152. The laws of the <strong>Europe</strong>an S<strong>in</strong>gle Market would apply only to those goods and<br />

services traded between Scotland and the rest of the <strong>Europe</strong>an S<strong>in</strong>gle Market. For<br />

<strong>in</strong>stance, a manufacturer based <strong>in</strong> Scotland with customers throughout the<br />

rema<strong>in</strong>der of the UK would cont<strong>in</strong>ue to be able to trade freely. We see no reason<br />

why the pr<strong>in</strong>ciple of mutual recognition of standards should not cont<strong>in</strong>ue to apply<br />

under this proposal. If the manufacturer also conducts bus<strong>in</strong>ess with<strong>in</strong> the<br />

<strong>Europe</strong>an S<strong>in</strong>gle Market they would be required to cont<strong>in</strong>ue to demonstrate that<br />

their products complied with the requirements of relevant EU Directives and<br />

Regulations. In essence, this <strong>in</strong>volves apply<strong>in</strong>g the pr<strong>in</strong>ciple of “parallel<br />

marketability” 58 whereby goods and services orig<strong>in</strong>at<strong>in</strong>g <strong>in</strong> Scotland may be legally<br />

marketed <strong>in</strong> both the UK and the EEA.<br />

Imports from the <strong>Europe</strong>an S<strong>in</strong>gle Market<br />

153. Goods enter<strong>in</strong>g the UK from the <strong>Europe</strong>an S<strong>in</strong>gle Market would be subject to the<br />

import regulations appropriate to either jurisdiction (Scotland or the rema<strong>in</strong>der of<br />

the UK). The appropriate regulations would be determ<strong>in</strong>ed by the po<strong>in</strong>t at which<br />

the goods are to be sold.<br />

154. If the po<strong>in</strong>t of sale is Scotland, then there will be no tariff payable due to our EEA<br />

membership. If the goods are to be sold <strong>in</strong> the rema<strong>in</strong>der of the UK they will be<br />

subject to whatever regulations apply and tariff is payable under the rema<strong>in</strong>der of<br />

the UK’s arrangements with the s<strong>in</strong>gle market and/or EFTA states. To the extent<br />

that any import from the s<strong>in</strong>gle market is not covered by <strong>Scotland’s</strong> EEA<br />

membership then the relevant regulations and tariff under Scottish and/or rUK law<br />

(depend<strong>in</strong>g on the devolution settlement <strong>in</strong> place) will apply.<br />

155. When a consignment conta<strong>in</strong>s goods bound for sale <strong>in</strong> both Scotland and the<br />

rema<strong>in</strong>der of the UK, if there is no difference <strong>in</strong> the treatment of that good (for<br />

example, if it is tariff-free) between Scotland and the rema<strong>in</strong>der of the UK, then no<br />

additional process is required. Where there is a difference, on enter<strong>in</strong>g the UK the<br />

po<strong>in</strong>t of sale for the relevant proportion of the goods will need to be declared and<br />

the relevant tariff paid and regulations followed. If the po<strong>in</strong>t of sale is <strong>in</strong> the<br />

rema<strong>in</strong>der of the UK, then the UK-wide regulations and any UK tariff would apply.<br />

Exports to the <strong>Europe</strong>an S<strong>in</strong>gle Market<br />

156. Goods and services could also cont<strong>in</strong>ue to be exported from Scotland and the UK<br />

under different conditions when access<strong>in</strong>g the <strong>Europe</strong>an S<strong>in</strong>gle Market. Goods and<br />

services produced <strong>in</strong> Scotland, and comply<strong>in</strong>g with all relevant EU regulations,<br />

would be exported freely to the <strong>Europe</strong>an S<strong>in</strong>gle Market, whilst those from<br />

elsewhere <strong>in</strong> the UK would be required to comply with the terms of the UK’s new<br />

trad<strong>in</strong>g relationship with the EU.<br />
