COMMENTARY<br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong>s<br />

140. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> has broad and expansive powers to oversight <strong>the</strong> ICAC and will<br />

use <strong>the</strong>m robustly to m<strong>on</strong>itor and review <strong>the</strong> exercise by <strong>the</strong> ICAC of its functi<strong>on</strong>s.<br />

141. While <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> acknowledges <strong>the</strong> c<strong>on</strong>straints imposed by secti<strong>on</strong> 64(2) of<br />

<strong>the</strong> ICAC Act <strong>on</strong> its m<strong>on</strong>itoring and review role, it is c<strong>on</strong>cerned that, narrowly<br />

interpreted and applied, secti<strong>on</strong> 64(2) of <strong>the</strong> ICAC Act may c<strong>on</strong>strain <strong>the</strong><br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> from properly exercising its statutory functi<strong>on</strong>s.<br />

142. The ICAC Act allows <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> to ask questi<strong>on</strong>s relating to particular<br />

c<strong>on</strong>duct or investigati<strong>on</strong>s in undertaking its oversight role, where such questi<strong>on</strong>s<br />

are for <strong>the</strong> purpose of m<strong>on</strong>itoring and reviewing <strong>the</strong> way in which <strong>the</strong> ICAC<br />

c<strong>on</strong>ducts its functi<strong>on</strong>s. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> does not c<strong>on</strong>sider it appropriate to<br />

questi<strong>on</strong> <strong>the</strong> ICAC <strong>on</strong> matters that are currently under investigati<strong>on</strong> or in cases<br />

where findings have not yet been made. However, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> is not similarly<br />

limited with regard to matters that have c<strong>on</strong>cluded.<br />

143. In reviewing <strong>the</strong> operati<strong>on</strong>al processes underpinning c<strong>on</strong>cluded ICAC findings and<br />

determinati<strong>on</strong>s, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g>’s work complements that of <strong>the</strong> Inspector, who<br />

can examine current matters and investigate individual complaints. The<br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> fully endorses <strong>the</strong> role of <strong>the</strong> Inspector in examining matters that are<br />

currently <strong>the</strong> subject of investigati<strong>on</strong> by <strong>the</strong> ICAC, resp<strong>on</strong>ding to individual<br />

complaints and undertaking audits and investigati<strong>on</strong>s to ensure that <strong>the</strong> ICAC<br />

complies with <strong>the</strong> law.<br />

144. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> acknowledges that questi<strong>on</strong>ing <strong>the</strong> ICAC <strong>on</strong> historic cases as part<br />

of its m<strong>on</strong>itoring and review role may lead to a degree of tensi<strong>on</strong> between <strong>the</strong><br />

<str<strong>on</strong>g>Committee</str<strong>on</strong>g> and <strong>the</strong> ICAC. However, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> c<strong>on</strong>siders that this is a<br />

legitimate outcome when acting to ensure <strong>the</strong> accountability of <strong>the</strong> ICAC.<br />
