What’s happening in Yaldhurst?<br />

Plenty of noise, a plethora of<br />

new quarries in a rural zone, a<br />

plethora of industrial activity in a<br />

rural zone and plenty of stressed<br />

residents.<br />

The root of the problem is a<br />

succession of district plans with<br />

extremely permissive rules. There<br />

are always consequences. While<br />

the buzz word in the city is rebuild<br />

and regenerate out on the fringes<br />

of the city it is denigrate.<br />

City council acting head of<br />

resource consents John Gibson<br />

said “the city council was aware of<br />

concerns in the area and sought to<br />

address them through a planning<br />

and legal framework.”<br />

Can he not comprehend that is<br />

precisely what caused the problem,<br />

a dysfunctional Resource<br />

Management Act. Historically the<br />

Resource Management Act looks<br />

at every application in isolation,<br />

in an ad hoc laissez faire style<br />

and doesn’t appear to take into<br />

account the cumulative effects of<br />

an activity.<br />

That is until the recent environment<br />

court decision by Judge<br />

Borthwick in Harewood Gravels,<br />

city council versus Joint Action<br />

Group. The application for resource<br />

consent has been declined.<br />

In this case Judge Borthwick<br />

considered the cumulative effects<br />

of the 300ha already consented<br />

with the current application and<br />

the absence of any specific study to<br />

determine the level of quarrying<br />

which is acceptable within this zone.<br />

As an aside the court acknowledged<br />

the impact on residents of<br />

the development of quarrying in<br />

this area and their felt sense of<br />

frustration, at times, helplessness,<br />

when responding to the applications<br />

in respect of which they were<br />

notified and their efforts to ‘police’<br />

the compliance by neighbouring<br />

quarries with the conditions of<br />

their consents.<br />

Harewood Gravels has now appealed<br />

to the High Court.<br />

The city council and Environment<br />

Canterbury’s lack of action<br />

is akin to “Caesar fiddling while<br />

Rome burns.”<br />
