The African Charter on the Welfare and Rights of the Child obliges States <strong>to</strong> take “all<br />

appropriate measures <strong>to</strong> ensure that a child who is subjected <strong>to</strong> school or parental discipline<br />

shall be treated with humanity and with respect for the inherent dignity of the child.” 100<br />

The UN special rapporteur on <strong>to</strong>rture, and other cruel, inhuman or degrading treatment or<br />

punishment has warned states that corporal punishment is inconsistent with<br />

governments’ obligations <strong>to</strong> protect individuals from cruel, inhuman, or degrading<br />

punishment or even <strong>to</strong>rture. 101 The international prohibition of <strong>to</strong>rture and other cruel,<br />

inhuman or degrading treatment or punishment, relates not only <strong>to</strong> acts that cause<br />

physical pain but also <strong>to</strong> acts that cause mental suffering <strong>to</strong> the victim. 102 Children and<br />

pupils in teaching institutions should be protected from corporal punishment, “including<br />

excessive chastisement ordered as … an educative or disciplinary measure.” 103<br />

In 2011, the African Committee of Experts on the Rights and Welfare of the Child urged all<br />

African states <strong>to</strong> adopt measures <strong>to</strong> eliminate violence in schools. 104 In 2015, the<br />

Committee on the Rights of the Child and the East African Community Legislative Assembly<br />

called upon the government <strong>to</strong> end corporal punishment in schools, and repeal or amend<br />

legislation <strong>to</strong> prohibit corporal and physical punishment in all settings. 105<br />
