unlock 30 million tonnes of hydrocarbon<br />

treasure worth Rs 70,000<br />

crore as part of the government’s<br />

efforts to reduce India’s import dependence<br />

by 10% by 2022.<br />

This is the first oilfield sale under<br />

a transparent, straight-forward<br />

revenue-sharing fiscal model<br />

instead of the production-sharing<br />

regime in vogue till now. As an<br />

icing, the discoveries are being<br />

offered without any marketing or<br />

pricing restriction on explorers —<br />

an issue that had inhibited investors<br />

and dogged several contracts<br />

for fields auctioned till now under<br />

the profit-sharing dominion.<br />

The government had in September<br />

last year decided to move away<br />

from production-sharing model to<br />

make it simpler for explorers to do<br />

business. It subsequently extended<br />

the fiscal model for auctioning<br />

spillover effect from China’s<br />

economy to other<br />

countries, including India.<br />

production due to remote location<br />

or small size as well as pricing and<br />

marketing restrictions. Pradhan<br />

said ONGC and OIL would be free<br />

to bid for the discoveries, which<br />

had been made between five and<br />

30 years back. The auction comes<br />

at a time when global oil and gas<br />

prices have plunged, forcing explorers<br />

to cut back on capital expenditure.<br />

But AtanuChakraborty, who<br />

took over as the head of Directorate<br />

General of Hydrocarbons,<br />

which acts as the sectoral regulator,<br />

said it was the ideal time to<br />

offer the auction as it would take<br />

about three years to start production,<br />

by which time oil and gas<br />

prices are projected to soar up.<br />

Bankruptcy law positive for banks<br />

in India: Moody’s<br />

Global credit rating agency<br />

Moody’s Investors Service on Thursday<br />

stated that India’s bankruptcy<br />

code boosts creditors bargaining<br />

power against big borrowers.<br />

On May 11, Parliament passed the<br />

national bankruptcy law, the Insolvency<br />

and Bankruptcy Code, <strong>2016</strong>,<br />

which is now pending the President’s<br />

signature.<br />

“The current weak legal framework<br />

for asset resolution has been<br />

a key structural credit weakness for<br />

Indian banks,” SrikanthVadlamani,<br />

vice president and senior credit officer<br />

at Moody’s.<br />

“The proposed new rules address<br />

several key inefficiencies in the current<br />

resolution regime,” he said in<br />

his report `Banks-India: Bankruptcy<br />

Law is Credit Positive for Indian<br />

Banks, but Challenges Remain’.<br />

According to the report, the proposed<br />

bankruptcy law would; introduce<br />

a unified framework to replace<br />

the current collection of separate<br />

laws drafted in piecemeal fashion<br />

across overlapping jurisdictions;<br />

reduce threshold for creditors to<br />

invoke the insolvency resolution<br />

process (IRP); introduce third-party<br />

insolvency professionals (IP) as<br />

intermediaries to oversee the IRP,<br />

replacing the debtor’s existing management<br />

and operate the company<br />

as a going concern upon initiation<br />

of an IRP; give creditors overriding<br />

authority to approve terms of any<br />

restructuring package; and limit<br />

duration of IRP to maximum of <strong>27</strong>0<br />

days, after which a company will be<br />

automatically liquidated.<br />

These features are positive for<br />

Indian banks because they will act<br />

as an incentive for corporate borrowers<br />

to avoid loan default and<br />

improve the recovery of assets, the<br />

report said. In addition to increasing<br />

banks’ influence over the restructuring<br />

process, the mandated replacement<br />

of the existing management<br />

during the process should act as a<br />

key disincentive for debtors to default<br />

in the first place. Moreover, the<br />

limited timeframe strengthens the<br />

banks’ bargaining power over delinquent<br />

borrowers.<br />

However, Moody’s also said significant<br />

infrastructure restrictions<br />

have to be negotiated for the framework<br />

to be fully operational, including;<br />

development of the required<br />

infrastructure, required support<br />

and new restructuring procedure,<br />

particularly legal resources and information<br />

utilities; time required for<br />

various stakeholders to accumulate<br />

the requisite legal experience and<br />

precedents for the new system to<br />

be fully up and running; and limited<br />

impact that the new law may have<br />

on the liquidation process. The proposed<br />

law will have limited benefit<br />

in addressing the current asset quality<br />

issues facing Indian banks.<br />

“In particular, the banks will still<br />

have limited avenues available to<br />

dispose of distressed assets, and will<br />

in general remain reluctant to make<br />

appropriate haircuts to reflect their<br />

current weak operating conditions,”<br />

Sauté for a minute and add<br />

Shraddha Srinath, who surprised us all with her flawless<br />

performance in Pawan Kumar’s latest Kannada<br />

thriller U-Turn, will be seen alongside Nivin Pauly in his<br />

next Tamil film. It is slated to go on floors next month.<br />

Debutant director Gautham Ramachandran, after<br />

months of auditioning, zeroed in on Shraddha, as he felt<br />

she was apposite for the role of a crime reporter in the<br />

film. The tamil film is based on critically acclaimed Rakshit<br />

Shetty directed Ulidavaru Kandanthe.<br />

“Shraddha was one of the first girls I met during the<br />

auditions. Although I felt she seemed perfect for the role,<br />

we decided to audition a few more girls. Over the course<br />

of nearly five months, we auditioned several girls but nobody<br />

fit the role as convincingly as Shraddha,” Gautham,<br />

former assistant of filmmakers Mysskin and Rajeev Menon,<br />

told IANS.<br />

“The second time we met Shraddha; she came well<br />

prepared and had even memorised her lines. In the second<br />

audition, she just proved she was destined to do the<br />

role and we were convinced too,” he said.<br />

The film’s producers weren’t initially enthusiastic<br />

about the idea.<br />

“They wanted a familiar heroine and a few wellknown<br />

actresses were also interested to be part of the<br />

project. As a team when we saw Shraddha audition the<br />

second time, we were convinced she’d be ideal for the<br />

role. Nivin was very supportive with my decision.”<br />

Shraddha, a lawyer by profession, has already worked<br />

in two Kannada films and a Malayalam film prior to this.<br />

It is with U-Turn she stole the limelight and has caught<br />

the attention of filmmakers.<br />
