<strong>15</strong>2. On September 11, 2012, Ms. Reilly filed a complaint with Twitter about<br />

Mr. <strong>Elliott</strong>’s tweets. (The complaint would ultimately be dismissed by Twitter<br />

because, inter alia, there appeared to be an active conversation between Mr.<br />

<strong>Elliott</strong> and Ms. Reilly.)<br />

<strong>15</strong>3. On September 12, 2012, Mr. <strong>Elliott</strong> sent the following tweet wherein he<br />

mentioned the #TBTB hashtag:<br />

You think men are "safe"? “@ronobot: #TBTB because walking<br />

around the city at night shouldn't be a privilege that only men get to<br />

enjoy.â€<br />

When cross-examined on this tweet, Ms. Guthrie confirmed that Mr. <strong>Elliott</strong><br />

appeared to have cut-and-pasted another Twitter user’s tweet that had included<br />

the #TBTB hashtag, and testified to the following:<br />

Q. Do you think it’s valid political commentary for Mr. <strong>Elliott</strong> to say “you<br />

think men are safe”?<br />

A. What is the ... why does it matter how valid the commentary is, Mr.<br />

Murphy? Can you tell me that?<br />

Q. Again, is that another rhetorical question?<br />

A. No, this one I’m curious. What does it matter how valid the point<br />

was? 143<br />

It is submitted again that Ms. Guthrie – the creator and director of the political<br />

organization WiTopoli – would not tolerate frequent dissenting commentary on<br />

her politics and her political tweets.<br />

<strong>15</strong>4. On September 12, 2012 – the day after filing her complaint with Twitter<br />

regarding Mr. <strong>Elliott</strong>’s harassment, and a week after she had allegedly become<br />

fearful that Mr. <strong>Elliott</strong> had crossed into her real-life world at the Cadillac Lounge,<br />

Ms. Reilly sent a tweet to all of her followers and mentioned the parody account<br />

@GregurdyAerdiot. Ms. Reilly’s tweet said “hey, I see you’re a Madonna fan…”<br />

and attached a photograph of Mr. <strong>Elliott</strong>’s tweet wherein he had asked Madonna<br />

to “hook up” after Madonna’s Toronto performance that evening. It is<br />

respectfully submitted that Ms. Reilly’s open taunt of Mr. <strong>Elliott</strong> again<br />

demonstrated that she was not fearful of Mr. <strong>Elliott</strong> on September 12 th .<br />

<strong>15</strong>5. On September 13, 2012, Ms. Reilly tweeted the following, apparently in<br />

reference to the @GregurdyAerdiot parody account:<br />
