Mid-September to Mid-November
159. Between mid-September and mid-November 2012 – more than half the
time period covered in the Information – there is no evidence that Mr. Elliott sent
a single tweet that could in any way be construed as being directed toward either
Ms. Guthrie or Ms. Reilly.
160. The first tweet during this period sent by Mr. Elliott that in any way
referred to Ms. Guthrie was on November 9, 2012, which mentioned Ms.
Guthrie’s handle:
@dreahouston @kiwinerd Right... @amirightfolks isn't "whipping up
outrage" she's fighting anti-oppression with oppression. Bullshit.

161. It is submitted that, from the wording of Mr. Elliott’s November 9 th tweet,
he had come across a reference on Twitter where Ms. Guthrie was recognized for
“whipping up outrage”, and Mr. Elliott was cutting-and-pasting that quotation and
directing the tweet to two Twitter users apparently not connected to the case at
bar.
The Pedophilia Incident
162. What evidently sparked Mr. Elliott to re-engage the complainants in
November 2012 was not either of the complainants making a minor political
point, or the fact that they invented a hashtag promoting one of their events.
Rather, Mr. Elliott responded to the propagation of the false idea that he was a
pedophile.
163. On November 12, 2012, an adult woman who was unknown to either Ms.
Guthrie or Ms. Reilly tweeted: “The size of Toronto is easily comparable to my
100 sq foot cave. WHY DOES EVERYONE KNOW EACH OTHER”. Mr.
Elliott, without mentioning anyone associated with the complainants, tweeted: “I
don’t know you yet. Let’s fix that sometime.” The adult woman – whose
credibility (or lack thereof) was unknown to the complainants at the time, tweeted
back: “No go away you’re a pedophile”; minutes later she said “I’m 13 you
creep!!!!!!!!!!!!” 149
164. In her cross-examination, Ms. Guthrie testified that she believed she saw
some of the people from the Summer Meeting tweeting about Mr. Elliott “hitting
on a 13 year old”, and confirmed:
I think I saw Paisley [Rae] and Heather [Reilly] both tweet about it. 150
