Alvan Stewart (1790-1849), a New York lawyer advocated the radical theory that the
Constitution was fundamentally antislavery. He believed that the Fifth Amendment
gave the federal government the power to end slavery anywhere in the nation. In 1845
Stewart tried to apply his theories to the New Jersey Constitution, but the supreme
court of that state, in State v. Van Beuren and State v. Post, rejected his arguments
