COMMENTARY<br />

Investigati<strong>on</strong>s<br />

36. Officers of <strong>the</strong> Corrupti<strong>on</strong> Preventi<strong>on</strong> Divisi<strong>on</strong> are attached to most ICAC<br />

investigati<strong>on</strong>s to identify processes, structures, human factors, external<br />

influences and possible legislative issues that are c<strong>on</strong>ducive to corrupt behaviour.<br />

Investigati<strong>on</strong> reports made by <strong>the</strong> ICAC may include corrupti<strong>on</strong> preventi<strong>on</strong><br />

recommendati<strong>on</strong>s, where agencies which are <strong>the</strong> subject of corrupti<strong>on</strong><br />

preventi<strong>on</strong> recommendati<strong>on</strong>s are required to inform <strong>the</strong> ICAC of any plan to<br />

resp<strong>on</strong>d to <strong>the</strong> recommendati<strong>on</strong>s. In <strong>the</strong> 2013-2014 reporting period, 72 per<br />

cent of corrupti<strong>on</strong> preventi<strong>on</strong> recommendati<strong>on</strong>s made to agencies were fully<br />

implemented. 18<br />

37. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> asked whe<strong>the</strong>r <strong>the</strong> ICAC c<strong>on</strong>sidered it had sufficient powers to<br />

ensure implementati<strong>on</strong>, given <strong>on</strong>ly 72 per cent of corrupti<strong>on</strong> preventi<strong>on</strong><br />

recommendati<strong>on</strong>s were fully implemented. The ICAC c<strong>on</strong>siders its current<br />

powers are adequate:<br />

Sector-wide projects<br />

...The ICAC has significant soft power around <strong>the</strong> implementati<strong>on</strong> of<br />

recommendati<strong>on</strong>s. The failure to implement is transparently displayed <strong>on</strong> <strong>the</strong> ICAC<br />

website and in <strong>the</strong> annual report, leaving n<strong>on</strong>-compliant agencies facing public<br />

pressure to explain.<br />

Should <strong>the</strong>re be intransigence, an escalati<strong>on</strong> protocol is in place in which ultimately<br />

<strong>the</strong> Minister is advised, again creating pressure <strong>on</strong> <strong>the</strong> agency to act. The escalati<strong>on</strong><br />

protocol has not been invoked within recent times. This soft power is generally<br />

c<strong>on</strong>sidered appropriate and adequate, <strong>the</strong> 2013-2014 figures aside, and preferable<br />

to <strong>the</strong> use of legislated powers. 19<br />

38. The Corrupti<strong>on</strong> Preventi<strong>on</strong> Divisi<strong>on</strong> identifies and analyses corrupti<strong>on</strong> risks of<br />

sector-wide significance, to make corrupti<strong>on</strong> preventi<strong>on</strong> recommendati<strong>on</strong>s to<br />

Government. In <strong>the</strong> 2013-2014 reporting period <strong>the</strong> Divisi<strong>on</strong> published sectorwide<br />

reports <strong>on</strong> IT c<strong>on</strong>tractors and <strong>the</strong> coal allocati<strong>on</strong> and approval system. The<br />

Divisi<strong>on</strong> also c<strong>on</strong>ducted a community attitude survey and commenced work <strong>on</strong><br />

sector-wide projects examining invoice payments, facilities maintenance and<br />

employment screening.<br />

39. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> notes that <strong>the</strong> ICAC selects subjects for sector-wide corrupti<strong>on</strong><br />

preventi<strong>on</strong> projects <strong>on</strong> <strong>the</strong> basis of <strong>the</strong> degree of public c<strong>on</strong>cern and <strong>the</strong> extent<br />

of corrupti<strong>on</strong> risk. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> asked how <strong>the</strong> Divisi<strong>on</strong> measured public<br />

c<strong>on</strong>cern and whe<strong>the</strong>r <strong>the</strong> results of <strong>the</strong> community attitude survey played a part<br />

in selecting subjects. The ICAC resp<strong>on</strong>ded that <strong>the</strong> c<strong>on</strong>tinuous c<strong>on</strong>tact between<br />

staff of <strong>the</strong> Divisi<strong>on</strong> and <strong>the</strong> public, suppliers and public officials informed its<br />

understanding of issues of importance:<br />

The staff of <strong>the</strong> Divisi<strong>on</strong>, including <strong>the</strong> ED, have extensive and c<strong>on</strong>tinuous c<strong>on</strong>tact<br />

with <strong>the</strong> public, suppliers to government and public officials through training,<br />

speaking, outreach, investigati<strong>on</strong>s, advice, and through <strong>the</strong> assessment of matters<br />

reported to <strong>the</strong> Commissi<strong>on</strong>. These many points of c<strong>on</strong>tact that occur annually allow<br />
