In certain circumstances you may be able to obtain a divorce or dissolution of a civil partnership using a simplified procedure – a “do-it-yourself” method. This is a cheap and simple method and you do not have to instruct and pay for a solicitor although outlays of £113 require to be paid to the court. If you prefer to instruct a solicitor their charges for this should be relatively cheap. To proceed under this basis the marriage must have broken down irretrievably or you or your spouse/civil partner have been issued with an interim gender recognition certificate. You must have been separated for at least a continuous period of one year and your spouse / civil partner will consent to the divorce / dissolution or you have been separated for at least a continuous period of two years whereby no consent is required. There must also be no financial claim, no children under sixteen years of age and the divorce / dissolution must be uncontested. Accordingly before applying for divorce / dissolution under this procedure, if you are basing it on your separation for one year, check that your spouse civil partner will consent. Also while you may not intend to pursue a financial claim, your spouse / civil partner may. If this happened the action could not proceed under the simplified procedure and would have to be pursued under the ordinary court procedure which is complicated and warrants the cost of a solicitor being involved. Please beware that once divorce is granted any right to make a financial claim is terminated. It is always advisable before you proceed with divorce to consult a specialist family law solicitor for advice.
