COMMENTARY<br />

This advice c<strong>on</strong>cluded that <strong>the</strong> TIA Act would enable <strong>the</strong> Commissi<strong>on</strong> to provide <strong>the</strong><br />

Inspector with applicati<strong>on</strong>s for telecommunicati<strong>on</strong>s intercepti<strong>on</strong> warrants where<br />

<strong>the</strong>re is a targeted inspecti<strong>on</strong> into an allegati<strong>on</strong> of misc<strong>on</strong>duct or corrupti<strong>on</strong> but not<br />

for undertaking a general audit to ascertain if misc<strong>on</strong>duct had occurred. 53<br />

89. The <strong>the</strong>n ICAC <str<strong>on</strong>g>Committee</str<strong>on</strong>g> supported <strong>the</strong> <strong>the</strong>n Inspector in seeking amendments<br />

to <strong>the</strong> TIA Act to enable access to telecommunicati<strong>on</strong>s intercepti<strong>on</strong> material for<br />

audit purposes. 54 The <strong>the</strong>n Commissi<strong>on</strong>er also expressed support for <strong>the</strong><br />

Inspector’s proposed amendments:<br />

The important functi<strong>on</strong> of <strong>the</strong> Inspector is to ensure that people in <strong>the</strong> organisati<strong>on</strong><br />

do not abuse <strong>the</strong> power <strong>the</strong>y have to tap ph<strong>on</strong>es and to put surveillance devices <strong>on</strong><br />

people so that members of <strong>the</strong> public have c<strong>on</strong>fidence we are not doing it. … So far<br />

as I am c<strong>on</strong>cerned, any possible inhibiti<strong>on</strong> in this legislati<strong>on</strong> to <strong>the</strong> Inspector would<br />

get my support if it were removed. 55<br />

90. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> understands that access to telecommunicati<strong>on</strong>s intercepti<strong>on</strong><br />

material for oversight purposes is also an issue for <strong>the</strong> Inspector in his role as<br />

Inspector of <strong>the</strong> Police Integrity Commissi<strong>on</strong> and an issue for inspectors of law<br />

enforcement and integrity bodies in o<strong>the</strong>r States:<br />

I recently met with some inspectors or occupants of cognate offices from Western<br />

Australia, Queensland and Victoria, who all have <strong>the</strong> same problem, and we<br />

discussed it. 56<br />

91. The Inspector made a submissi<strong>on</strong> to <strong>the</strong> recent Comm<strong>on</strong>wealth Legal and<br />

C<strong>on</strong>stituti<strong>on</strong>al Affairs References <str<strong>on</strong>g>Committee</str<strong>on</strong>g> inquiry into comprehensive revisi<strong>on</strong><br />

of <strong>the</strong> TIA Act in relati<strong>on</strong> to this issue, submitting that <strong>the</strong> inability to access all<br />

records held by <strong>the</strong> ICAC means that <strong>the</strong> Inspector is not fully able to perform his<br />

or her statutory functi<strong>on</strong>s:<br />

The current positi<strong>on</strong> is <strong>the</strong>refore that <strong>the</strong> Inspector (of <strong>the</strong> ICAC) is unable to fully<br />

perform his or her statutory functi<strong>on</strong>s. In particular, in performance of <strong>the</strong><br />

Inspector’s audit functi<strong>on</strong>, he or she may wish to assess <strong>the</strong> legality and propriety of<br />

<strong>the</strong> ICAC’s reliance <strong>on</strong> teleph<strong>on</strong>e intercepts in fur<strong>the</strong>rance of its investigati<strong>on</strong>s and in<br />

order to do so, may need to access <strong>the</strong> intercepted informati<strong>on</strong> obtained under<br />

warrant. A warrant and intercepti<strong>on</strong> under <strong>the</strong> TIA Act could proceed for purposes<br />

not appropriate to <strong>the</strong> objectives of <strong>the</strong> ICAC but ra<strong>the</strong>r, for improper purposes. It is<br />

for this reas<strong>on</strong> that <strong>the</strong> Inspector has been given <strong>the</strong> powers of audit. However, <strong>the</strong><br />

current form of <strong>the</strong> TIA Act is said to prevent <strong>the</strong> Inspector from accessing such<br />
