For the reasons stated above, the Court holds that<br />

Plaintiff has not introduced sufficient evidence, beyond<br />

pure speculation and conjecture, to establish a [*98]<br />

triable issue of fact regarding Defendants' access to<br />

Plaintiff's screenplay. Additionally, even assuming<br />

arguendo that there is a triable issue regarding access, no<br />

reasonable jury could conclude that Karma! and Earl are<br />

substantially similar. For these reasons, the Court<br />

GRANTS Defendants' Motions for Summary Judgment.<br />
