66. It is submitted that Ms. Guthrie was intentionally attempting to mislead the Court<br />

in her testimony on this point, and was deliberately attempting to make Mr. <strong>Elliott</strong><br />

appear unstable so that Ms. Guthrie’s fear of him would appear more reasonable.<br />

67. It is submitted that Ms. Guthrie attempted to further mislead the Court when<br />

trying to contort Mr. <strong>Elliott</strong>’s <strong>April</strong> emails into something they clearly were not:<br />

Q. Let’s take you to the [email] just above that, please?... This is <strong>April</strong><br />

21, now, 2012…at 9:36 a.m. “Thanks, Steph. No need to credit me for<br />

anything. I would have loved to have provided your project with a great<br />

logo and poster. Maybe next time. Love Greg.”<br />

A: Yeah.<br />

Q: Right? Does that sound like a very angry man to you?<br />

A: It sounds like a man whose [sic] masking some anger. All of these<br />

exchanges do, and as you might recall me mentioning, I too was masking<br />

some dislike, some negative feelings. I mean none of these exchanges use<br />

insults or all caps to scream at each other, but there is a seething<br />

undertone to it.<br />

Q: Okay. So I’m assuming…<br />

A: And anyone with some social intelligence I think would see that. 63<br />

68. It is submitted that not a single word of Mr. <strong>Elliott</strong>’s emails (Exhibits 6, 9, 10)<br />

displays frustration, hostility, or anger. It is further submitted that Ms. Guthrie’s<br />

testimony was either based on an utterly unreasonable interpretation of Mr.<br />

<strong>Elliott</strong>’s emails, or her testimony was a deliberate attempt to convey to the Court<br />

false and misleading information about Mr. <strong>Elliott</strong>.<br />

May and June 2012<br />

69. In May and June 2012, there are numerous tweets between Mr. <strong>Elliott</strong> and Ms.<br />

Guthrie displaying that a congenial relationship existed between the two of them.<br />

The select tweets that are referenced, below, from May and June are referenced in<br />

an attempt to permit the Court to better assess the entire circumstances of the<br />

case.<br />

70. On May 2, 2012, Ms. Guthrie and Mr. <strong>Elliott</strong> were tweeting each other regarding<br />

an incident that had occurred between Mayor Rob Ford and the Toronto Star<br />

reporter Daniel Dale on the land behind Mayor Ford’s home. At 23:23:27, Ms.<br />

Guthrie sent the following tweet: “@greg_a_elliott, @torontostar that comparison<br />

truly offends me and is a complete and utter distortion of reality”. In<br />

examination-in-chief, Ms. Guthrie said that she sent this tweet because Mr. <strong>Elliott</strong><br />

had accused Mr. Dale of “wrongdoing and making some comment about his<br />

masculinity”, and that Mr. <strong>Elliott</strong> called him a “sissy or a pussy or something<br />

along those lines”. However, when the Crown Attorney took Ms. Guthrie to the<br />

actual conversation, Ms. Guthrie confirmed the tweet of Mr. <strong>Elliott</strong>’s she was<br />
