Alvan Stewart (1790-1849), a New York lawyer advocated the radical theory that the<br />

Constitution was fundamentally antislavery. He believed that the Fifth Amendment<br />

gave the federal government the power to end slavery anywhere in the nation. In 1845<br />

Stewart tried to apply his theories to the New Jersey Constitution, but the supreme<br />

court of that state, in State v. Van Beuren and State v. Post, rejected his arguments<br />
