COMMENTARY<br />

The Telecommunicati<strong>on</strong>s (Intercepti<strong>on</strong> and Access) Act 1979 (Cth)<br />

80. The ability of <strong>the</strong> Inspector to fully perform this audit functi<strong>on</strong> is hampered by<br />

<strong>the</strong> provisi<strong>on</strong>s governing access to telecommunicati<strong>on</strong> intercepti<strong>on</strong> material held<br />

by <strong>the</strong> ICAC, set out in <strong>the</strong> Telecommunicati<strong>on</strong>s (Intercepti<strong>on</strong> and Access) Act<br />

1979 (Cth) (<strong>the</strong> TIA Act). The TIA Act empowers law enforcement and integrity<br />

agencies such as <strong>the</strong> ICAC to apply for telecommunicati<strong>on</strong>s intercepti<strong>on</strong> warrants<br />

where <strong>the</strong>y believe a warrant would assist in <strong>the</strong> investigati<strong>on</strong> of a serious<br />

offence. 47 Warranted access may apply to communicati<strong>on</strong>s passing across<br />

telecommunicati<strong>on</strong> services and stored telecommunicati<strong>on</strong> c<strong>on</strong>tent.<br />

81. The TIA Act provides for m<strong>on</strong>itoring of law enforcement and integrity agencies’<br />

applicati<strong>on</strong> for, and use of, intercepti<strong>on</strong> material through <strong>the</strong> Comm<strong>on</strong>wealth<br />

Ombudsman and <strong>the</strong> Ombudsman of each state. The Ombudsman is required to<br />

check whe<strong>the</strong>r <strong>the</strong> agency has complied with <strong>the</strong> record keeping requirements of<br />

<strong>the</strong> TIA Act, including <strong>the</strong> accurate documentati<strong>on</strong> of <strong>the</strong> issue of warrants, and<br />

how <strong>the</strong> informati<strong>on</strong> ga<strong>the</strong>red was used. Records must be inspected at least<br />

twice a year, and a report of <strong>the</strong> inspecti<strong>on</strong>s made annually. 48<br />

82. The Ombudsman’s role in examining compliance with record keeping<br />

requirements does not extend to assessing whe<strong>the</strong>r <strong>the</strong> law enforcement or<br />

integrity agency is exercising its coercive and covert powers appropriately. This is<br />

<strong>the</strong> Inspector’s role. 49 Despite this, <strong>the</strong> Inspector has <strong>on</strong>ly very limited authority<br />

under <strong>the</strong> TIA Act to inspect telecommunicati<strong>on</strong>s intercepti<strong>on</strong> material possessed<br />

by <strong>the</strong> ICAC for <strong>the</strong> purpose of assessing whe<strong>the</strong>r <strong>the</strong> ICAC is exercising its powers<br />

appropriately.<br />

83. The issue of access to intercepti<strong>on</strong> material has been a matter of c<strong>on</strong>cern since<br />

<strong>the</strong> establishment of <strong>the</strong> Inspectorate. In 2000, <strong>the</strong> ICAC <str<strong>on</strong>g>Committee</str<strong>on</strong>g>, when<br />

recommending <strong>the</strong> establishment of <strong>the</strong> Inspector of <strong>the</strong> ICAC, recognised that<br />

unimpeded access to telecommunicati<strong>on</strong>s intercepti<strong>on</strong> material was necessary to<br />

ensure that <strong>the</strong> Inspector was able to assess <strong>the</strong> legality and propriety of <strong>the</strong><br />

ICAC’s procedures and m<strong>on</strong>itor its compliance with <strong>the</strong> law:<br />

The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> is aware that <strong>the</strong> Comm<strong>on</strong>wealth legislati<strong>on</strong> governing <strong>the</strong><br />

transmissi<strong>on</strong> of legally acquired telecommunicati<strong>on</strong>s intercept product currently<br />

would prevent <strong>the</strong> proposed Inspector from accessing any ICAC records that c<strong>on</strong>tain<br />

TI product. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>sequently notes that amendments will need to be<br />

made to <strong>the</strong> Comm<strong>on</strong>wealth Telecommunicati<strong>on</strong>s (Intercepti<strong>on</strong>) Act 1979 if <strong>the</strong><br />

Inspector’s access to ICAC records is to be uninhibited. Advice to this effect will be<br />

provided to <strong>the</strong> New South Wales Attorney General. 50<br />

84. The <strong>the</strong>n <str<strong>on</strong>g>Committee</str<strong>on</strong>g> recommended that <strong>the</strong> Inspector of <strong>the</strong> ICAC be included as<br />

an authorised recipient of telecommunicati<strong>on</strong>s product; this recommendati<strong>on</strong><br />
