EDUCATION NEWS State Board considers changes to teacher evaluation regulations At the May 4 State Board of Education meeting, the N.J. Department of Education heard, at the first discussion level, revisions to N.J.A.C. 6A:10, Educator Effectiveness, state regulations around teacher evaluation, and N.J.A.C. 6A:9C, Professional Development. These revisions, if approved, would go into effect sometime in the fall of 2016. The major difference for NJEA members in the proposed language is in the number and duration of classroom observations. Tenured teachers would see the required number of observations changed from three to two. Nontenured teachers would still have three required observations, but the current combination of long and short observations would change. All observations would be required to be at least 20 minutes, meaning the mandated time of nontenured teachers’ observations would be half of what it was prior to TEACHNJ. Other staff members who are not teachers, such as school counselors, media specialists, and child study team members, would have observations with a minimum time of 20 minutes. In the prior regulations, there was no mention of time for this group. The proposed regulations allow for some flexibility for evaluation of those teachers with a highly effective rating in their most recent evaluation, although the proposal is vague as to what that flexibility would permit. The proposal refers to a list of acceptable activities that will be posted on the department website. Although the department reported to the State Board that teachers would have to agree to any deviations from classroom observations, that is not explicitly stated in the proposed regulations. Another set of changes deals with the deadlines for certain activities. The department proposes that Professional Development Plans (currently done with the annual review in the spring), Corrective Action Plans (currently required to be completed by Sept. 15) and Student Growth Objectives should all have a final due date of Oct. 31. There are a number of other changes in the regulations, including changes in the principal evaluation system, but those listed here are the ones with the most impact on NJEA members. This is the first step for the proposed changes. At its June 1 meeting—after press time for this edition of the NJEA Review—the board will consider the changes at the second discussion level. At that meeting, the board will take public testimony on the proposed changes. At its July 8 meeting, the board will vote to publish the proposed regulatory changes in the New Jersey Register at proposal level. There will then be a 60-day comment period and a public testimony session, followed by a board vote to publish the regulations in the New Jersey Register for adoption. Once they are published, the changes become law. Depending on the publication schedule of the New Jersey Register, the time from proposal to law can take up to four months. It is not unusual for changes to be made in regulations from first discussion to the final adoption of those regulations. NJEA staff are analyzing the changes in the regulations to determine any negative effects they could have on members, and will be testifying and lobbying through the summer to make any changes that are needed. WNYEA protests deplorable BOE proposal Yellow police tape lined the east side of 6028 Broadway in West New York where about 400 members of the West New York Education Association (WNYEA) lined the sidewalks. Led by WNYEA President Anita Kober, they marched to protest the $1,700,000 in budget cuts proposed by their board of education. Dressed in red and carrying signs that read, “School Employees Matter!” the group expressed its frustration over the school board’s failure to make a respectable proposal during negotiations. Rallygoers chanted under the watchful eye of police who were present to keep the peace and protect the crowd from the busy street a few steps away. Contract negotiations have stalled. Bargaining is headed into mediation after the association received a series of unreasonable proposals from the board of education. The board offered no salary increases, the elimination of longevity, no increase in extra curricular positions, and no movement on the salary guide. “Our contract expired June 30 of last year,” said Kober. “The board has told us that they have no money for a raise this year, next year, or the year after. Zero percent over three years is unacceptable! We have members who are potentially losing their homes. They are taking home less pay now then they did five years ago.” The association leadership and members plan to attend board meetings and community functions to inform the public about the crisis. WNYEA will continue to pressure the board of education to do the right thing for students and staff while advocating for a fair settlement.
