Conversely, the share of the complaints against institutions has been increasing. This is one of the<br />
positive aspects of dealing of fraud and deception issues related to foreign employment.<br />

Table 4.12 shows the number of complaints handled by the DoFE in the FY 2013/14 and 204/15.<br />
Data reveal that relatively large number of complaints was registered in FY 2014/15 compared to the<br />
previous fiscal year. It is revealed that very few numbers of cases against institutions are forwarded<br />
to the Foreign Employment Tribunal (FET) compared to the cases against individuals.<br />

Registration of Cases at the Foreign Employment Tribunal (FET)<br />
Section 64 of FEA 2007 allows the FET to deal with the cases related to foreign employment. Cases<br />
must be filed at the tribunal by a DoFE investigation officer. Cases cannot be directly registered by a<br />
worker with the tribunal (Section 61(4)) – thus all the cases before the tribunal are ‘state cases’<br />
(Section 63). Therefore, before deciding to file a case in the tribunal, the investigation officer must<br />
obtain advice of the government attorney (Section 61(4)).<br />
The FET initiated its work since the FY 2009/10. Accodingly, the six-yearly (2009/10-2014/15)<br />
average case disposal ratio of FET is 36.7 with low in the FY 2009/10. It is also reported that by the<br />
end of FY 2014/15, there were 206 cases remained as pending in the FET. Of them, 35 are of within<br />
one-year, 27 with one-year and 18 months, 14 with 18 months to 2 years and 30 with 2 years and<br />
more.<br />
