Ageing infrastructure blamed for outages
ANDISA BONANI and
PILANATHI RASMENI
W
HILE the Enoch
Mgijima Local
Municipalit y
(EMLM) has
indicated it is exploring plans
to fix the ageing infrastructure
of Komani, businesses and
residents were this week
counting the costs of a lengthy
power outage last week.
Water cuts accompanied the
blackout, which started last
Wednesday, due to the
inability to pump water, but a
generator was brought in to
assist with the supply. Some
remained without water long
after the power had been
restored to most areas on
Saturday morning.
The power outage came at
the worst possible time –
month-end – for retailers and
business owners.
AKM Foods managing
director Nashid Dosa said one
KFC store in town had
managed to operate
intermittently with the use of a
g e n e r at o r.
“The outage has resulted in
a loss of sales, as well as a
large quantity of frozen stock.
When municipal services are
functioning well, it is great for
business and the community.
We hope the power and water
issues in Komani will be
resolved permanently so that
we are able to function at full
capacity and serve our
c u st o m e r s . ”
Water Zone owner Gail
Lieberum said stock was sold
out as customers filed in to
buy drinking water, which was
beneficial for the business but
not for the town.
“The electricity outage
affected us immensely
because we could not purify
more water as the machines
need electricity to function.
Luckily we had full tanks of
purified water so we could
supply the water. We are a
little behind with purifying at
present and hope the
municipality will sort out
the electricity issues.”
Border-Kei Chamber of
Business chairwoman Adré
Bartis, who kept residents
updated about the outages
and progress on work via
social media throughout
the process, said many
businesses had been hit hard.
“Businesses like Twizza and
petrol stations lost a lot of
revenue due to the outages.
One filling station had to turn
away buses which passengers
usually used their ablution
facilities. SUPERSPAR had to
use 10000 litres of diesel for
generators which was a big
loss. Hopefully the
municipality will use this as a
learning curve and sort it out
before the whole infrastructure
stops working.”
The outage had a
devastating impact on other
services. South African Social
Security Agency (Sassa)
communications officer
Sinoxolo Gqala said the cut in
electricity affected the
rendering of services by the
government entity.
“The office could not
function to full capacity as
computers and printers were
not working. These outages
have a negative impact on our
daily functions. Sassa officials
and beneficiaries could not
use ablution facilities and had
no drinking water, a basic
human right. The office
management had to release
officials as they waited for the
restoration of power which
The municipality kept people
informed via social media. We are
awaiting a R6-million injection
took longer than estimated.”
Resident Luvuyo Giwu from
Phelandaba Extension said his
area had been without water
long before the electricity
outage. This had been
reported, but without a
response.
“We initially did not even
get water from the municipal
tankers, but after the power
outage, they came. This water
will not help us much because
we have been told not to
consume it as it is unsafe.
What is the point of bringing
water that cannot be used to
cook or drink?”
On Monday, a T-switch at
the corner of Robinson Road
and Joubert Street which
supplies electricity to
Westbourne and surrounding
areas, blew.
A municipal worker on site,
who did not want to be
identified, said such incidents
would be common as the
transformers had not been
replaced for more than a
decade.
EMLM spokesman Fundile
Feketshane said the electrical
network faced challenges, but
repairs were being done.
“The continuous breakdown
of substations is caused by
ageing electricity
infrastructure and plans to
have this fixed are under
way. Plans to fix the
Queendustria network are
looming as we are waiting
for confirmation of a
R6-million cash injection.”
Feketshane said the
municipality had updated
people via social media on
what was happening.
“Chris Hani District
Municipality was approached
to provide water tanks to
various wards and we thank
our communities for their
patience and support. We
apologise for the damage. The
electrical department is busy
with its maintenance
programme so as to avoid the
outages going forward and if
there is any planned
disruption, we shall make
people aware upfront so
alternatives can be explored.”
taxi rank
PHILANATHI RASMENI
IT REMAINS a mystery when the
multimillion-rand intermodal taxi rank in Komani
will come into operation.
The rank, which lies between the Komani CBD
and Mlungisi, was supposed to have been
operational in 2014 with construction having
started in 2013.
One of the street vendors who were hoping to
benefit from selling goods at the rank, Veliswa
Dingi, said this week: “We were hoping that our
businesses would benefit. We are disappointed
because people do not come to where we are
because the temporary taxi rank is far from the
shops.”
Commuter Nomfanelo Silwana from Cacadu
said the existing rank was muddy and flooded
and people were often mugged as it was not a
safe area.
The Rep reported (“Still closed”, March 10,
2017) that municipal spokesman, Fundile
Feketshane said the newspaper would be
provided with an appropriate schedule as to the
official opening of the rank when related issues
had been sorted out.
In January this year, Feketshane said, “The
issue of the intermodal taxi rank is still being
discussed internally and once those are finalised
you will be advised of all the logistics around it.”
He repeated the statement this week.
The Rep reported (“Not enough money”, June
6 2014) that the taxi rank was 90% complete. It
was reported (“On the rise”, April 3 2015) that
the project had been allocated R11-million in the
2015/2016 financial year, with R14-million at the
time to be allocated in the 2016-17 financial year.
EFF protests
over arrests
ANDISA BONANI
EFF party members protested
outside the Ezibeleni
Magist rate’s Court on
Monday in support of eight
people who were arrested on
Thursday for defying a
Grahamstown High Court order
by illegally erecting shacks on
municipal land.
Enoch Mgijima Local
Municipality (EMLM) won a court
interdict in October preventing
anyone from occupying the land
– known as the Highway in
Ezibeleni.
Sipho Gcwata, Simphiwe
Jikijela, Nobantu Sinxoto, Nelisa
Gawe, Zandisile Gcwata, Siseko
Fatyela, Sebenzile Mahe and
Novusile Mahe, appeared in the
Ezibeleni Magistrate’s Court and
were charged for contempt of
court by magistrate Xoliswa
Ngwendlu and each granted
R200 bail.
The case was postponed to
March 15 for further investigation.
Sipho, Jikijela, Gawe and
Zandisile, were arrested by the
Ezibeleni station commander
lieutenant-colonel Bekekile Waka
after they approaced the police
station to protest against the fo u r
people who were arrested before
them.
Jikijela said three elderly
residents were among those
arrested and thus the EFF had
asked Waka to arrest them
instead and to release the others.
They claimed they were
threatened and put behind bars,
but that they would continue to
invade the land.
Mahe, 71, who was arrested
with his wife Novusile, 56, said
ON SITE: EFF members protest against the arrest of eight people after shacks were erected on land in Ezibeleni, in violation of an
interdict prohibiting it
Picture: ANDISA BONANI
they were deprived of their
medication during their
incarceration. He said being
arrested was a painful experience
because he had to watch his wife
sleep on a cold cement floor for
four days.
Zolile Matiwane of Matiwane
attorneys who represented the
eight pro bono, said he was
approached by the EFF to assist
the arrested community
members. “We tried so hard to
get them released on Friday but
due to the seriousness of the
case we fell short. All we wanted
to do today was get bail for them
and we successfully did that. The
state initially proposed R500 bail
but due to most them being
unemployed, we managed to get
it reduced to R200.”
EFF MP Zolile Xalisa spoke
outside the court, encouraging
people to continue invading land.
“It cannot be that the young
people of this municipality still
live in their parents’ homes when
there is unoccupied land. The
police will have to arrest all of us
if that is their wish, but we are
not moved or shaken by this
incident and we will continue
standing by those who are
a r r e st e d . ”
EFF councillor in EMLM,
Luthando Amos, advised the
community to be strategic when
they decide to invade land by not
building their shacks during the
day but rather in the evening so
that the police would wake up to
a surprise new community and so
avoid arrests.
THE search for Denise Bartlett, 71, who was
abducted following a house robbery in
Sterkstroom on Tuesday evening, continued
Bartlett and her granddaughter were
assaulted in their home after returning from
Thefts and robberies rife in Komani
LAST Tuesday Red Guard
response officers were
summoned to two
scenarios in which
would-be thieves
grabbed items from
shops and ran away and
a third when an elderly
woman was robbed and
wished to lay a charge.
The police were
summoned and the
matter handed over to
them, operations
manager Willie Reynecke
told The Rep.
On Thursday a
supermarket reported
that two old women had
stolen some items. The
police were called and
the matter handed over.
Response officers were
summoned to a tavern
which had called for help
after a man had been
robbed and stabbed in
the stomach outside the
premises and had run in
for help. The paramedics
were called to attend to
him.
On Saturday another
tavern called for
assistance, saying an
armed man had tried to
rape a woman and
members of the public
were beating the alleged
perpetrator. It was found
that it was a toy gun
which was confiscated.
The woman declined to
open a case.
That night officers
responded to a panic
alarm at a nursing
concern where they
found there had been a
break-in, with a window
forced open and the
burglar bars bent. The
police were called and a
nearby guard pointed out
the suspects who were
apprehended and taken
to the charge office. –
ANC to blame for
outages says DA
THE DA has
indicated that
residents of the
Enoch Mgijima Local
Municipality (EMLM)
should expect more
power and water
outages – and that the
state of affairs should
be blamed on the ANC.
In a statement, DA
caucus leader Chris de
We t said residents had
a “rude awakening” l a st
Wednesday when most
of the town was left
without water and
p o w e r.
“Although the initial
trigger that led to the
damage at the
transformer on the
western station is
believed to have been
caused by a lightning
strike, the rest of the
damage to the network
was totally preventable
if proper maintenance
and the upgrade of the
network was
maintained.”
He said that as a
result of the lack of
maintenance and
upgrading, an incident
which should have
Classic Pizza
taken a few hours to
repair, took a few days.
The power blackout
led to the water supply
also being interrupted
and once the electricity
supply was restored,
the main water supply
pipeline burst and
resulted in a further
delay in restoring the
water supply.
In some instances
some areas were
without water for over
five days.
“What happened over
the last few days has
been extremely
traumatic for the
residents of Komani. It
has caused immense
personal discomfort,
more so to the
vulnerable and the poor.
It had a huge impact on
the vulnerable members
of our society, such as
old people, sick people
and the needy.
“Apart from the
aforesaid, schools and
their activities were
interrupted and
businesses had to shut
down.”
De Wet said it was
impact of the disaster
would run into millions
negatively on investors’
where job creation was
desperately needed.
De Wet commended
the staff of EMLM and
the Chris Hani District
Municipality who
worked through the
night to effect
emergency repairs.
“They were the real
heroes and deserve our
thanks and respect for
what they have done.
Furthermore, from civil
society there was an
amazing surge of
cooperation where
individuals, as well as
organisations, played
an amazing role to
render assistance and
supply information to
our communities.
“These people are
also heroes and proved
that we have awesome
people in our town who
excelled when the need
was there.”
Unfortunately, he
added, the same could
not be said of most of
the high-ranking political
officials who “were
glaring in their absence
during the crises”.
“One would have
expected that the
respective mayors and
their mayoral
committees would have
played an active
leadership role on the
ground to restore basic
services to our people.
Instead they
comfortably remained
in their plush houses,
paid for by taxpayers’
m o n e y. ”
De Wet said the party
had warned against the
scenario of the past few
days, with Komani
having reached the
stage where massive
breakdowns of water
and electricity supplies
could become a regular
occurrence.
“Sadly, due to gross
mismanagement of
municipal finances, the
municipality is now
bankrupt and had to
should go to the ANC
that had “over the last
100th parkrun (all done at Stutt) in the company of
his daughter, son-in-law and two granddaughters. Len
has been a staunch supporter of this parkrun since its
it, but the leak resurfaced on
M o n d ay.
“I told the municipality that it
was still leaking on Monday,
common problem.
“The municipality takes its
IN LOVE: Valentine’s Day is fast approaching
Pictures: SUPPLIED
Ideas on how to celebrate love
S
O Valentine’s Day
is coming up next
week and you
really want to give
your loved one a gift he
or she will treasure, but
your finances have not
yet recovered since
Christmas, especially if
you have children who
went back to school
and needed a myriad of
things.
Time to get out your
thinking cap, get
creative and make
something that will not
break the bank, but will
really touch that special
person’s heart. Come to
think of it, your gift will
probably be even more
appreciated because of
the thought, time and
effort you put into it,
than if you had just
gone out and spent 10
times as much.
So let’s think of some
ideas
You could plant a
little succulent garden.
These plants are all the
rage at present and so
many people have them
that you could quite
possibly ask friends for
little plants.
Get a fairly shallow
container, perhaps even
a tinfoil one that you
bought a lasagna or
some other meal in,
make some small holes
in the bottom, fill it up
with soil and then plant
the succulents
at t ractively.
Then give it a little
water just to settle the
plants, but remember
that succulents don’t
like much water.
There is possibly one
of these at home or you
could use an empty
plastic box that
contained sweets or
biscuits and if you
could find one that is
heart-shaped, so much
the better.
Of course you could
buy a tray of seedlings
and plant them instead
of succulents, but make
sure that they are
small-growing or they
will never come to
fruition in a shallow
c o n t a i n e r.
If your container is
deeper, of course you
can plant something a
little bigger, but check
at the nursery first if
the specific plants you
have in mind will do
indoors, because not all
plants will.
Then there’s an
arrangement that
anyone (even men) can
do so easily and it
looks stunning.
It requires a tall vase
(perhaps a jug or some
other similar container
if you don’t have vase)
and some
long-stemmed flowers
– there need not be
m a n y.
Pick a bunch of
foliage in your garden,
longer than the
container you plan to
use. Hold them in a
bunch and cut them all
off at the same length,
about 10-15cm longer
than the container. Strip
the leaves off the
bottom of the stems, all
those that will be under
water or they will
decompose and create
bacteria which will
quickly kill your
arrangement. Now put
the whole bunch into
the vase and top up
with water.
Now comes the fun
p ar t
Cut the flowers a
little longer than the
leaves, strip the stems
and put them, one by
one, in between the
foliage. The stems of
the leaves provide a
‘framework’ for the
flowers and will hold
them in place.
If the lady in your life
is not into flowers you
could do the same
thing, but instead of
flowers you could use
chocolates or other
treats taped to sosatie
sticks and arranged in
the same way.
A collage of
photos is
a n ot h e r
inexpensive way to
make a welcome
gif t.
Most of us have
dozens of photos lying
around - or perhaps not
so many in this digital
age. If you don’t have,
get some printed (ready
in no time) then have
fun cutting away
unnecessar y
backgrounds or
long-forgotten people
and fitting them
together on a firm
background, and glue
them down.
This is really
something dads and
children can enjoy
doing for the Mom in
their lives.
Perhaps you already
have an empty picture
frame lying around or
there is a huge variety
in the shops (some in
heart shapes) and
when you are done you
can pop it into the
frame or have one
made for your creation.
For that matter, you
could make your own
frame
Do the collage on
something quite strong
(like hardboard) but
edges.
Then glue something
decorative over the
open 5cm that you left,
while for a male you
could use wine corks
THE REPRESENTATIVE 9 Februar y 2018
EDITORIAL
OPINION
Plans for
the future
WHILE the Enoch Mgijima
Local Municipality is
battling a lack of power,
failing infrastructure, potholed
roads and refuse removal
challenges, there is another
issue which is in need of urgent
attention: residential land.
The recent occupation of land
in Ezibeleni has brought to the
forefront the dire need for the
municipality to start focusing
on the organised planning of
the town and surrounding
areas.
Such planning – which needs
professional input in terms of
layout and access to services –
is imperative if the town wants
to grow in a sustainable
manner and in a way which will,
in the future, meet the needs of
residents.
The need for open spaces for
parks, recreation and future
development of business and
suburbs will have to be taken in
consideration. Ezibeleni has
had way too little business
development over the past few
years and while the area
blossoms, opportunity for
growth and for the
entrepreneurial spirit is being
hampered by the lack of space
and plans for a thriving
business hub in the area.
At the same time, desperation
has resulted in people invading
municipal land – a move which
recently led to a court interdict
by the municipality and the
subsequent arrest of people for
disobeying said interdict.
Instead of this becoming a
negative tendency, it should be
sparking EMLM to action in
terms of looking at available
residential land and the setting
out of plots for residential
development.
My fear is, as the past few
weeks have proven, that the
existing infrastructure can not
handle the population growth
being experienced in Komani.
The municipality has indicated,
in The Rep’s front page story
today, that plans are in place to
repair the electrical
infrastructure. Whether any of
that money would go towards
the development of new
infrastructure in areas which
need the development of
residential suburbs, is not
known, but it is necessary.
The building of RDP houses
has to be accompanied by an
investment in infrastructure and
the existing network has to be
maintained. And that’s just
water and power. The
municipality will still have to
consider roads and sewage
network extensions.
It is a mammoth task, but it
will have to be done for the
future of a well-developed and
structured Komani.
Give Ramaphosa the
space to uproot Zuma
PRESIDENT Jacob Zuma has always
attracted drama.
If he was not the president he
would have been the perfect
character in a political drama or a
gangster movie. Many had
underestimated the levels he was
willing to go to stay out of jail and
later to stay in power so as to stay
out of jail. While many were still
mesmerised by his unlikely ascent
to power Zuma summed up that the
strong and independent law
enforcement agencies were an
impediment to him remaining
s c ot - f r e e .
Tu y n h u y s was a ticket to stay safe
and to make his
fa m i l y,
benefactors and
friends rich. If
many South
Africans had their
way Zuma should
be pulled by the scruff of the neck
and chucked out of Mahlamba
Ndlopfu.
They are frustrated with what they
see as the limp-wristed approach of
the ANC and Deputy President Cyril
Ramaphosa towards Zuma. While
that may appear so, ours is a
constitutional democracy so
whatever we do, we have to be
careful not to fix a problem by
creating another.
There are only two ways a
president can be removed: either
via Section 102 – A vote of no
confidence which needs a simple
majorit y.
This is similar to a resignation
and the president keeps his
benefits; or by Section 89 which
needs a two-thirds majority on the
grounds that the president is unable
IN
TOUCH
... with Phumelele P Hlati
to perform his duties or after a
serious violation of the c o n st i t u t i o n
or serious misconduct.
Under this section, the president
is stripped of all his benefits and is
barred from ever assuming public
of f i c e .
Nowhere in our constitution does
the word “recall” appear. Do you see
why the ANC has to be so careful?
He has the ANC, and by
extension, the country, by the throat.
What Zuma is doing may well be
within his rights and is lawful, but
as a politician he has broken every
rule. He is an ANC deployee, so
when that party wants to remove
him, he should
oblige. But
Zuma being
Zuma, he will
not go meekly.
Is Ramaphosa
sof t?
Is he being played by Zuma? I
doubt Ramaphosa is either. He is
biding his time to make sure all the
loose ends are tied up. Some have
accused him of being in a hurry to
be president but his conduct over
the past few days and weeks shows
the opposite.
He has been at pains to make
sure that there is no constitutional
crisis while avoiding a showdown in
parliament between the ANC, Zuma
and opposition parties.
We must give him space to
uproot Zuma from the presidency
with as little damage as possible.
Zuma is finished and he knows it.
He will go by the end of the month
and things will go back to some sort
of normal state.
The opposite is too ghastly to
c o n t e m p l at e .
Question: Do you think
women are recognised
they do in the society?
Answer: I don’t think
women are given enough
recognition and
acknowledgement of the
kind of impact they have
on society. You will find
that in most work places
about it on a daily basis.
Q: What makes you
A: People who pretend
to be something that they
are not upsets me. Life is
unpredictable enough as
it is, and having people
who trap you with the
idea of what they think
is unnecessary.
It’s disgracing our traditional
ritual. Xhosa men’s initiation is
our sacred rite to prove
whether a man is fit to face
through that transition to
manhood. To us it is sad to see
anyone who does not let
circumstances define who
they want to be and what
they want to achieve in
life. I believe you should
never give up, be it your
past, present or your
health issues. Everyone
should live their dream.
Q: What is your motto in
l i fe?
A: Love. Live. Laugh.
Q: What makes you
proud of being a South
A f r i c a n?
A: I am proud to be a
South African because we
are a diverse country that
encounters conflicts
because of diversity but,
through it all, we always
strive together to build a
unified and peaceful
societ y.
Q: Where do you see
yourself in the next five
A: I see myself living
my dream and I want to
inspire and motivate
others through that
dream.
Q: Describe South
No planning
led to crisis
BUSINESSMAN of Komani writes: The inevitable
breakdown of the town’s water and electrical
infrastructure has hit us with a vengeance with the
recent electrical and water outages due to a
variety of preventable causes. Business was hardhit
as were individual households . Some schools
had to send children home as the lack of water
took its toll. Some businesses closed for health
and sanitation reasons. As usual, the poorest who
have a lack of alternative options bore the brunt –
and continue to do so.
The real tragedy here is the lack of planning ,
knowledge of maintaining the infrastructure and
lack of commitment by the so-called leaders of the
town . As far back as 10 years ago, they were
warned by various business and civic
organisations that the current scenario would play
out but sheer arrogance and their refusal to take
advice has led to the current situation which will
continue periodically into the future .
Just as the leader of our country has set us
back a decade or more in terms of economic
development , so have the so-called leaders sent
Komani back into the dark ages .
Business cannot expand with confidence, which
means less employment opportunities. It is going
to take literally hundreds of millions of rands to
repair roads, fix the water issues and get our
electricity issues to an acceptable level. Komani
has not had a true leader since former mayor
Mzwabantu Dapula left. The sooner the
incumbents are booted out and replaced by
competent, real leaders with a vision, we will
continue to wallow in misery in this town . Thank
God that the quality and character of many of the
people of this town mitigates against the appalling
lack of leadership .
street lights were off. My family couldn’t believe it,
it was humongous!
provide a family
facilities, give moral
support and even to help
when, for instance, the family
lives far from the treatment
undergoing therapy. In some
cases they could be away from
ROUND&ABOUT
Boost battle against
childhood cancer
A story that appeared in the
Daily Dispatch this week
described the ordeal of a mother
and her little girl who was
diagnosed with cancer when she
was only two.
Describing the trauma of
numerous operations and
other procedures over a
period of more than two
years, the mother says,
“CHOC really stood by me.
There is also a social
worker in the ward whose
support is mind-blowing
and the paediatric
oncologists were
fa n t a st i c .
“They said I could go
to a private hospital, but I chose
to stay with the state because of
the fabulous support you get.
There is a family environment
and always another mom to
speak to.”
This mother’s link with CHOC
has not abated since her
Laughter awaits at the Queens Casino
known as Goliath and Goliath.
Sheree O’Brien of the management
company is a well-established artist
manager, media, entertainment, music
and television maverick who has spent
no less than 20 years in this country
and abroad. She identified a gap in the
market for comedic entertainment which
would become a culture ... and no one
will argue that citizens of this country
could do with something really funny.
“To see the rainbow nation in one
room, laughing together over some
thought-provoking and often
daughter’s recovery. (This year
the little girl started Grade R).
“Other moms and gogos at
Frere had more challenges than I
did. They would lock up their
homes in rural areas and come
to East London for months at a
time. This is where CHOC would
step in to help them. That is why
I want to give back by supporting
CHOC,” which is why she feels it
imperative to impress upon
people that the early detection of
childhood cancer enables a
better chance of survival.
“There are a lot of very sick
kids,” she said.
So if you support this
worthwhile cause make sure you
don something blue next
Thursday and make your
financial contribution by buying
a badge and/or chocolate from
Stepping Stone School on the
corner of Livingstone Road and
Peacocke Street.
ROUND OF APPLAUSE: Outgoing chairman of Queenstown Round Table Dean Goldschmidt, left,
hands over the Tabler of the Year award to Darryl Aspey at the club’s recent induction dinner
controversial topics that the comedians
raise, is heart-warming. Comedy has the
power to unify,” she said, adding that
the show will appeal to all cultures and
language groups. Local comedians are
welcome to get in touch with the
company if they would like to become
part of the line-up.
“It’s no secret that Komani lacks
variety on the entertainment scene and
Hadley’s Sports Bar is to become the
‘funny centre’ of the town,” Queens
Casino and Hotel general manager John
Rademan said.
PRIMEPROPER TY
Avoid rental deposit conflict
ORRIED about
how to handle
Wrental deposits?
Here is some advice from
Leapfrog Property Group
CEO Bruce Swain.
The ABC of rental
deposits
Possibly one of the
biggest sources of
contention between
landlords and tenants
surrounds the rental
deposit.
“Most tenants rely on
getting their rental
deposits back when
moving, so they can use
it to pay a deposit on
their new home. Having it
withheld or even having
large amounts deducted
can lead to a lot of
dist ress,” S wa i n
explained.
What to do when paying
a deposit
Do a pre-occupation
inspection
According to the Rental
Housing Act, landlords
(or the managing agents
representing them) are
permitted to request a
tenant to pay a deposit
before taking occupation
of a property – although
the act does not provide
guidance as to the
amount.
“It is very important for
both landlords and
tenants to note that a
landlord (or managing
agent) who doesn’t
conduct a pre-occupation
inspection with the new
tenant, loses the right to
claim against the tenant’s
deposit when they move
out,” said Swain.
Check that the deposit
is invested
Swain highlighted the
fact that landlords are
required to pay their
tenant’s deposits into an
interest-bearing account
with a financial
i n st i t u t i o n .
Getting a deposit
retur ned
According to the Rental
Housing Act, the tenant
and landlord have to do a
joint inspection of the
property before the lease
expires. Should the
landlord or managing
agent fail to do so, they
will not be able to claim
against the tenant’s
deposit.
Upon the end of the
lease period, the landlord
may then deduct from the
accrued interest and
deposit to effect any
repairs the tenant may be
liable for. The remainder
of the combined sum
(accrued interest and
deposit) must then be
refunded to the tenant,
no later than 14 days after
the tenant moved out.
“Tenants are allowed to
request that the landlord
provide a written receipt
of all payments made,
including proof of the
interest earned on the
deposit.”
Deductions may not be
made for defects that
existed before the tenant
moved in, or that can be
considered as part of “fa i r
wear and tear”.
“It’s important to note
that tenants may not be
eligible for the accrued
interest amount if they’re
renting through an estate
agent. This is because,
unless otherwise
indicated in the lease
agreement, the agent is
required to deposit the
interest earned in to the
Estate Agents Fidelity
Fund – as per the Estate
Agency Affairs Act of
1 9 76 , ” explained Swain.
Swain pointed out that
tenants can ask for the
rental contract to indicate
that the interest be paid
to them “subject to any
written agreement in this
Institute of Estate
Agents
of South Africa
regard between the agent
and such party’.
“Tenants need to be
aware that a percentage
of the interest may still be
used to cover the agent’s
administrative expenses
in this case.”
It is critical that both
landlords and tenants
read through their rental
contracts carefully before
signing and familiarise
themselves with the
legalities around rental
deposits.
THE REPRESENTATIVE 9 Februar y 2018
LEARNING VCURVE: WSU Queenstown campus rector Professor McGlory
Speckman and the university vice-chancellor Professor Rob Midgely sing
the national anthem at the institution’s welcoming day for new students
in Whittlesea
Picture: ANDISA BONANI
WSU to implement
free education now
ANDISA BONANI
WALTER Sisulu University (WSU) is
ready to implement free education as
was announced last year by President
Jacob Zuma and which falls within
stipulated parameters.
The WSU Queenstown campus
which includes the Whittlesea site,
held a welcoming day for first years in
Whittlesea prior to orientation week.
Speaking at the event attended by
new students, parents, university
management and staff, WSU
vice-chancellor Professor Rob Midgely,
said the Fees must Fall movement had
been a great idea “which pointed out a
problem in society that needed to be
corrected”.
“I do not agree with the way in
which it was conducted but I totally
agree with the principle. WSU is
committed to ensuring that whatever
government decides would assist
students, to be part of it. Many people
regard this as free education but it is
assisted education. Students will not
be expected to pay registration fees or
the minimal initial payment, the
government will do that. It is important
for parents, staff and students to
understand that all first years whose
family income is below R350000 per
annum will be given a bursary upon
application by the National Student
Financial Aid Scheme (NSFAS). If their
income is above the said amount, then
fees would have to be paid.”
Returning students on NSFAS aid
would still be expected to pay back the
money when they are in a position to
do so. As soon as government can find
money, loans will be converted to
bursaries.
Midgely added that WSU was owed
R800-million by students in debt and if
that amount were to be paid, the
institution would make provision for
student residences and an agriculture
facility at the Whittlesea site.
The Student Representative Council
(SRC) president Lerato Tshefu, said he
would ensure that all the new students
were registered and that his office was
available for all those with academic
issues.
on Saturday and contributed R200 each to see who
Brown, Hammill in top form
THIS Saturday the golf club was a hive of
activity again with the annual GHS golf day
taking place.
The event drew just over 100 players
including a junior section that played nine
holes.
The organising committee of the day can
be commended on a slick, well-organised
golf day. The junior section was probably
the most pleasing part and is something
the golf committee would like to see
included in every fundraiser golf day.
The format for the day was a betterball
Stableford and the prize winners were as
follows: 1st – Garry Brown and Martin
Hammill; 2nd – H Bezuidenhout and John
de Villiers; 3rd – Johnny Poyo and Nzame
Breakers are now fifth
in Group A of the Eastern
Cape Super 12
championship log with
four points. The Mlungisi
side were beaten 26-17
by Star of Hope in
Uitenhage last weekend.
Star of Hope top the
group with 11 points after
two wins and a draw in
the washed out match
against Ntlaza.
Mathematically, Breakers
can still reach the
semifinals but it will
mean the top two teams
must lose all their
remaining matches and
with Gardens regaining
form it should be a
three-horse race for the
two top spots, with Parks
also unbeaten.
unforgiving mood and
made clear their
intentions of fighting for
a knockout spot after
suffering a surprise loss
in their first match
against Star of Hope.
These should be
worrying signs for
Breakers, who face them
this weekend. Parks
romped to a five-pointer
in their 41-15 demolition
job of Buffs to move to
second in the group.
In Group B, Swallows
continued their
impressive form and
made it three out of three
with a clinical 33-8 win
over Berlin Tigers. One
more win and Swallows
could be the first team to
reach the semis, but a
week off will keep the
champagne on ice.
Harlequins defeated
Despatch 39-26 to move
to second on the log on
10 points. Kruisfontein
heaped further misery on
a deflated Police outfit
with a 34-24 win. The
Bobbies have been way
below par this season
and the former winners
and 2017 finalists have
already been dumped out
of the competition.
Four matches take
place tomorrow with
Breakers facing their
hoodoo team, Gardens, at
Mlungisi Stadium.
Breakers have never
beaten the Uitenhage
outfit, suffering
numerous defeats at
Mlungisi Stadium and
away. Known to travel
with their passionate
support, Gardens are on
a mission to revive their
hopes for a semifinal
spot with Breakers only
playing for pride. It’s a
top-of-the-table clash
with Park hosting Star of
Hope. Either result will be
good for Gardens who
are hot on their heels if
either team drops points.
Phoenix rules
mini tourney
ANDISA BONANI
PHOENIX Football Club won the
Under-13 mini soccer tournament
after they beat Young Stars FC
1-0 in the final at the Dumpy Adams
Stadium on Saturday.
Three teams battled it out at the
weekend to see who would emerge as
the winner.
Juluka FC took on Young Stars in
the first match, and were beaten 2-0.
Juluka dominated the game in the
first half but struggled to get the ball
into the back of the net. After both
teams had regrouped and got advice
from their respective coaches, Young
Stars brought their A-game and
scored two goals, which automatically
granted them a spot in the final.
The final between Phoenix FC and
Young Stars saw a goal being scored
in the first half by Kamva Thanga of
Phoenix.
Kamva said he was happy to have
helped his team win the tournament
and, had it not been for a team effort,
they would have lost because Young
Stars were a great team. Phoenix
coach Ringo Klaas said the
tournament was good practise for all
the teams that participated, in
preparation for the Junior League,
which is set to start this month.
“I am very proud of all the teams
that played. This is not really a
competition but a means to motivate
children and help them hone their
skills. We celebrate with other teams,
even when we have lost to eliminate
jealousy and instill positive energy
among them,” Klaas said.
Excitement builds for
Great Kei Trek MTB Ride
MADELEINE CHAPUT
AFTER great excitement and anticipation,
the Great Kei Trek was officially launched
in East London last Thursday.
Over a festive meet-up at Country
Bumbkin, organiser Rob Jackson from the
Leverage Corporation and his local team
proudly introduced the three-day
Mountain Bike experience.
The stage race is set to take place
from April 28 to 30 and will cover a
total of 260km starting in Komani.
The two- rider team race will
see riders meander through
some of the Eastern Cape’s
forgotten gems including
Old Thomas River, the
Stutterheim forests and
Great Kei River Valley, before
ending in Morgan’s Bay.
“This area is one of the
most ignored parts of our
country, but it is beautiful
and we’re hoping to bring as
many people to this area,” said
Jackson, who grew up in Komani.
Focussng on the enjoyment of the ride
and the area, the race will not be timed
with the emphasis on having fun.
“I’ve wanted to do something like this
for a long time and I’m so glad that Rob
and the Leverage Corporation have the
same ambitions for this area,” route
planner and Stutterheim resident, Dean
Sheard, said.
Following the tradition of creating top
class and high quality events, The
Leverage Corporation promises that this
will be a race like no other.
Riders are in for a true Eastern Cape
experience as various local farm owners
along the route have generously offered
access through their land. Cycling along
some of the old cattle and sheep passages
that farmers used in the first half of the
1900s, riders will be treated to the
interesting history of the area, with their
fist overnight stop in the historical village
of Old Thomas River.
The village is situated in the Northern
slopes of the Amatola mountain range,
where 19 farmers have made over 31 000
hectares of beautiful farmland available
for conservation and recreation. Some
other highlights will be the stunning Qacu
Forest Reserve, the impressive Chaba
Wind Farm and the Kubusie Valley.
“The Kubusie Valley cycle is one of the
most spectacular rides through a valley
that I have ever done,” said Sheard.
Riders will be provided with tented
accommodation and meals which is all
included in the entry fee. Entries close
once a field of 150 teams of two riders is
reached, or on April 4.
Various sponsors have come on board
in an effort to make the event one not be
missed. Sponsors include Bidvest,
Bridgestone, Luxliner, Splashworks portion
of the proceeds will be donated to various
Non Profit Organisations within the area.
