B. Satellite earth stations that are one (1) meter (39.37") or less in diameter in all<br />
residential districts and two (2) meters or less in all other zoning districts and<br />
which are not greater than twenty (20) feet above grade in residential districts<br />
and thirty-five (35) feet above grade in all other zoning districts.<br />
C. Government-owned wireless communication facilities, upon the declaration <strong>of</strong> a<br />
state <strong>of</strong> emergency by federal, state, or local government, and a written<br />
determination <strong>of</strong> public necessity by the <strong>City</strong>; except that such wireless<br />
communication facilities must comply with all federal and state requirements.<br />
This exemption shall terminate upon the state <strong>of</strong> emergency ending.<br />
D. Government-owned wireless communication facilities erected <strong>for</strong> the purposes <strong>of</strong><br />
installing antenna(s) and ancillary equipment necessary to provide<br />
communications <strong>for</strong> public health and safety.<br />
E. Temporary, commercial wireless communication facilities, upon the declaration<br />
<strong>of</strong> a state <strong>of</strong> emergency by federal, state, or local government, or determination <strong>of</strong><br />
public necessity by the <strong>City</strong>, and approval by the <strong>City</strong>; except that such wireless<br />
communication facilities must comply with all federal and state requirements.<br />
The exemption may be permitted by the <strong>City</strong> to continue to three (3) months after<br />
the duration <strong>of</strong> the state <strong>of</strong> emergency.<br />
F. Temporary, commercial wireless communication facilities <strong>for</strong> the purposes <strong>of</strong><br />
providing coverage <strong>of</strong> a special event such as news coverage or sporting event,<br />
subject to approved by the <strong>City</strong>, except that such wireless communication<br />
facilities must comply with all federal and state requirements. Said wireless<br />
