COMMITTEE ON THE INDEPENDENT COMMISSION AGAINST CORRUPTION<br />

COMMENTARY<br />

(c) to examine each annual and o<strong>the</strong>r report of <strong>the</strong> Commissi<strong>on</strong> and of <strong>the</strong> Inspector<br />

and report to both Houses of Parliament <strong>on</strong> any matter appearing in, or arising out<br />

of, any such report,<br />

(d) to examine trends and changes in corrupt c<strong>on</strong>duct, and practices and methods<br />

relating to corrupt c<strong>on</strong>duct, and report to both Houses of Parliament any change<br />

which <strong>the</strong> Joint <str<strong>on</strong>g>Committee</str<strong>on</strong>g> thinks desirable to <strong>the</strong> functi<strong>on</strong>s, structures and<br />

procedures of <strong>the</strong> Commissi<strong>on</strong> and <strong>the</strong> Inspector,<br />

(e) to inquire into any questi<strong>on</strong> in c<strong>on</strong>necti<strong>on</strong> with its functi<strong>on</strong>s which is referred to<br />

it by both Houses of Parliament, and report to both Houses <strong>on</strong> that questi<strong>on</strong>.<br />

109. Secti<strong>on</strong> 64(2) of <strong>the</strong> ICAC Act prevents <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> from investigating<br />

particular c<strong>on</strong>duct, or rec<strong>on</strong>sidering <strong>the</strong> ICAC’s decisi<strong>on</strong>s, findings or<br />

recommendati<strong>on</strong>s about particular complaints or investigati<strong>on</strong>s:<br />

(2) Nothing in this Part authorises <strong>the</strong> Joint <str<strong>on</strong>g>Committee</str<strong>on</strong>g>:<br />

(a) to investigate a matter relating to particular c<strong>on</strong>duct, or<br />

(b) to rec<strong>on</strong>sider a decisi<strong>on</strong> to investigate, not to investigate or to disc<strong>on</strong>tinue<br />

investigati<strong>on</strong> of a particular complaint, or<br />

(c) to rec<strong>on</strong>sider <strong>the</strong> findings, recommendati<strong>on</strong>s, determinati<strong>on</strong>s or o<strong>the</strong>r decisi<strong>on</strong>s<br />

of <strong>the</strong> Commissi<strong>on</strong> in relati<strong>on</strong> to a particular investigati<strong>on</strong> or complaint.<br />

110. In order to effectively c<strong>on</strong>duct its m<strong>on</strong>itoring and review role, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> is<br />

empowered to send for pers<strong>on</strong>s, papers and things (secti<strong>on</strong> 69 of <strong>the</strong> ICAC Act).<br />

Nati<strong>on</strong>al Crime Authority (NCA) model<br />

111. The legislative provisi<strong>on</strong>s for <strong>the</strong> ICAC <str<strong>on</strong>g>Committee</str<strong>on</strong>g> are closely modelled <strong>on</strong> <strong>the</strong><br />

provisi<strong>on</strong>s of <strong>the</strong> Comm<strong>on</strong>wealth Nati<strong>on</strong>al Crime Authority Act 1984, which<br />

provided for a joint oversight committee to m<strong>on</strong>itor <strong>the</strong> NCA. 64 The NCA was a<br />

federal law enforcement agency established to investigate serious and organised<br />

crime. The NCA had extensive covert and coercive powers and secrecy provisi<strong>on</strong>s<br />

to c<strong>on</strong>duct investigati<strong>on</strong>s; however it had no prosecutorial functi<strong>on</strong>. Informati<strong>on</strong><br />

ga<strong>the</strong>red by <strong>the</strong> NCA was handed to bodies such as <strong>the</strong> Australian Federal Police,<br />

Australian Tax Office or Customs. The NCA was superseded by <strong>the</strong> Australian<br />

Crime Commissi<strong>on</strong> in 2003.<br />

112. The NCA <str<strong>on</strong>g>Committee</str<strong>on</strong>g> was established to ‘m<strong>on</strong>itor and review <strong>the</strong> performance by<br />

<strong>the</strong> NCA of its functi<strong>on</strong>s and to report to both Houses of Parliament up<strong>on</strong> any<br />

matter appertaining to <strong>the</strong> Authority or any change which <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> thinks<br />

desirable to <strong>the</strong> functi<strong>on</strong>s, structure, powers and procedures of <strong>the</strong> Authority.’ 65<br />

113. In <strong>the</strong> early years of its operati<strong>on</strong>, <strong>the</strong> NCA <str<strong>on</strong>g>Committee</str<strong>on</strong>g> found it was unable to<br />

adequately fulfil its m<strong>on</strong>itoring and review functi<strong>on</strong>s because it could not obtain<br />

sufficient informati<strong>on</strong> from <strong>the</strong> NCA. The NCA <str<strong>on</strong>g>Committee</str<strong>on</strong>g> went as far as<br />
