14 I NEWS I Your Legacy Law Matters January 9, 2019 MID RIVERS NEWSMAGAZINE Life is short. The older I get, the more evident that becomes. When I was young, 30 seemed so old; 60 seemed like forever and 70 was an eternity; and 80 or 90 was just incomprehensible nonsense. And then suddenly, it’s here. We don’t necessarily feel that old. In fact, in our heads, we’re still 25 or 30, but the mirror tells us something entirely different. How can all of that happen? And when you start to think about the brevity of life, you can start to think about what your life has meant. We take ourselves entirely too seriously (and probably rightfully so) to just see ourselves as some passing mist – here today and gone and forgotten tomorrow. Many people start to think about their legacy – when we’re gone, how will people remember us? That was brought home to me recently when working with some business owners. They had spent most of their adult years nurturing and growing a business, and now time was catching up. They wanted to plan what to do carefully so there wasn’t a train wreck when they died, but they were having trouble letting go. This is very common. One of the business owners had a child involved in the business and two others who weren't He really wanted things to end harmoniously for the family as a whole, protect the son in the business because of the grandchildren, and also protect the employemployees, some of whom had been with him for years. It was sort of a complex calculus. Another business owner didn’t have any family active in the business, but the business was the principal asset of his estate. The most likely successors to his business were some key employees. So he wanted to plan a fair transition that protected employees while also providing an inheritance for his family. Although there may be similarities in different business plans like this, I have found that subtle differences in focuses can have major impacts on the resulting plan. The dynamic relations between family members can result in vastly varying solutions. The complex politics of a business can require a carefully finessed plan that makes individuals feel valued without undermining the operation of the business. (636) 537-7884 | fvilbig@shandselbert.com | www.law-matters.net By BRIAN FLINCHPAUGH Every weekday, more than 200 homebound seniors in St. Peters count on a hot meal delivered around lunchtime by a friendly volunteer as part of the Meals on Wheels program. As of earlier this month, St. Peters city officials said the program has gotten another strong boost going into 2019 from fundraising efforts that are allowing one of the few remaining fresh Meals on Wheels programs in the St. Louis region to continue. Alderman Jerry Hollingsworth [Ward 2] said at the city’s Board of Aldermen meeting on Dec. 20 that a check for $20,156 raised at annual trivia night on Oct. 19 was presented at a Christmas party on Dec. 19 at the St. Peters Senior Center. The trivia night is hosted by Mayor Len Pagano, the board of aldermen and Central County Fire and Rescue. City officials said about $20,200 in contributions from St. Peters utility customers through the “Dollar Up” program also was raised in 2018. Residents can elect to include a “dollar up” donation as part of their water and sewer payments. Those donations also fund the Meals on Wheels program. St. Peters utility customers have contributed $94,251 through the dollar up program since its inception in 2012. Some utility customers also have the option of rounding up their utility bill to the next dollar amount. This has raised more than $4,300 this year. The fundraising effort began as a result of the state and federal budget cuts that began in 2011. “Federal and state governments, they mismanage our tax dollars incredibly,” Hollingsworth said in an interview. “What happens is that with people with disabilities and seniors, they go to their programs and that’s where they start cutting and that’s what happened with the Meals on Wheels program.” He said St. Peters and possibly one other senior center deliver hot meals in the St. Louis region. “What happens is that [most programs] are delivering five frozen meals on Monday,” he said. “Some seniors are going to struggle with how to heat them. Do they have a microwave? Can they open the packaging? “Probably even more important is by delivering that one time a week [seniors] lose the human touch they get with delivering on a daily basis. The meal is secondary.” Hollingsworth lauded the role and contributions of the Central County Fire and Rescue, saying their help has been critical to the success of the annual trivia night, which has raised more than $20,000 annually for the last few years. Central County also has provided backup for volunteer drivers delivering meals. If there is, say, a four-inch snowfall that may discourage volunteers, many who are seniors and shy about driving in snow, Central County personnel often deliver meals, Hollingsworth said. “Those guys are incredible.” Central County personnel and volunteers deliver meals prepared by the St. Peters Senior Center. On the day of the Christmas party, 205 meals were delivered. Hollingsworth said it used to be that 150 to 160 meals were delivered daily but the number has gone up dramatically. “For a sleepy community between two giants, O’Fallon and St. Charles, we do a pretty good job. I’m sounding like Mayor Pagano for God’s sake,” Hollingsworth said with a laugh. “You know what, he’s a great ambassador for our city.” Hollingsworth added that St. Peters is a giving community with great volunteers. “We keep trudging down the road, doing what needs to be done,” he said. Some of the ways St. Peters raises money are being copied by other communities around the state. In 2014, the city’s voluntary dollar up program was recognized by the Missouri Municipal League. Hollingsworth said he’s gotten no indication yet if state funding for Meals on Wheels faces new cuts. The Missouri General Assembly will have new members in the coming legislative session and “I don’t know what this new batch of guys is facing as far as deficits,” he said. “I don’t see it dying as long as we keep promoting and pushing it,” he said. However, like a lot of nonprofit efforts, Hollingsworth said there is a continuing need for young and new volunteers – and he put in a plea for help from some of the largest companies coming into the city. “Just a shout out to our new neighbors at Amazon, if you have any charitable feelings in your bones, I would be more than happy to come to talk to you about the Meals on Wheels program in St. Peters. “We would greatly appreciate it.” – Jerry Hollingsworth

Emery. The crime spree, which also included firing on two police officers and stabbing a woman in an attempted carjacking, began in what St. Charles Police describe as a quiet neighborhood at a home in the 100 block of Whetstone Drive. The crime was unlike anything most authorities have ever seen in St. Charles County. “I’ve been here five years and I can’t think of any case where we have four victims, three assaults and an attempted carjacking,” said Leslie Knight, a spokesperson for St. Charles County Prosecuting Attorney Tim Lohmar. Lt. Tom Wilkison, public information officer for the St. Charles Police Department, said, “I’ve been here 16 years and I’ve talked to guys that have been here 30 years and they’ve seen nothing like this.” The Major Case Squad investigation is complete, but its results are not expected to be widely shared. “We’ll probably be pretty tight-lipped on this one,” Knight said. Emery faces counts on 15 crimes according to charges filed by the prosecuting attorney’s office on Dec. 29 – four counts of murder in the first degree, seven counts of armed criminal action, one count of attempted robbery in the first degree, and three counts of assault in the first degree. It began with a 911 call at about 11:55 p.m. to the St. Charles City Police dispatch for “shots fired” in the 100 block of Whetstone Drive. According to the probable cause statement filed with the prosecuting attorney’s office, the dispatcher could hear “apparent gunshots in the background and advised responding officers.” At 11:58 p.m., officers arrived on the scene and observed Emery getting into a white Chevy Silverado and trying to leave the subdivision. Officers attempted to stop the vehicle, which first failed to yield but eventually stopped at the intersection of Cheshire and Muegge roads. Police said Emery exited the truck, displayed a handgun and fired multiple shots at two police officers. The shots struck the police vehicle eight times in the open driver’s door, door frame and grill. Officers returned fire until Emery ran out of sight. None of the officers were injured. Meanwhile, officers at the residence found four victims of gunshot wounds. On the phone line, with gunshots audible, was Jane Moeckel, 61, who had barricaded herself in a downstairs room with her two grandchildren, Zoe, 8, and Jonathan, 10. The three were found dead. Kate Kasten, 39, the mother of the children, was found wounded in a north bedroom and was transported to a hospital where she died. At about 1:32 p.m. police received a call for a stabbing. The victim described a suspect similar to Emery who told her, “I gotta get out of here,” and attempted to take her vehicle. He then stabbed her multiple times in her torso and fled on foot, which prompted an extensive seven-hour manhunt. The victim was taken to a hospital where she was reported to be in critical but stable condition. At 7:23 a.m., police responded to a 911 call from a Quick Trip in the 2000 block of First Capital Drive regarding a white male bleeding heavily from a possible gunshot wound who had entered a bathroom there. Emery appeared to be suffering from gunshot wounds when he was taken into custody. According to the probable cause statement, Emery asked if the lady he tried to carjack was OK. He also apologized for shooting at the officers. Emery’s handgun and knife were located by investigators based on his statements to officers. Police said Emery lived at the home on Whetstone Drive and was Kasten’s boyfriend. The children were from her marriage to Kory Kasten, who died in April 2017 after a six-year battle with cancer. A GoFundMe page has been established to help pay for funeral expenses. Meanwhile, as Emery waits in jail without bail, a case review was scheduled for Jan. 8 before Circuit Judge Terry Cundiff.
