September 11, 2012 and Following
152. On September 11, 2012, Ms. Reilly filed a complaint with Twitter about
Mr. Elliott’s tweets. (The complaint would ultimately be dismissed by Twitter
because, inter alia, there appeared to be an active conversation between Mr.
Elliott and Ms. Reilly.)
153. On September 12, 2012, Mr. Elliott sent the following tweet wherein he
mentioned the #TBTB hashtag:
You think men are "safe"? “@ronobot: #TBTB because walking
around the city at night shouldn't be a privilege that only men get to
142
enjoy.â€
When cross-examined on this tweet, Ms. Guthrie confirmed that Mr. Elliott
appeared to have cut-and-pasted another Twitter user’s tweet that had included
the #TBTB hashtag, and testified to the following:
Q. Do you think it’s valid political commentary for Mr. Elliott to say “you
think men are safe”?
A. What is the ... why does it matter how valid the commentary is, Mr.
Murphy? Can you tell me that?
Q. Again, is that another rhetorical question?
A. No, this one I’m curious. What does it matter how valid the point
was? 143
It is submitted again that Ms. Guthrie – the creator and director of the political
organization WiTopoli – would not tolerate frequent dissenting commentary on
her politics and her political tweets.
154. On September 12, 2012 – the day after filing her complaint with Twitter
regarding Mr. Elliott’s harassment, and a week after she had allegedly become
fearful that Mr. Elliott had crossed into her real-life world at the Cadillac Lounge,
Ms. Reilly sent a tweet to all of her followers and mentioned the parody account
@GregurdyAerdiot. Ms. Reilly’s tweet said “hey, I see you’re a Madonna fan…”
and attached a photograph of Mr. Elliott’s tweet wherein he had asked Madonna
to “hook up” after Madonna’s Toronto performance that evening. It is
respectfully submitted that Ms. Reilly’s open taunt of Mr. Elliott again
demonstrated that she was not fearful of Mr. Elliott on September 12 th .
155. On September 13, 2012, Ms. Reilly tweeted the following, apparently in
reference to the @GregurdyAerdiot parody account:
