articulated by <strong>the</strong> former Inspector’s staff indicating that <strong>the</strong>y, (<strong>the</strong> complainants),<br />

would receive some form of attenti<strong>on</strong> and satisfacti<strong>on</strong>. 39<br />

70. Of <strong>the</strong> 16 complaints received in <strong>the</strong> vacancy period, <strong>on</strong>e was outside <strong>the</strong><br />

jurisdicti<strong>on</strong> of <strong>the</strong> Inspector, <strong>on</strong>e was withdrawn, six were not sustained and<br />

eight were carried over to <strong>the</strong> 2014-2015 reporting period. 40 The Inspector noted<br />

in his report that a great deal of time and resources had been occupied in<br />

resolving complaints received during <strong>the</strong> vacancy period, which were of ‘arguable<br />

validity’. 41<br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> comment<br />

71. The Inspector c<strong>on</strong>ducts a vital oversight role to ensure that <strong>the</strong> ICAC’s extensive<br />

covert and coercive powers are properly exercised and adequately scrutinised.<br />

While <strong>the</strong> Inspector has been assured that <strong>the</strong>re are fur<strong>the</strong>r resources available<br />

should he require <strong>the</strong>m, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> is c<strong>on</strong>cerned that <strong>the</strong> Inspector<br />

requested <strong>the</strong> appointment of an Assistant Inspector prior to meeting with <strong>the</strong><br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> <strong>on</strong> 7 August 2015 yet <strong>the</strong> appointment was <strong>on</strong>ly finalised in February<br />

2016.<br />

72. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>siders that for <strong>the</strong> Inspector to perform his oversight role<br />

effectively, adequate resources, including staff, are essential. Recruitment should<br />

take place in a timely fashi<strong>on</strong>. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>siders it is unacceptable that,<br />

in a period when <strong>the</strong> Inspector received an unprecedented volume of complaints,<br />

<strong>the</strong>re were delays in <strong>the</strong> appointment of an Assistant Inspector.<br />

73. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> was pleased to hear that <strong>the</strong> simultaneous discharge of duties of<br />

both Inspector of <strong>the</strong> ICAC and Inspector of <strong>the</strong> PIC is working well.<br />

74. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> also c<strong>on</strong>siders it unacceptable that <strong>the</strong>re was a period of vacancy<br />

in <strong>the</strong> positi<strong>on</strong> of <strong>the</strong> Inspector from October 2013 to February 2014. Fur<strong>the</strong>r,<br />

<strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>siders that it was unfortunate that Inspectorate staff<br />

c<strong>on</strong>ducted <strong>the</strong> Inspector’s complaint handling functi<strong>on</strong> in this period. The<br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> agrees with <strong>the</strong> Inspector that, given <strong>the</strong> fixed terms of appointment<br />

for Inspectors, <strong>the</strong>re was ample opportunity for <strong>the</strong> timely appointment of <strong>the</strong><br />

new Inspector, avoiding any vacancy period and <strong>the</strong> potential for pers<strong>on</strong>s o<strong>the</strong>r<br />

than <strong>the</strong> Inspector to take <strong>on</strong> this statutory role.<br />

75. The ICAC Act makes provisi<strong>on</strong> for a pers<strong>on</strong> to be appointed as an Acting<br />

Inspector, who would have all <strong>the</strong> functi<strong>on</strong>s of <strong>the</strong> Inspector. 42 The appointment<br />

of an Acting Inspector should take place if an unavoidable vacancy in <strong>the</strong> Office of<br />

<strong>the</strong> Inspector arises in future. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> makes <strong>the</strong> following<br />

recommendati<strong>on</strong>.<br />
